The South Brooklyn Art Camp Liability Waiver & Participation Agreement

Hello parents! We are so excited to welcome your young artists for a school year filled with creativity, imagination, and plenty of color! We love fostering a vibrant, hands-on environment. Because our students will use real art tools, navigate playground structures, and enjoy water play, safety remains our top priority. Thank you for partnering with us to keep our program community respectful and safe!

    1. Scope of Activities & Assumption of Risk
I understand that my child will participate in standard indoor art program activities and supervised outdoor recreational play. I acknowledge that these activities carry inherent, minor risks of injury. By signing below, I express understanding of and consent to these specific conditions:
Art Tools Safety: Students will safely use age-appropriate tools, including metal scissors, palette knives, brushes and pencils. All other indoor media consist of paper, plastic, aluminium foil and trays, paint, and drawing materials.
Outdoor Play & Water Risks: Students will play outdoors during designated breaks. This includes using playground structures (such as monkey bars and swings), participating in group ball and bat games, and spending time in the water park area. I recognize that normal physical play, concrete surfaces, and wet surfaces carry risks of accidental slips, trips, falls, or impact bumps.
    2. Release of Liability
To the fullest extent permitted by law, I release The South Brooklyn Art Camp and its staff from any financial liability, claims, or demands for personal injuries that occur during standard program operations, except in cases of gross negligence or willful misconduct.
    3. Emergency Medical Authorization
In the event of an illness or injury, I grant program staff full permission to administer basic first aid. If a serious medical emergency occurs and I cannot be reached immediately, I authorize program staff to secure professional medical treatment or transport for my child. I accept financial responsibility for any medical expenses incurred.
    4. Peer-to-Peer Injury & Third-Party Liability
I acknowledge that the program cannot perfectly predict or prevent the sudden, willful, or careless actions of individual children. If one student violates program rules and injures another student, The South Brooklyn Art Camp and its staff are not legally or financially liable for that injury.
    5. Parent Obligation & Dispute Resolution
In the event of a behavioral issue or an injury caused by another student, parents are obligated to handle the matter directly:
Parent-Child Discussion: Parents must speak directly with their own child regarding the incident and behavioral expectations.
Parent-to-Parent Communication: If further resolution or financial discussion is required regarding an incident between children, the involved parents agree to communicate directly with each other to resolve the matter.
    6. Exclusion from Third-Party Disputes & Financial Issues
If any legal issues, claims, or disputes arise within or between individual families regarding a student incident, The South Brooklyn Art Camp will not act as a go-between, intermediary, or legal mediator. Furthermore, the program is not responsible for, nor will it participate in, any finance-related issues, reimbursement demands, or monetary disputes within or between individual families. The program's involvement is strictly limited to facilitating the exchange of basic contact information between the involved parties.
    7. Behavioral Expectations
I agree that my child must follow basic safety rules, share tools responsibly, and respect others. The program reserves the right to send a child home without a refund if their behavior creates a safety hazard for themselves or other students.
