I am about to observe, participate in, crew aboard a vessel in, or otherwise take part in a sailboat race, regatta, race-related activity, or other event conducted under the direction or sponsorship of the Quantico Yacht Club, hereinafter referred to as "QYC," aboard, adjacent to, or in waters associated with Marine Corps Installation National Capital Region, Marine Corps Base Quantico, Virginia, hereinafter referred to as "MCINCR-MCBQ."

I understand that QYC is a non-federal entity and is not an agency, organization, instrumentality, or component of the United States Government, the Department of Defense, the Department of the Navy, the United States Marine Corps, or Marine Corps Base Quantico.

I understand that QYC is operating and conducting activities on or in connection with MCINCR-MCBQ by permission of the Federal Government and subject to applicable terms, conditions, regulations, policies, and restrictions.

I understand that my observation of or participation in a QYC sponsored race or related activity may involve access to MCINCR-MCBQ, an active military installation that includes ranges, training areas, waterfront facilities, docks, piers, roadways, recreational areas, and other areas used for military operations and training.

I understand that military training and operations conducted aboard MCINCR-MCBQ may create hazards that are not normally associated with civilian recreational facilities. These hazards may include, but are not limited to, military training activities, ammunition or training residue, manmade or natural obstacles, restricted areas, moving vehicles or vessels, waterfront hazards, uneven terrain, and rapidly changing environmental conditions.

I understand that weather and environmental conditions may increase the risk associated with participation in a QYC event. These conditions may include extreme heat, humidity, cold, wind, rain, thunderstorms, lightning, poor visibility, strong currents, tides, wakes, waves, debris, submerged objects, and other conditions that may increase the likelihood of accident, illness, injury, property damage, or death.

I further understand that QYC sponsored sailboat races, regattas, and related activities are water-related recreational activities that involve inherent risks.

These risks include, but are not limited to:

Drowning or near drowning.

Falling overboard.

Capsizing, grounding, sinking, flooding, or swamping of a vessel.

Collision with another vessel, dock, pier, buoy, navigational aid, shoreline, fixed object, or submerged object.

Injury resulting from sails, lines, sheets, halyards, winches, blocks, booms, spars, rudders, rigging, anchors, engines, electrical systems, or other vessel equipment.

Slipping, tripping, or falling aboard a vessel, dock, pier, ramp, shoreline, or other waterfront area.

Sudden movement of the vessel caused by wind, waves, wakes, currents, tides, maneuvering, or contact with another object.

Exposure to severe weather, lightning, extreme temperatures, sun, wind, rain, or cold water.

Electrocution or electrical injury associated with vessel electrical systems, shore power, batteries, equipment, or contact between rigging and electrical sources.

Equipment failure or malfunction.

Errors in navigation, boat handling, judgment, communication, or decision-making by the skipper, crew, race committee, other participants, or third parties.

Actions or omissions of other vessels, competitors, recreational boaters, commercial vessels, military vessels, or other waterway users.

Physical exertion associated with sailing, including lifting, pulling, climbing, balancing, hiking, grinding, trimming sails, handling lines, and moving around a vessel.

Muscle strains, sprains, tendon injuries, joint injuries, fractures, cuts, bruises, burns, head injuries, or other bodily injuries.

Delay in access to emergency medical care due to the location of the vessel or event.

Property damage or loss involving vessels, personal equipment, vehicles, trailers, or other property.

Serious bodily injury or death.

I understand that sailing and sailboat racing are inherently dangerous activities and that no race organizer, race committee, skipper, vessel owner, club, government agency, or other person can eliminate all risks associated with participation.

I understand that participation in a QYC sponsored race is voluntary.

I understand that each skipper is responsible for determining whether the skipper, vessel, and crew are capable of safely participating in the race based on weather, vessel condition, crew experience, equipment, and all other relevant circumstances.

I understand that the decision to start, continue racing, or remain on the water is the responsibility of the vessel's skipper and participants.

