1. FREE SESSION APPLY TO TERMS/CONDITIONS
With free sessions all the rules of the terms and conditions apply as well.
2. SERVICES & DELIVERABLES
Wildflower by Lanie Photography (“Photographer”) agrees to provide the photography services described above and in any attached invoice or package description. The exact session length, locations, number of delivered edited images, and other deliverables are the items agreed upon at booking. If there is a conflict between this agreement and an invoice, the parties should resolve the conflict in writing before the session.
3. BOOKING & RETAINER
The date is reserved only after this agreement is signed and the required booking retainer/deposit is paid. The retainer amount is the amount stated above or on the invoice. Unless otherwise agreed in writing, the retainer is applied toward the total fee and is non-refundable because it compensates Photographer for reserving the date and declining other work. Any remaining balance is due by the due date stated on the invoice.
4. PAYMENT
Accepted payment methods: Venmo, Zelle, Apple Pay or Cash. Client agrees to pay any applicable travel, permit, venue, parking, or other third-party fees that were disclosed before booking. No final gallery or other deliverables will be released until the account is paid in full, unless Photographer agrees otherwise in writing.
5. RESCHEDULING & CANCELLATION
For portrait, pet, family, and engagement sessions, Client may request one reschedule with at least 2 days’ notice, subject to Photographer’s availability. For weddings and events, rescheduling and cancellation terms will be governed by the date-specific terms on the invoice, with the booking retainer remaining non-refundable unless otherwise required by law or agreed in writing. If Client cancels without a contractual right to a refund, amounts already paid may be retained to the extent permitted by law. Photographer may offer a future credit at Photographer’s discretion.
6. WEATHER, EMERGENCIES & FORCE MAJEURE
For outdoor sessions, Photographer may recommend rescheduling because of unsafe weather, smoke, hazardous conditions, or other circumstances that materially affect safety or the ability to create the agreed work. Photographer may also reschedule because of illness, emergency, equipment failure, natural disaster, government restriction, venue closure, or another circumstance beyond reasonable control. Photographer will make reasonable efforts to provide a replacement date or, where appropriate, a qualified substitute photographer. If no reasonable replacement is possible, Photographer’s liability is limited to amounts actually paid for services not provided, except where applicable law requires otherwise.
7. CLIENT RESPONSIBILITIES
Client agrees to arrive on time, provide accurate information, obtain any required venue/property permissions, and communicate relevant accessibility, pet, family, or event needs in advance. For weddings and events, Client is responsible for providing a reasonably accurate timeline and a designated contact person when appropriate. Photographer is not responsible for missed images caused by Client lateness, lack of access, restrictions imposed by a venue, guest interference, or events outside Photographer’s control.
8. PHOTOGRAPHIC STYLE & EDITING
Client acknowledges that Photographer’s portfolio represents Photographer’s artistic style. Photographer retains creative discretion over composition, posing, lighting, color, cropping, and editing. RAW/unedited files are not included unless specifically stated in writing. Client may request reasonable retouching or editing adjustments when offered by Photographer, but Photographer is not required to reproduce another photographer’s style or provide extensive alterations outside the agreed package.
9. IMAGE DELIVERY & ARCHIVING
Edited images will be delivered through an online gallery or other agreed method. Suggested delivery targets are approximately 2–4 weeks for portrait/mini/engagement sessions and 6–10 weeks for weddings and larger events, unless a different timeframe is stated on the invoice. Photographer will make reasonable efforts to retain delivered files for 6 months after gallery delivery; Client is responsible for downloading and safely backing up delivered images.
10. COPYRIGHT & CLIENT PRINT/SHARING RIGHTS
Photographer retains copyright in the photographs. This agreement grants Client a personal-use license to download, print, and share delivered images for non-commercial purposes, provided the images are not altered in a way that misrepresents Photographer’s work. Client may not sell, license, submit, or use the images for commercial advertising or other commercial purposes unless a separate written commercial-use license is agreed.
11. COMMERCIAL / BUSINESS USE
For headshots, branding, professional profiles, websites, advertising, publications, or other business use, the parties will specify any commercial usage rights in writing. Unless the invoice expressly grants commercial rights, the standard personal-use license above does not include paid advertising, resale, licensing, or transfer of image rights to another business or organization.
12. MODEL & PORTFOLIO RELEASE
Client grants Photographer permission to use images of Client for Photographer’s portfolio, website, social media, studio samples, advertising, competitions, and other lawful promotional purposes, unless Client selects the opt-out below. Photographer will not knowingly identify a minor by full name in promotional materials without separate permission. For wedding/event groups, Client understands Photographer may photograph guests and agrees to communicate any reasonable privacy restrictions to Photographer in advance.
13. MINORS & PETS
Client confirms that they are the parent/legal guardian of any minor for whom they provide consent, or that they have obtained the necessary permission. Client is responsible for the safety and control of their pets during sessions. Photographer is not responsible for pet-related injury, property damage, or loss caused by an uncontrolled animal, except to the extent caused by Photographer’s negligence or as otherwise required by law.
14. LIMITATION OF LIABILITY
Photographer will use reasonable professional care. If an unforeseeable circumstance results in loss, corruption, or failure of images, Photographer will make reasonable efforts to recover or recreate the work when possible. To the extent permitted by law, Photographer’s total liability arising from this agreement will not exceed the amount actually paid by Client for the affected services. Nothing in this agreement is intended to waive rights or remedies that cannot legally be waived.
15. COOPERATION & SAFE WORKING ENVIRONMENT
Photographer may stop or decline a session if Photographer reasonably believes the environment is unsafe, threatening, discriminatory, harassing, or otherwise unsuitable for professional work. Client agrees to treat Photographer and assistants with reasonable respect and to follow safety instructions. No refund is guaranteed when a session is ended because of Client misconduct or unsafe conditions caused by Client or Client’s guests, except as required by law.
16. AGREEMENT CHANGES
Any changes to the package, date, location, deliverables, or other material terms should be confirmed in writing, including by email or an updated invoice/contract. This agreement and its attached invoice/package description represent the parties’ understanding of the booked services.
17. GOVERNING LAW & DISPUTES
This agreement is intended for use in Washington. The parties agree that Washington law will govern the agreement to the extent permitted by law. Any dispute will first be addressed in good-faith communication between the parties. If a dispute cannot be resolved informally, the parties may pursue any remedies available under applicable law.
18. ELECTRONIC SIGNATURES
The parties may sign this agreement electronically if they agree to conduct the transaction electronically. The parties should retain a copy of the signed agreement and any attached invoice.
19. SIGNATURES
By signing below, the parties acknowledge that they have read, understood, and agree to the terms of this Photography Services Agreement and the attached package/invoice.
