FURYOFTHEWIND EARLY BOOKING ICSI CONTRACT
This certifies that _________________________, mare owner or recorded lessee (herein referred to as "Mare Owner" has engaged in service to FURYOFTHEWIND (AQHA #4415184)

The mare owner will pay a stud fee of $2,500 payable as follows:

a: A Booking fee of $500 payable with this contract. The Booking Fee is non-refundable.

b: The balance of the breeding fee ($2,000) when the recipient mare has a heartbeat at 45 days.

Breeding and Booking Fee:
The breeding fee shall be $2,500, which includes a non-refundable Booking fee of $500, payable with this agreement. After payment of the Booking Fee and upon the successful obtaining of an embryo that is transferred in a recipient mare with a 45-day heartbeat, the balance of the breeding fee ($2,000) shall be paid together with any other fees due. Frozen embryos being stored do not need to be paid for until they are transferred into a mare and have a 45-day heartbeat.

The Mare Owner shall be responsible for obtaining and furnishing the oocyte(s) to the facility of their choice and for all expenses off oocyte retrieval ICSI procedure including, but not limited to shipping, embryo transfer, recipient mares and embryo storage.

Live Foal Guarantee:
The Mare Owner will be entitled to a return ICSI breeding for the following year only in the absence of a live foal, meaning a foal which stands, nurses and lives for 24 hours. Upon proper notification and the payment of a rebreed fee of $250, the Mare Owner will receive the right to a rebreed. Proper notification shall be a written certification by a licensed veterinarian within seven days that the mare didn't carry to term or produced a nonviable foal. After one rebreed is used the following year, no more rebreeds will be given from that contract.

Only Frozen Semen is provided for ICSI procedure.
Shipping Containers:
All shipping containers must be returned to Copper Spring Ranch within 72 hours of receipt. Failure to do so will result in penalties. Tanks not received back in 10 business days will be replaced at Mare Owner's expense.
Breeders Certificate:
Upon notification of birth of a live foal, if all fees and expenses are paid, a signed Registration Application for said foal will be released. The Mare owner is responsible to notify the Stallion owner of any confirmed pregnancies no later than August 30 to be guaranteed on the Stallion Breeding Report without a late fee.
Multiple Embryos:
The payments provided above are for one foal from the mare listed on this contract. Should more than one embryo or foal result from an ICSI procedure, the Mare Owner shall pay an additional Breeding Fee of $2,500 for each additional embryo that is transferred into a recipient mare upon positive 45 day pregnancy check. No breeding certificate for any foal shall be issued without payment in full.
Agreement:
This agreement a) may neither be assigned nor transferred in any manner, absent the express written permission of the Stallion owner; b) constitutes the entire agreement between the parties; c) supersedes all other agreements or understandings between parties; d) may not be amended in any manner other than in writing executed by both parties; and e) shall be binding upon the heirs, personal representatives, successors , and permitted assigns of the parties. The failure of Stallion owner to require performance of any provision of this Agreement shall not affect Stallion Owner's right to later require performance nor shall a waiver of any breach or default of this Agreement constitute a waiver of any subsequent breach or default or a waiver of the provision itself.
Acknowledgement:
All parties acknowledge that this Agreement is made and performed within the County of Gallatin, State of Montana. Both parties should any dispute or claims arise regarding this contract, the venue will be in the State Court located in Gallatin County, Montana and shall be construed and enforced under the laws of the State of Montana. Both parties agree that at no time will any damages ever be awarded in any amount greater than the actual stud fee that was paid.

Every attempt will be taken to deliver cooled semen to mare owner in good condition, however once the shipment leaves Copper Spring Ranch, Stallion Owner and/or CSR cannot be held responsible for delayed arrival or condition of semen upon arrival.
