Your photography experience is designed to feel calm, considered and personal from beginning to end.
This agreement sets out the important things you need to know before your experience begins, so that everything is clear from the very beginning.By signing this agreement, you confirm that you have read and understood these terms and agree to them as part of your booking with MANAWA.
1. Your Booking & Session Fee
Your booking is confirmed once the required session fee or deposit has been paid.The session fee covers the time, preparation, planning and studio resources required to provide your photography experience.Session fees are non-refundable except where a refund is required by New Zealand law or otherwise agreed by MANAWA.
Your booking is personal to you and cannot be transferred to another person without prior agreement from MANAWA.Your booking covers the session and experience selected at the time of booking.
Artwork, digital images and other products are additional unless specifically included in the Collection or package you have purchased.
2. Cancellations & Rescheduling
We understand that circumstances can change. If you need to cancel or reschedule, please contact MANAWA as soon as possible.
Individual Session Bookings
Session fees are non-refundable, subject to your rights under New Zealand consumer law.Where reasonably possible, MANAWA will work with you to find an alternative date if you need to reschedule.Rescheduling is subject to availability and, where appropriate, the nature and timing of the original booking.
All-Inclusive Collections
Where you have purchased an All-Inclusive Collection covering multiple sessions, the following cancellation terms apply, subject always to your rights under New Zealand law:
Cancellation more than one month before the first scheduled session MANAWA may retain a $299 session fee to cover preparation and booking costs, with the remaining balance refunded.
Cancellation less than one month before the first scheduled session50% of the total Collection price may be retained to cover costs and loss associated with the cancellation, with the remaining 50% refunded.
Cancellation less than 14 days before a scheduled session No refund will ordinarily be provided. Where an All-Inclusive Collection contains multiple sessions and some sessions have already taken place, MANAWA may calculate any refund by reference to the sessions and services already provided, costs incurred and the applicable cancellation terms.
Nothing in this agreement limits any rights you may have under the Consumer Guarantees Act 1993 or other applicable New Zealand law.
We will always approach rescheduling requests with care and understanding and will do our best to find a suitable alternative date where possible.
3. Your Photography Experience
MANAWA will make every reasonable effort to provide the experience described at the time of booking. Photography is a creative service and every family, baby and session is different. While we work carefully to create beautiful photographs for you, we cannot guarantee any particular image, pose, expression, photographic outcome or number of photographs.
You are choosing MANAWA based on the style shown in our portfolio and agree that the final photographs will reflect MANAWA's artistic approach.
Newborn Sessions
Newborn sessions are intentionally relaxed and follow your baby's needs.Feeding, settling, cuddling, changing and breaks are all a natural part of the experience. The session may take longer than originally anticipated where this is necessary for your baby's comfort and wellbeing.
4. Illness, Safety & Wellbeing
Please do not attend your session if you or anyone attending is unwell or experiencing symptoms of a contagious illness. Please contact MANAWA as soon as possible so that we can discuss rescheduling.
MANAWA reserves the right to postpone or stop a session where we reasonably believe that continuing would present a risk to the health, safety or wellbeing of the client, their family, MANAWA or others.
Parents and guardians remain responsible for the care and supervision of children attending a session.
Please tell MANAWA before your session about any relevant medical, behavioural, accessibility, developmental or other circumstances that may affect the safety or comfort of anyone attending.
5. Rescheduling by MANAWA
MANAWA will make every reasonable effort to provide your session as booked. In the unlikely event that MANAWA needs to reschedule due to illness, equipment failure, studio circumstances or another unforeseen event, we will offer an alternative date as soon as reasonably possible.
If MANAWA is unable to provide the booked service and no reasonable alternative can be agreed, any refund will be handled in accordance with your rights under New Zealand law.
6. Viewing Experience & Artwork
Your photographs will be presented during your cinematic viewing experience.This is where you will see your completed photographs and discuss the artwork and Collections available for your home.
MANAWA specialises in creating finished artwork rather than simply providing photographs as digital files. Artwork, albums, Collections and other products are purchased separately from the initial session fee unless your booking specifically states that they are included.
7. Products & Custom Orders
Artwork, albums and other products are custom-made to order for you. Once an order has been confirmed and production has commenced, the order cannot ordinarily be cancelled or refunded because the product has been individually commissioned for you.
This does not affect any rights you may have under New Zealand consumer law where a product or service does not meet the guarantees required by law.Where applicable, production timeframes will be discussed or confirmed at the time of ordering.
MANAWA will take reasonable care to ensure that your chosen artwork and products are ordered correctly according to the selections confirmed by you.
8. Payment Plans
MANAWA may offer an interest-free in-house payment plan for eligible clients.Where a payment plan is agreed: The payment schedule, amount and duration will be confirmed in writing before the plan begins. Payments will be processed automatically using the agreed payment method.You are responsible for ensuring that sufficient funds are available on each payment date.
