I, the volunteer applicant, understand that the volunteer applicant is not an employee, agent, subcontractor, or independent contractor of Kingdom Bound Ministries, Inc., Project Lab, or Sheridan Parkside Life Center. I understand that my volunteer position is not a contract for hire, expressed or implied, and is with no promise of compensation or employment. I further understand that Kingdom Bound Ministries, Inc., Project Lab, or Sheridan Parkside Life Center will not provide me with any pay, compensation, insurance coverage, worker's compensation or any other benefit to which an employee may be entitled in consideration of my being allowed to volunteer for the purpose of general festival help or for any other purpose.
I, the volunteer applicant, hereby release, forever discharge and agree to defend, indemnify and to hold harmless, Kingdom Bound Ministries, Inc., Project Lab, or Sheridan Parkside Life Center, and its officers, directors, employees, agents, contractors, subcontractors and subsidiaries, from and against any and all liability, claims, action or actions, cause and causes of action, suits or demands for personal injury, bodily injury, sickness or death, as well as property damage and expenses, and including without limitation, attorneys fees and court costs and any and all other liabilities of any nature whatsoever which may arise from my activities as a volunteer, through my participation in Kingdom Bound related activities, and/or my presence on Six Flags Darien Lake property during the Kingdom Bound festival (including set up and tear down) whether or not related to Kingdom Bound Festival activities. At no time while volunteering, or at any other time, shall I be considered as having purchased admission to Kingdom Bound, Project Lab, or Sheridan Parkside Life Center due to, or as a result of, my activities as a volunteer.
I voluntarily and knowingly fully release and discharge, absolve, indemnify and hold harmless Kingdom Bound Ministries, Inc., SProject Lab, or Sheridan Parkside Life Center your agents, and any former employer, person, firm, corporation, or government agency, its officers, directors, contractors, subcontractors, subsidiaries, employees and agents or representatives from any and all claims, liability, demands, causes of action, damages, or costs, including attorneys fees, present or future, whether known or unknown, anticipated or unanticipated, arising from or incident to, the disclosure or release of any such reference form, information, references and background screening to you, your agents, or employees, or representatives. Kingdom Bound may obtain from the applicant their social security number for the purpose of conducting a background screening if needed.
I further agree that any and all controversies, disputes, claims or liability which may arise out of, or related to this agreement, or any of my activities at the Kingdom Bound Project Lab, or Sheridan Parkside Life Center event, shall be settled by an arbitration panel of (3) three arbitrators administered by the American Arbitration Association. It is agreed that both parties will faithfully observe this agreement and that they will abide by and perform any award rendered by the arbitrators and herewith agree to waive any right of appeal to another body, program or court having possible jurisdiction over this matter.
I further agree to take due care in my position as a volunteer and to conduct myself in a safe and hazard-free manner. I will report unsafe hazards to the officials of Kingdom Bound Ministries, Inc; Project Lab, or Sheridan Parkside Life Center immediately. I understand that as a volunteer I am to present myself with modest dress and conduct myself in a biblical and Christ-like manner. I further understand and agree that in matters of security and/or medical assistance that I may not arrest or detain anyone, nor will I render medical assistance unless I am qualified to do so. I agree not to counsel any person under any circumstances. I will refer all counseling situations to authorized personnel. I certify that I am able to perform the duties of my volunteer position. I also give Kingdom Bound Ministries and Project Lab, or Sheridan Parkside Life Centerpermission to video or photograph me while on park premises, without reward or compensation. No volunteer or ministry representative has the authority to enter into any agreement expressed or implied, or make any representations or agreements on behalf of Kingdom Bound Ministries, Inc. without written consent. I understand that Kingdom Bound Ministries reserves the right to accept or not accept a volunteer application with or without cause at the discretion of Kingdom Bound Ministries, and reserves the right to have any volunteer submit a reference form at anytime at its discretion.
