1. Voluntary Participation and Assumption of Risk — I understand that I am voluntarily participating in a storm-chasing ride-along with 605 Chaser. Severe-weather observation and travel are inherently unpredictable and potentially dangerous, including risks of tornadoes, lightning, hail, damaging winds, flash flooding, extreme heat or cold, flying or falling debris, downed power lines, fire, poor road conditions, reduced visibility, vehicle accidents, mechanical failures, wildlife, remote locations, and delayed access to medical or emergency services. I knowingly and voluntarily assume these ordinary and inherent risks.
2. Safety Instructions and Chase Decisions — I agree to follow reasonable safety instructions given by the 605 Chaser driver, chase lead, or team member. Routes, destinations, stops, and chase plans may change quickly due to weather, traffic, road closures, or safety concerns. I will not interfere with vehicle operation, distract the driver, exit the vehicle when instructed to remain inside, or create an unreasonable safety risk.
3. Personal Property — I am responsible for my own phone, camera, equipment, and other personal property. To the fullest extent permitted by law, 605 Chaser and its owners, members, volunteers, drivers, and affiliates are not responsible for personal property that is lost, stolen, destroyed, or damaged during or in connection with the ride-along.
4. Release of Liability — To the fullest extent permitted by applicable law, I release and hold harmless 605 Chaser and its owners, members, volunteers, drivers, representatives, and affiliates from claims arising from the ordinary and inherent risks of my voluntary participation, including claims for personal injury, death, or property damage. This release does not waive rights or claims that cannot lawfully be waived.
5. Medical Emergencies — If I become injured or ill and unable to make decisions for myself, I authorize 605 Chaser personnel to contact emergency services and provide reasonable assistance. 605 Chaser is not a medical provider and does not guarantee emergency response times. I remain responsible for my own medical expenses to the extent permitted by law.
6. Transportation and Seat Belts — I agree to wear a seat belt whenever the vehicle is moving and to comply with applicable laws.
7. Alcohol, Drugs, Weapons, and Unsafe Conduct — I will not participate while impaired by alcohol or illegal drugs, and will not engage in threatening, reckless, or intentionally unsafe behavior. 605 Chaser may end my participation at any time for safety concerns.
8. Photography, Video, and Livestreaming — I understand storm-chasing activities may be photographed, recorded, or livestreamed. This waiver does not by itself grant unlimited promotional rights to my identity unless separately authorized. I agree not to disclose confidential passwords, private communications, or non-public operational information encountered during the ride-along.
9. No Guarantee of Weather or Experience — 605 Chaser does not guarantee that a tornado, severe storm, or any particular weather event will be observed. A chase may be changed, delayed, shortened, or canceled for safety, weather, vehicle, or operational reasons.
10. Governing Law and Severability — Governed by the laws of the State of South Dakota. If any provision is invalid or unenforceable, the remaining provisions continue in effect.
11. Acknowledgment — I have had the opportunity to read this entire waiver and ask questions before signing. I understand this document affects legal rights, and I am signing voluntarily, understanding electronic signatures may be used to evidence my agreement.