Missed or declined payments may result in a reasonable administration or late fee where this has been agreed with you in advance.MANAWA may pause further services or the release of products where payments are overdue.Images and products will not be released until the applicable balance has been paid in full, unless otherwise agreed in writing.
Payment plans relate to the agreed purchase and do not create ownership of unpaid products or digital files.Any cancellation or refund of a payment plan will be handled in accordance with the terms of the underlying purchase and applicable New Zealand law.
9. Digital Images & Image Storage
Where digital images are included in your chosen Collection or purchase, they will be supplied in accordance with that Collection or purchase.Digital images will normally be made available through your personal online gallery or other agreed delivery method.
MANAWA takes reasonable care with the storage and delivery of client photographs. However, digital files are not guaranteed to remain available indefinitely. Unless otherwise agreed, MANAWA may permanently delete client images from its storage systems after the applicable delivery and storage period has passed.
We strongly recommend downloading and securely backing up all digital files as soon as you receive them.
10. Copyright & Personal Use Licence
Copyright in photographs created by MANAWA remains with MANAWA at all times.Purchasing photographs, digital files, albums or artwork does not transfer copyright ownership to the client.
Where digital photographs are supplied, you receive a personal, non-commercial licence to use those photographs for your own personal purposes, including:Printing and displaying photographs in your homeSharing photographs on your personal social media accounts Sharing photographs with family and friends Creating personal copies for your own use
You may not:
* Sell the photographsUse the photographs for commercial purposes
* Supply the photographs to a business or third party for commercial use
* Claim authorship of the photographs
*Alter or materially edit the photographs in a way that misrepresents MANAWA's work
Commercial use or licensing may be permitted by written agreement with MANAWA.
11. Artistic Style & Image Selection
By booking MANAWA, you confirm that you have viewed and considered our portfolio and are choosing MANAWA based on its photographic style.
MANAWA retains creative discretion over:
* The photographs taken during the session
* The photographs selected for editing
* The final artistic treatment and editing
* The presentation of your photographs
Not every photograph taken during a session will necessarily be delivered.Requests for substantial changes to MANAWA's artistic style or editing may not be possible.
12. Personal Information & Privacy
MANAWA collects personal information necessary to provide your photography services, manage your booking, communicate with you, process orders and payments, and maintain appropriate business records. Information will be collected, stored, used and disclosed in accordance with the New Zealand Privacy Act 2020 and MANAWA's Privacy Policy.
We will take reasonable steps to protect personal information from loss, unauthorised access, use, modification or disclosure. You may have rights to access and request correction of personal information held about you, subject to applicable law.For further information, please refer to MANAWA's Privacy Policy.
13. Image Usage & Model/Media Permission
Your permission for MANAWA to use photographs for portfolio, website, social media, advertising, competition or other promotional purposes is dealt with separately through MANAWA's Model & Media Release.Signing this Client Booking Agreement does not by itself provide marketing or promotional permission.Any separate Model & Media Release will clearly explain what permission you are choosing to provide.
14. Circumstances Beyond Our Control
Sometimes circumstances outside either party's reasonable control may affect a booking. This may include serious illness, natural disasters, significant weather events, government restrictions, loss of access to the studio, major equipment failure or other circumstances that could not reasonably have been prevented.Where this happens, MANAWA will communicate with you as soon as reasonably possible and will make reasonable efforts to reschedule or otherwise resolve the situation.
Nothing in this clause removes or limits any rights or remedies available under applicable New Zealand law.
15. Liability
MANAWA will provide its services with reasonable care and skill and in accordance with applicable New Zealand consumer law. We take reasonable precautions to protect you, your family, your photographs and your belongings.
However, MANAWA cannot accept responsibility for loss or damage caused by circumstances outside our reasonable control or for personal belongings brought to the studio.Nothing in this agreement excludes, restricts or modifies any right, guarantee, remedy or liability that cannot legally be excluded or limited under New Zealand law.
Where MANAWA is legally responsible for a failure of service, any remedy or compensation will be determined in accordance with applicable New Zealand law.
16. Changes to Your Experience
MANAWA may occasionally need to make reasonable changes to a session, product, supplier, location or process where circumstances outside our reasonable control make this necessary. Where a significant change affects your booking, we will communicate this with you as soon as reasonably possible and work with you to find an appropriate solution.
17. Our Commitment to You
We want your experience with MANAWA to feel calm, considered and personal from beginning to end.Luxury, to us, is not simply about the products you purchase. It is about the care given to every part of your experience — how we communicate, prepare, listen, photograph, present your artwork and look after your family.
If anything in this agreement is unclear, please ask before signing. We are always happy to explain anything you would like clarified.

I agree to the terms relating to my booking with MANAWA.
I understand that artwork, Collections and digital images may be purchased separately unless specifically included in my booking.
I understand that MANAWA retains copyright in photographs created during my session.
I understand that any permission for MANAWA to use my photographs for promotional purposes is dealt with separately through the Model & Media Release.
I understand that nothing in this agreement removes my rights under applicable New Zealand consumer or privacy law.
