ADULT PARTICIPANTS ONLY (18+). A parent or guardian must complete a separate minor participant agreement for anyone under 18.
PLEASE READ CAREFULLY. THIS IS A LEGAL AGREEMENT THAT AFFECTS YOUR RIGHTS.
In consideration for being permitted to attend or participate, now or in the future, in any event, activity, program, gathering, training session, clinic, class, excursion, or other experience organized, hosted, promoted, sponsored, facilitated, or conducted by Euzo LLC ("EUZO"), I agree to the following terms.
1. ACTIVITIES COVERED
I understand that EUZO events may include a wide variety of activities and that individual events may differ substantially. For purposes of this Agreement, "Activities" includes all activities associated with any current or future EUZO event, whether athletic, recreational, educational, social, outdoor, indoor, land-based, water-based, recovery-oriented, or otherwise.
Activities may include, without limitation:
- Brazilian jiu-jitsu, grappling, wrestling, martial arts, sparring, drilling, open mats, and other contact or combat-sport activities;
- strength training, conditioning, running, walking, hiking, mobility work, yoga, stretching, and other physical exercise;
- swimming, paddling, boating, beach, water, and other aquatic activities;
- cycling, outdoor recreation, excursions, games, and adventure activities;
- heat, cold, sauna, cold-water immersion, recovery, wellness, breathwork, and similar experiences;
- use of mats, fitness equipment, sporting equipment, vehicles, vessels, facilities, temporary event installations, and other equipment;
- social gatherings, community events, workshops, demonstrations, food or beverage experiences, and other EUZO-sponsored experiences; and
- entering, occupying, moving around, or otherwise using an event venue before, during, or after an Activity.
This Agreement is intentionally broad and is not limited to jiu-jitsu, grappling, martial arts, or athletic events.
2. CONTINUING AGREEMENT; FUTURE EVENTS
I understand and agree that this is a continuing agreement. It applies to every EUZO Activity in which I choose to participate on or after the date I sign it, including future EUZO events, programs, gatherings, and Activities, without requiring me to sign a new waiver for each event.
This Agreement remains in effect unless it is replaced or superseded by a later written or electronic agreement accepted by me. EUZO may require me to complete an updated or event-specific agreement at any time.
3. ACKNOWLEDGMENT OF RISK
I understand that participation in EUZO Activities may involve inherent and other risks, both known and unknown, anticipated and unanticipated. Depending on the Activity, risks may include falls; slips; collisions; physical contact with other participants; joint locks; chokes or strangles; takedowns; impact; strains; sprains; fractures; dislocations; cuts; illness; infection or communicable disease exposure; overexertion; dehydration; heat illness; cold exposure; burns; allergic reactions; equipment malfunction; hazardous surfaces or premises; traffic; transportation; weather; waves; currents; drowning; wildlife; insects; acts or omissions of other participants; and other risks associated with physical, recreational, outdoor, social, recovery, or adventure activities.
These risks may result in property damage, temporary or permanent injury, paralysis, illness, disability, or death. I understand that the nature and extent of these risks cannot always be predicted or eliminated.
4. VOLUNTARY PARTICIPATION AND ASSUMPTION OF RISK
My participation is voluntary. I choose whether to participate in any particular Activity and am responsible for determining whether I am physically, mentally, and otherwise capable of safely participating. I may decline, modify, or stop participating in an Activity at any time.
I knowingly and voluntarily accept and assume all risks associated with my participation, whether known or unknown, inherent or otherwise, except to the extent a risk may not legally be assumed or waived.
5. RELEASE AND WAIVER OF LIABILITY
For purposes of this Agreement, the "Released Parties" means Euzo LLC, together with its members, managers, owners, officers, employees, contractors, instructors, coaches, volunteers, representatives, agents, affiliates, event organizers, event partners, sponsors, vendors, host venues, property owners, property managers, lessors, and other persons or entities involved in organizing, providing, hosting, or facilitating an EUZO Activity.
TO THE FULLEST EXTENT PERMITTED BY LAW, I RELEASE AND WAIVE ALL CLAIMS AGAINST THE RELEASED PARTIES ARISING FROM OR RELATING TO MY PARTICIPATION IN ANY CURRENT OR FUTURE EUZO ACTIVITY, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY. THIS INCLUDES, WITHOUT LIMITATION, CLAIMS RELATING TO NEGLIGENT INSTRUCTION OR SUPERVISION, EVENT ORGANIZATION, PREMISES OR EQUIPMENT, FAILURE TO INSPECT OR MAINTAIN, OR FAILURE TO WARN.
This release includes claims for personal injury, illness, death, property damage, economic loss, or other loss arising out of or related to my participation in an Activity, presence at an event, use of equipment or facilities, transportation provided or arranged as part of an Activity, or the condition of an event location.
I understand that I am giving up legal rights that I might otherwise have, including the right to seek damages from a Released Party for injuries or losses caused by that Released Party's ordinary negligence.
