Player Development Training
Terms of Service and Participation Agreement
This Agreement is between Nexus Futbol Academy, LLC (“Nexus,” “we,” “us”) and the parent or legal guardian (“you”) enrolling a player (“the Player”) in the Player Development Training program (“the Program”). By enrolling, you agree to the terms below on behalf of yourself and the Player.
Please read all of it. Sections 11 and 12 affect your legal rights.
1. The Program
The Program provides individual and small-group football training in three formats: private (one player), semi-private (two players), and small group (up to six players per coach). Six players per coach is a maximum, not a target.
Sessions are 60 minutes and run on the Nexus fields at 2045 Reflection Bay Dr., Pearland, Texas 77584, after school and on weekends. The season runs September through June.
The Program is supplemental training. It is not a club, a team, or a substitute for the Player’s club or school football, and Nexus makes no representation about selection, placement, scholarship, or recruitment outcomes.
2. Enrollment and your session slot
Enrollment is monthly and continues until you end it under Section 6. On enrolling, the Player is assigned a recurring weekly day and time. That slot is reserved and staffed for the Player each week, whether or not the Player attends.
Players who are not enrolled at Nexus begin with a private session before joining a semi-private or small-group format, so the coach can assess level and needs. Nexus students may join a group format directly.
Nexus assigns players to groups by age, level and training need, and may move a player between groups where doing so serves the training. Group composition is at our discretion.
3. Fees and billing
Monthly fees are per player, for one session per week:
Private (individual): $340
1 player · 1 coach
Semi-private (pairs): $220 per player
2 players · 1 coach
Small group: $140 per player
Up to 6 players · 1 coach
Fees are billed on the 1st of each month by automatic charge to the payment method you keep on file. By enrolling you authorize us to charge that method on a recurring basis until enrollment ends.
If a Player starts mid-month, the first month is prorated to the number of scheduled sessions remaining.
Failed payments. If a charge is declined we will attempt it again. If payment has not been received within seven days of the billing date, the Player’s sessions are suspended until the balance is paid. The reserved slot is held during suspension but is not guaranteed beyond it, and suspended sessions are not made up.
Changes to fees. We may change fees with at least 30 days’ written notice. If you do not wish to continue at the new rate, you may end enrollment under Section 6 before the change takes effect.
Fees do not include camps, clinics or tournaments, which are priced and paid separately.
4. Missed sessions and make-ups
If you cancel a session with at least 24 hours’ notice, the Player may make it up in another session for which space is available and which is appropriate to the Player’s level and format. Make-ups must be used within 30 days of the missed session and expire after that.
Sessions cancelled with less than 24 hours’ notice, and sessions the Player simply does not attend, are not made up and are not refunded or credited. The slot was reserved and the coach was scheduled.
Make-ups depend on space existing. We will offer what is available; we cannot create a session or add a seventh player to a group in order to accommodate one.
5. Sessions cancelled by Nexus
We may cancel a session for weather, unsafe field conditions, facility closure, coach illness or other circumstances outside our control. Where we can, we will notify you by early afternoon on the day of the session using the contact details you provide.
Sessions we cancel are rescheduled at no charge, or credited to your next invoice if no reschedule is possible within 30 days.
6. Ending enrollment
You may end enrollment at any time by giving written notice before the next billing date. Notice given on or after the 1st takes effect at the end of that month, and that month’s fee is not refunded or prorated.
There is no season-long commitment. Written notice by email to josephine@nexusfutbol.com is sufficient.
We may end enrollment at any time, with or without cause, on written notice. If we end enrollment for reasons other than the Player’s conduct, we will refund the unused portion of the current month.
7. Camps, clinics and tournaments
Camps, clinics and tournaments are separate from monthly training and are booked and paid for separately. Deposits are non-refundable. Fees for camps, clinics and tournaments are non-refundable once paid, including where a player does not attend, and are not transferable to monthly training fees.
8. Drop-off, pick-up and field access
Drop-off and pick-up take place at the rear of the Nexus facility. Please arrive no earlier than ten minutes before the session and collect the Player promptly at the end.
Parents, family members and spectators are not permitted on the training field during sessions. This is a training environment and the coaching depends on the Player’s full attention. You are welcome to wait in the designated area.
