ACKNOWLEDGEMENT OF RISK, WAIVER, RELEASE & INDEMNITY
1. RISK ACKNOWLEDGEMENT: I, the undersigned, hereby acknowledge that participation in horse riding safaris and related activities conducted by Tanzania Horse Safari involves inherent and significant risks, including but not limited to: falls from horses, being kicked, bitten or trampled, unpredictable behavior of horses, uneven or hazardous terrain, weather conditions, remote locations, interaction with wild animals, limited access to medical facilities, illness, disease, accidents, injury, or death.
2. PHYSICAL FITNESS: I confirm that I am physically and medically fit to participate in horse riding activities and that I have fully disclosed to Tanzania Horse Safari any medical conditions, injuries, allergies, disabilities, or limitations that may affect my ability to ride safely.
3. WAIVER & RELEASE: I voluntarily elect to participate entirely at my own risk and hereby waive, release, and discharge Tanzania Horse Safari, its owners, directors, officers, employees, guides, agents, contractors, and representatives from any and all claims, demands, actions, losses, damages, costs, or expenses arising out of or in connection with my participation in the safari activities, to the fullest extent permitted by law, whether arising from negligence or otherwise.
4. ANIMAL BEHAVIOR: I acknowledge that horses are animals that may behave unpredictably and that accidents and injuries may occur even where reasonable care, skill, and supervision have been exercised.
5. COMPLIANCE: I agree to comply fully with all safety instructions, briefings, rules, and directions given by guides or staff at all times. I understand that failure to do so may increase the risk of injury and may result in my removal from the activity without refund.
6. INDEMNITY: I hereby agree to indemnify and hold harmless Tanzania Horse Safari against any and all claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising directly or indirectly from my actions, omissions, breach of instructions, or misconduct during the safari.
7. MEDICAL CONSENT: I consent to the provision of emergency medical treatment in the event of injury or illness and accept full responsibility for any medical, evacuation, or related costs incurred.
8. JURISDICTION: This agreement shall be governed by and construed in accordance with the laws of the United Republic of Tanzania, and the courts of Tanzania shall have exclusive jurisdiction.