I acknowledge that race officials, QYC officers, volunteers, committee members, or representatives may provide race information, sailing instructions, notices, course information, weather information, safety information, or other guidance. I understand that such information does not relieve the skipper or participants of responsibility for the safe operation of the vessel or the decision to participate.

I understand that QYC may conduct races or related activities on the Potomac River, Quantico Creek, adjacent waterways, waterfront facilities, or other locations associated with MCINCR-MCBQ. These waterways may be used simultaneously by recreational vessels, commercial vessels, military vessels, law enforcement vessels, and other waterway users.

I understand that participation may require compliance with applicable federal, state, local, military installation, United States Coast Guard, racing, navigation, and safety requirements.

In consideration for being permitted to observe or participate in a QYC sponsored sailboat race, regatta, or related activity, I freely and voluntarily accept and assume all risks associated with my participation, whether known or unknown, foreseeable or unforeseeable, including risks that may result in property damage, serious bodily injury, illness, accident, or death.

I understand and acknowledge that QYC is a non-federal entity and that QYC sponsored events are not official activities of the United States Government.

I further understand that permission granted to QYC to conduct activities aboard or in association with MCINCR-MCBQ does not constitute sponsorship, endorsement, supervision, or responsibility for the activity by the Federal Government.

In consideration for the privilege of participating in or observing QYC activities aboard or associated with MCINCR-MCBQ, I freely and voluntarily, and intending to be legally bound to the fullest extent permitted by law, waive and release any claims, demands, causes of action, or other legal actions I may have arising from accident, injury, illness, property damage, or death resulting from my observation of or participation in QYC sponsored activities against the following:

The United States of America.

The Department of Defense.

The Department of the Navy.

The United States Marine Corps.

Marine Corps Installation National Capital Region.

Marine Corps Base Quantico.

Any command, organization, agency, employee, service member, official, representative, medical provider, successor, or assign of the United States Government associated with MCINCR-MCBQ or the activities described herein.

I understand that this waiver includes claims arising from my participation in or observation of QYC activities, including claims that may involve negligence, to the extent permitted by applicable law.

I understand that this waiver applies to me and, to the extent permitted by law, to my spouse, parents or guardians, heirs, executors, administrators, estate, legal representatives, and any other person who may assert a claim on my behalf.

I understand that by checking "YES" and electronically acknowledging this waiver, I am acknowledging that the Federal Government and its agencies, officials, employees, and representatives are not responsible for injuries, illness, property damage, or death that I may sustain as a result of my participation in or observation of QYC sponsored activities.

I understand that QYC is a separate non-federal entity and that participation in a QYC sponsored race or event is undertaken voluntarily and at my own risk.

I acknowledge that I am responsible for my personal safety and for following all applicable laws, regulations, race rules, sailing instructions, safety requirements, and lawful directions associated with the event.

If I am serving as the skipper or person in charge of a participating vessel, I acknowledge that I am responsible for the safe operation and seaworthiness of my vessel, compliance with applicable safety requirements, and the decision to start, continue, or retire from the race.

If I am participating as crew, I acknowledge that I voluntarily accept the risks associated with sailing aboard the participating vessel and understand that the skipper or person in charge has primary responsibility for the operation of that vessel.

I understand that participation in a QYC sponsored event may be denied or restricted if I decline to execute or electronically acknowledge any waiver of liability required by MCINCR-MCBQ, QYC, or other applicable authority.

By registering for, observing, or participating in a QYC sponsored race, regatta, or related activity, and by electronically accepting this waiver, I acknowledge that:

I have carefully read this waiver in its entirety.

I understand that QYC is a non-federal entity and is not part of the Federal Government.

I understand the inherent risks associated with sailing, sailboat racing, water-related activities, and activities conducted aboard or in association with MCINCR-MCBQ.

I voluntarily accept and assume those risks.

I understand that these risks may result in property damage, serious bodily injury, illness, or death.

I understand the rights and claims addressed by this waiver.

I voluntarily agree to the terms and conditions contained in this waiver.
