  • Deposit and payment terms: For domestic building work in Victoria, the deposit will not exceed 10% of the total contract price where the price is less than $20,000, or 5% where the total contract price is $20,000 or more. Progress payments will be listed in the quotation and correspond with completed stages of work. The final balance is payable upon completion of the agreed work and issue of the final invoice. These terms are subject to applicable Victorian building and consumer laws. Power and water: The client must provide reasonable access to electricity and water at the worksite for the duration of the project at no additional cost to Evergreen Exteriors Care. Permits and approvals: Unless expressly included in the written quotation, the client is responsible for obtaining all required council permits, building permits, owners-corporation approvals and other necessary permissions before work begins. Evergreen Exteriors Care will advise the client if it becomes aware that a permit or approval may be required. Work may be delayed until required approvals are obtained. Underground services: Before work begins, the client must disclose all known underground services and provide available plans or service-location information, including electricity, gas, water, drainage, sewerage, irrigation and communications. Evergreen Exteriors Care will take reasonable care and comply with applicable legal obligations. To the extent permitted by law, Evergreen Exteriors Care is not responsible for damage to services that were not disclosed, were incorrectly marked or were not accurately shown in information supplied, except where damage results from Evergreen Exteriors Care's negligence, breach of contract or breach of applicable law. If an unidentified service is found, work may be suspended until safely located or inspected. Necessary locating services, licensed trade work, repairs, delays or scope changes must be explained and handled as a written variation before additional work proceeds. Written variations: Any change to the agreed scope, materials, specifications, price or completion requirements must be recorded in writing and accepted by both parties before changed work begins, except urgent work reasonably necessary for safety or preventing property damage. Consumer rights: Nothing in these terms excludes, restricts or modifies any right, consumer guarantee or remedy that cannot lawfully be excluded under Australian Consumer Law or applicable Victorian legislation.
