1. ACKNOWLEDGMENT AND ASSUMPTION OF RISK
I understand that participating in a 5K run/walk and related event activities involves inherent and other risks that may result in serious bodily injury, illness, permanent disability, property damage, or death.
These risks may include, but are not limited to: falls; collisions with other participants, spectators, vehicles, bicycles, animals, or objects; uneven, wet, damaged, or slippery surfaces; curbs, potholes, road conditions, sidewalks, traffic, weather conditions, heat, dehydration, overexertion, exhaustion, muscle or joint injuries, cardiac events, and other medical emergencies.
I understand that these risks may arise from my own actions or inactions, the actions or inactions of others, the condition of the course or premises, or the ordinary negligence of the Released Parties described below.
I knowingly and voluntarily choose to participate in this event and assume all risks associated with my participation, whether known or unknown, foreseeable or unforeseeable, to the fullest extent permitted by California law.
2. RELEASE AND WAIVER OF LIABILITY
In consideration for being permitted to participate in this event, I, for myself and for my heirs, executors, administrators, representatives, successors, and assigns, hereby release, waive, discharge, and covenant not to sue:
CALIFORNIA MUSCLE ONE STOP NUTRITION; RUNNER PARADISE LLC; and each of their respective owners, members, managers, officers, employees, agents, representatives, volunteers, contractors, event staff, sponsors, vendors, affiliates, successors, and assigns, as well as any participating property owners or governmental entities, collectively referred to as the “Released Parties,”
from claims, demands, causes of action, damages, losses, or liabilities arising out of or relating to my participation in the event, including claims arising from the ordinary negligence of any Released Party, to the fullest extent permitted by California law.
This release is intended to be as broad and inclusive as permitted under California law. Nothing in this agreement is intended to release liability that cannot lawfully be released under California law, including liability for gross negligence, reckless or willful misconduct, fraud, or other conduct for which liability cannot legally be waived.
3. PARTICIPANT RESPONSIBILITY
I certify that I am physically capable of participating in this 5K run/walk. I understand that it is my responsibility to determine whether I am medically and physically able to participate.
I agree to follow event rules, course markings, safety instructions, and directions provided by event organizers, volunteers, law enforcement, or event personnel.
I understand that the event organizers may remove me from the event if they reasonably believe that continuing could present a safety risk to me or others.
4. MEDICAL TREATMENT AUTHORIZATION
If I become injured or ill during the event and I am unable to provide consent, I authorize event personnel to obtain or provide reasonable emergency medical assistance on my behalf, including contacting emergency medical services.
I understand that CALIFORNIA MUSCLE ONE STOP NUTRITION; RUNNER PARADISE LLC, do not guarantee that medical personnel will be available at all times.
I understand that I am responsible for my own medical expenses, ambulance charges, hospital expenses, or other costs resulting from illness or injury except to the extent otherwise required by law.
5. PHOTO, VIDEO & MEDIA PERMISSION
I grant CALIFORNIA MUSCLE ONE STOP NUTRITION; RUNNER PARADISE LLC permission to photograph, videotape, record, and otherwise capture my image, likeness, and voice during the event.
I authorize both businesses to use, reproduce, publish, display, distribute, and share such photographs, videos, recordings, and other media for legitimate event and business purposes, including event promotion, websites, social media, advertising, marketing, recap videos, printed materials, and promotion of future events, without compensation to me.
I understand that photographs and videos posted publicly, including on social media, may be viewed or shared by others.
Photo/Video Permission:
YES, I give CALIFORNIA MUSCLE ONE STOP NUTRITION; RUNNER PARADISE LLC permission to use my/my child's image and likeness as described above.
I understand that event organizers cannot guarantee that I will not incidentally appear in crowd photographs or general event footage taken in public areas.
6. PERSONAL PROPERTY
I understand that I am responsible for my personal belongings. CALIFORNIA MUSCLE ONE STOP NUTRITION; RUNNER PARADISE LLC are not responsible for lost, stolen, or damaged personal property except to the extent liability cannot legally be waived.
7. CALIFORNIA LAW & SEVERABILITY
This agreement shall be governed by the laws of the State of California.
If any portion of this agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.