This release is intended to bind me and, to the fullest extent permitted by law, my heirs, estate, personal representatives, successors, and assigns. It is not intended to release liability that cannot legally be waived, including liability for gross negligence, reckless conduct, or intentional misconduct to the extent such liability cannot be released under applicable law.
6. COVENANT NOT TO SUE
To the fullest extent permitted by law, I agree not to bring, maintain, or participate in a lawsuit or other claim against a Released Party for a claim that I have released under this Agreement.
7. HEALTH, FITNESS, AND INSURANCE
I represent that I am capable of participating safely in the Activities I voluntarily choose to undertake. I understand that EUZO is not providing medical diagnosis, treatment, or individualized medical advice, and that information or demonstrations at an event are not a substitute for appropriate professional medical care.
I am responsible for considering my own health, injuries, medical conditions, medications, experience, skill level, and limitations before participating. If I am uncertain whether participation is appropriate for me, I understand that I should obtain appropriate medical guidance before participating.
I understand that EUZO does not provide health, medical, or accident insurance for me, and I am responsible for my own insurance and medical expenses.
8. EMERGENCY MEDICAL CARE
If I become injured or ill and I am unable to make decisions for myself, I authorize EUZO and persons assisting at the event to contact emergency medical services and take reasonable steps to obtain emergency assistance for me. I understand that EUZO does not guarantee that medical personnel will be present at an event. I am responsible for medical, transportation, or other expenses incurred on my behalf.
9. RESPONSIBILITY FOR MY CONDUCT
I agree to comply with The EUZO Standard, event-specific instructions, reasonable safety directions, and rules established by EUZO or the event venue. I understand that EUZO may refuse or terminate my participation at any time if EUZO determines that my conduct is unsafe, disruptive, inappropriate, or inconsistent with its community standards.
I remain responsible for injury, damage, or loss I cause to another person or property through my own acts or omissions, including intentional misconduct, reckless behavior, or negligent conduct.
10. INDEMNIFICATION FOR MY CONDUCT
To the fullest extent permitted by law, I agree to indemnify and hold harmless the Released Parties from third-party claims, damages, losses, liabilities, or reasonable expenses arising from my own acts or omissions, my violation of this Agreement, or my damage to another person or property.
11. THIRD-PARTY PROVIDERS AND VENUES
EUZO Activities may occur at facilities or locations owned or controlled by third parties and may involve services, equipment, instruction, transportation, food, beverages, or other products provided by third parties. I understand that participation may also be subject to additional waivers, rules, or agreements required by those third parties.
12. PERSONAL PROPERTY
I am responsible for my own personal property. To the fullest extent permitted by law, I release the Released Parties from claims for loss, theft, or damage to my personal property in connection with an EUZO Activity, including claims arising from ordinary negligence.
13. PHOTOGRAPHY, VIDEO, AND MEDIA
I understand that EUZO events are community experiences that may be photographed, filmed, livestreamed, recorded, or otherwise documented, and that I should not expect privacy from event photography or recording while participating in or attending an EUZO event.
As a condition of participation, I expressly authorize and consent to Euzo LLC photographing, filming, recording, and otherwise capturing my name, image, likeness, voice, appearance, and participation during current and future EUZO events.
I grant Euzo LLC a worldwide, royalty-free, perpetual right and permission to use, reproduce, edit, publish, distribute, display, transmit, and otherwise use such photographs, video, audio, or other recordings in connection with EUZO, including on websites, social media, digital content, event recaps, advertisements, promotional materials, publications, and other commercial or non-commercial media, without further approval from or compensation to me.
I understand that such content may be published publicly, shared or reposted by third parties, and remain publicly available after the event. I waive any right to inspect or approve the finished content or the manner in which it is used, provided the use is not unlawful.
If I do not agree to these media terms, I should not participate in EUZO events.
14. ELECTRONIC AGREEMENT AND SIGNATURE
I agree that this transaction may be conducted electronically. I understand that checking an acknowledgment box, entering my name, applying an electronic signature, or otherwise electronically indicating my agreement is intended to constitute my signature and agreement to these terms. I intend my electronic signature to have the same effect as my handwritten signature.
15. FLORIDA LAW; VENUE
This Agreement is governed by the laws of the State of Florida, without regard to conflict-of-law principles. To the extent permitted by law, any legal proceeding arising from this Agreement or my participation in an EUZO Activity must be brought in a court of competent jurisdiction located in Pinellas County, Florida.
16. SEVERABILITY; ENTIRE AGREEMENT
If any provision of this Agreement is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect. This Agreement, together with The EUZO Standard and any event-specific terms incorporated into it, constitutes the agreement between me and EUZO concerning the matters addressed here and may be modified only in a written or electronic agreement accepted by the parties.
17. ACKNOWLEDGMENT
I certify that I am at least 18 years old. I have had the opportunity to read this entire Agreement, including The EUZO Standard. I understand its terms, including that it applies to current and future EUZO Activities, the risks I am assuming, the legal claims I am releasing, and the media rights I am granting. I have had the opportunity to ask questions before signing. I am signing voluntarily and intend to be legally bound.