Nexus does not supervise players before or after their scheduled session. Responsibility for the Player begins when the coach takes the field with them and ends when the session ends.
9. Player conduct
Players are expected to arrive on time and ready to train, to follow coaching instructions, and to treat coaches, other players and the facility with respect.
We may remove a Player from a session, or end enrollment, for conduct that is unsafe, disruptive or disrespectful, or for repeated failure to meet these expectations. No refund or credit is given for sessions lost as a result.
Players train in appropriate footwear and shin guards. Jewellery is not permitted on the field.
10. Health, injury and fitness to participate
By enrolling you confirm that the Player is in good health and physically fit to take part in football training, and that you have disclosed to us in writing any medical condition, injury, allergy or medication that a coach should know about. You agree to tell us promptly if that changes.
If the Player is injured or unwell, they should not train until they are ready to do so. Where a Player has been injured during a session, we will contact you using the details you have provided.
Football training carries an inherent risk of injury. Coaches are not medical professionals and do not diagnose, treat or clear injuries.
11. Assumption of risk, release and indemnity
You understand and accept that football training involves inherent risks that cannot be eliminated, including collisions, falls, contact with the ball or other players, uneven or wet ground, heat, weather, and the risk of injury ranging from minor to serious, including permanent injury or death.
Knowing those risks, you voluntarily enroll the Player and assume them on the Player’s behalf and your own.
To the fullest extent permitted by Texas law, you release and discharge Nexus Futbol Academy, LLC, its owners, officers, employees, coaches, contractors and the owners of the facility from any claim, demand or cause of action arising out of the Player’s participation in the Program, other than a claim arising from gross negligence or wilful misconduct.
You agree to indemnify and hold them harmless against any claim brought by or on behalf of the Player, or by a third party, arising out of the Player’s participation, to the same extent.
You are signing this on your own behalf and, to the extent Texas law permits a parent or guardian to do so, on behalf of the Player as a minor.
12. Limitation of liability
To the fullest extent permitted by law, Nexus’s total liability arising out of or relating to this Agreement or the Program is limited to the fees you have paid in the three months preceding the event giving rise to the claim. Nexus is not liable for indirect, incidental or consequential loss.
Nexus is not responsible for personal property brought to the facility or left in the parking area.
13. Photographs and video
We sometimes photograph or film sessions for coaching review and for promoting the Program.
We will not use images or footage of your Player in marketing unless you opt in below. If you opt in, you grant Nexus a non-exclusive, royalty-free right to use photographs and video of the Player in its own promotional materials, website and social media, without further approval or payment. You may withdraw consent at any time by writing to us; we will stop future use, though we cannot always recall material already published.
Coaching-review footage used internally, and not published, does not require opt-in.
Parents and spectators may not film or photograph other people’s children.
14. Information you give us
We collect the contact, health and payment information needed to run the Program safely and to bill you. We do not sell it. We share it only with the people who need it to deliver the Program — coaches, our payment processor, and emergency services if required.
Payment card details are held by our payment processor, not by Nexus.
15. Notices
Written notice to Nexus should be sent to Nexus Futbol Academy, LLC, 2045 Reflection Bay Dr., Pearland, Texas 77584, or by email to the program address given to you at enrollment. Notice to you will be sent to the email address on your enrollment form, and is effective when sent.
16. Assignment
Nexus may assign this Agreement, in whole or in part, to an affiliated or successor training provider. We will give you at least ten days’ written notice before any such assignment takes effect. Your schedule, coach and rate will not change as a result. Because the assignee is a separate company, you will be asked to sign a new agreement and authorize payment again; if you choose not to, your enrollment ends on the transfer date and you will not be charged beyond it.
You may not assign or transfer your enrollment to another family or player.
17. Changes to these terms
We may update these terms with at least 30 days’ written notice. Continued enrollment after the notice period means you accept the updated terms. If you do not, you may end enrollment under Section 6.
18. Governing law and venue
This Agreement is governed by the laws of the State of Texas. Any dispute arising out of it will be brought exclusively in the state or federal courts located in Brazoria County, Texas, and you consent to that venue.
19. General
This Agreement is the entire agreement between us regarding the Program and replaces any prior discussion or representation. If any provision is found unenforceable, the rest remains in force and the unenforceable provision is limited to the minimum extent necessary. Our failure to enforce a provision is not a waiver of it.
