RELEASE, WAIVER, DISCHARGE, PHOTO RELEASE AND COVENANT NOT TO SUE (THIS “RELEASE”) 

In consideration of my participation and/or my child’s participation in High School Mentor Training - Tuesday, October 20, 2026, Sussex County Technical School, McNeice Auditorium, 105 N Church Rd, Sparta, NJ 07871, 6:00-8:00 pm.

The Rise Youth Empowerment Summit on Wednesday, October 21, 2026, Sussex County Technical School, McNeice Auditorium, 105 N Church Rd, Sparta, NJ 07871, 8:45 am-1:30 pm.

 

(collectively, the “Event”), on behalf of myself and the minor child /ward/ (if any) identified more specifically hereinbelow (the “Minor”) for whom I represent and warrant that I have the capacity to contract, I hereby acknowledge and agree to the following: 

Release and Indemnity.  To the fullest extent permitted by law, I hereby voluntarily RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE (on behalf of myself and my Minor) The Center for Prevention & Counseling, Inc.(“CFPC”), its officers, directors, agents, employees, insurers, staff, volunteers, and all of their respective employees, agents, representatives, and volunteers (the “RELEASEES”) arising from or relating in any way to my (and/or my Minor’s) involvement and participation in the Event, including without limitation any claim of breach of statutory duty or other duty of care, warranty, or strict liability.  I shall indemnify, defend, and hold harmless the RELEASEES from and against any and all claims, demands, suits, actions, judgments, losses, liabilities or expenses of any nature whatsoever (including, without limitation, reasonable attorneys’ fees, costs and disbursements, and irrespective of whether an action is brought, on appeal or otherwise), arising from or out of, or relating to, directly or indirectly, my (or my Minor’s) involvement and participation in the Event.    
 
Assumption of Risk.  I understand and acknowledge that participation in the Event, including, without limitation, any and all activities part of or associated with the Event, involves inherent risks, including but not limited to accidents, illness, personal injury, death, or property damage. I knowingly and voluntarily assume all such risks, whether known or unknown, foreseeable, or unforeseeable, on behalf of myself (and/or my Minor). I understand that these risks may arise from my (or my Minor’s) actions, the actions of others, transportation-related incidents, or conditions at the Event or venue. 
 
Medical Consent and Authorization.  I acknowledge that a medical professional may not be on staff at the Event. In the event of an accident, injury, or medical emergency involving me (and/or my Minor), I authorize and consent to CFPC and its representatives obtaining or providing emergency medical care (e.g., CPR), including transportation to a medical facility, as deemed necessary or advisable. I, on behalf of myself (and/or my Minor) consent to medical treatment administered by licensed medical professionals and authorize CFPC and its representatives to exercise their best judgment upon the advice of medical or emergency personnel.  I agree to be financially responsible for all medical expenses incurred. I understand that reasonable efforts will be made to contact me in the event of a medical emergency involving my Minor.   
 
Voluntary Participation.  I am fully aware of the risks associated with participating in the Event, irrespective of whether specifically described in this Release, and I voluntarily choose to (and/or allow my Minor to) participate with full knowledge and acceptance of those risks. 
 
Acknowledgement and Compliance with Rules.  I agree to observe and obey all rules, instructions, and safety procedures related to the Event. I understand that CFPC and Event officials reserve the right to dismiss me (and/or my Minor), without refund, if my (or and/or my Minor’s) behavior is deemed unsafe, disruptive, or otherwise negatively impacts any person, facility, or property. 

Media Release. I (on behalf of myself and my Minor) hereby voluntarily grant to CFPC (and its affiliated entities, partners, successors and assigns) permission (without compensation) to take and to use, reproduce, publish, transmit, distribute and display photographs or video, in whole or in part, including without limitation voice and likeness of  me (and/or my Minor), including without limitation all printed matter associated therewith, related to the Event (collectively, the “MEDIA”), for use in CFPC’s internal records, and for promotional, training or educational materials, which records and materials include, without limitation, annual reports, catalogs, brochures, posters, magazines, media articles, electronic and paper newsletters, and all electronic media, including CFPC’s Internet web sites, blogs, Social Media pages, and other similar web-based media. I agree that CFPC will own all MEDIA taken by it or its employees or agents.  Notwithstanding the foregoing, CFPC will not include my (and/or my Minor’s) address or other identifying information in connection with the use of any of the MEDIA; provided, however, my (and/or my Minor’s) name may be used in the MEDIA.  I further understand that the Internet is not a secure medium, that any material posted on the Internet is accessible to anyone with Internet access, that while CFPC has made efforts to secure its web site, it cannot guarantee privacy or control access to its web site, and that any MEDIA of me (and/or my Minor) that are posted on the Internet may be viewed or downloaded by any computer. 

Counterparts and Electronic Signatures.  This RELEASE may be executed in one or more counterparts, and all executed counterparts shall form the same agreement. I (i) agree that an electronic copy (including pdf or any electronic signature process complying with the U.S. federal ESIGN Act of 2000) of the signature of the persons executing this RELEASE on behalf of such party may be used for any and all purposes, with the same force and effect as an original of such signature, (ii) intend to be bound by the electronic copy of such signature, (iii) am aware that CFPC will rely on the electronic copy of such signature, and (iv) acknowledge such reliance and waive any defenses (other than fraud) to the enforcement of this RELEASE based on an electronic copy of such signature. 
 
Miscellaneous.  I understand and acknowledge that I may not assign any of my rights or obligations under this Release without the prior written consent of CFPC, which may be withheld in its sole discretion.  It is my express intent that this Release shall bind any permitted assigns and representatives, and shall be deemed as a RELEASE, WAIVER, DISCHARGE, MEDIA RELEASE AND COVENANT NOT TO SUE the above-named RELEASEES. This Release and the provisions contained herein shall be construed, interpreted, and controlled according to the laws of the State of New Jersey. I HEREBY KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A JURY TRIAL OF ANY DISPUTE ARISING IN CONNECTION WITH THIS AGREEMENT.  I ACKNOWLEDGE THAT THIS WAIVER WAS EXPRESSLY NEGOTIATED AND IS A MATERIAL INDUCEMENT FOR THE PERMISSION GRANTED BY RELEASEES TO PARTICIPATE IN AND BE INVOLVED IN THE PROGRAM.  For avoidance of doubt, if no minor is identified hereinbelow, references to “Minor” herein shall not be applicable. 
 
Severability.  I agree that if any portion of this RELEASE is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
