THIS RELEASE IS A BINDING LEGAL CONTRACT.
PLEASE READ IT CAREFULLY BEFORE SIGNING.
I, the undersigned individual, desire to engage in a Community Wellness program (“Program”) organized by the Milwaukee Turners. In consideration for Milwaukee Turners permitting me to participate in the Program, I have agreed to execute this Release of Liability and Assumption of Risks (this “Agreement”).
ACKNOWLEDGEMENT OF RISKS
I understand that yoga and fitness activities including weightlifting and use of equipment involve risk and possible injury including but not limited to serious injury, illness, or death, including losses which may result not only from my own actions, inactions or possible negligence, but also from the actions, inactions, or negligence of others, the condition of the facilities, equipment, or areas where the activity is being conducted, and/or the rules of play of this type of activity. I understand that injuries can and do happen.
I further acknowledge that the above list is not inclusive of all possible risks associated with participation in the Program. I agree that such list in no way limits the extent or reach of this Release. If I see or hear anything that I feel is questionable or dangerous, it is my responsibility to inform the instructor or a representative of the Milwaukee Turners.
I understand that if I have any risk concerns, I shall discuss them completely with the staff before I sign this agreement and before my participation in the activity begins.
RELEASE
I release Milwaukee Turners, Inc, the Turner Ballroom Preservation Trust, and employees, volunteers, the Board, the Program, the Milwaukee Turners gym facility and its owners, the equipment owners, and other related parties from the responsibility or liability for insurance deductible, medical expenses, damages, actions, claims and liabilities, whether known or unknown, anticipated or unanticipated, suspected or unsuspected, relating to or arising from any activity, occurrence, or event involving the Program or Milwaukee Turners incurred by my child, myself, or other family members while participating, visiting the facilities, parking area, or traveling to a related event. This Release is intended to release and discharge the Released Parties from all damages, actions, claims and liabilities of any nature, specifically including, but not limited to, damages, actions, claims and liabilities arising from or related to the negligence of the Released Parties. I further agree to indemnify, hold harmless, and defend the Released Parties from and against any loss, damage, liability and expense, including costs and attorneys’ fees, incurred by any of the Released Parties as a result of using the Program or participating in any activity sponsored by or involving Milwaukee Turners.
The laws of the State of Wisconsin shall govern the rights and obligations of the parties to this Release and the interpretation, construction, and enforceability thereof. I agree that any lawsuit brought against any of the Released Parties or otherwise in connection with my use of the Program shall be brought solely in the federal or state courts located in Milwaukee County, Wisconsin.
CODE OF CONDUCT
I certify that I have no medical, physical or other condition that could interfere with my use of the Program, including, but not limited to, any interference with my ability to follow or give directions while climbing, belaying, using gymnastics equipment, or any other activity where the Program is facilitated.
All participants will refrain from engaging in any behavior considered physical aggression, social aggression, verbal aggression, written aggression, intimidation, sexual harassment, religious harassment, racial/ethnic harassment, or other forms of bullying.
Milwaukee Turners reserves the right to discontinue membership, enrollment, or use of gym facilities of any participant, based on their behavior, without a refund, as well as to remove any participant from class and ask them not to return.
By providing Milwaukee Turners with my email address I agree to receive newsletters, information and other promotions. Email addresses and other personal information will never be sold and will be kept confidential. Milwaukee Turners reserve the right to use any photograph or video taken at the Program, whether during the course of a birthday party or private group or during any other activity at the Program, involving Milwaukee Turners or otherwise, in Milwaukee Turners promotional materials, brochures, and website.
By signing this waiver I attest that the above information is true and correct.
