Peachy Day Farms Rescue Foster Agreement
This Dog Foster Agreement (“Agreement”) is entered into between Peachy Day Farms Rescue (“Rescue”) and the undersigned volunteer foster (“Foster”). The purpose of this Agreement is to establish the responsibilities, obligations, and risks associated with Foster caring for a dog placed in Foster’s home or custody by the Rescue.

2. FOSTER RESPONSIBILITY - Foster acknowledges and agrees that, upon accepting the foster dog into their care, custody, or control, Foster assumes full responsibility for the dog for the entire period the dog is in Foster’s possession. This responsibility includes, but is not limited to: Providing adequate food, fresh water, shelter, exercise, supervision, and appropriate care; Providing a safe and secure environment for the dog; Preventing the dog from escaping, running loose, or causing injury or property damage; Maintaining appropriate control of the dog at all times; Following all instructions provided by the Rescue regarding the dog’s care, feeding, medication, behavior, and restrictions; Immediately notifying the Rescue of any illness, injury, behavioral issue, escape, bite, incident, or other significant event involving the dog; Returning the dog to the Rescue upon request or termination of the foster placement; Not transferring, selling, giving away, surrendering, boarding, breeding, or otherwise placing the dog with another person or organization without prior approval from the Rescue.

3. ASSUMPTION OF RISK - Foster understands that dogs are animals and that even dogs that appear friendly, healthy, well-behaved, or non-aggressive may behave unpredictably. Foster acknowledges that caring for a rescue dog may involve inherent risks, including, but not limited to: Dog bites, scratches, jumps, knocks, falls, or other physical injuries; Aggressive or fearful behavior; Resource guarding; Destructive behavior; Escape or running away; Injury to or death of the foster dog; Injury to other animals; Transmission of illness, disease, parasites, or other conditions; Damage to personal or real property; Injuries or damages caused by the foster dog to household members, visitors, neighbors, other animals, or third parties; Veterinary emergencies and associated expenses. Foster voluntarily accepts and assumes all such risks associated with the care, custody, and control of the foster dog while in Foster’s care.

4. RELEASE OF PEACHY DAY FARMS RESCUE - To the fullest extent permitted by applicable law, Foster, on behalf of Foster and Foster’s heirs, representatives, successors, and assigns, releases and holds harmless Peachy Day Farms Rescue, including its owners, directors, officers, employees, volunteers, agents, representatives, foster coordinators, and affiliated individuals, from claims, demands, actions, damages, losses, liabilities, costs, and expenses arising out of or relating to Foster’s care, custody, possession, transportation, handling, or control of the foster dog. This release includes, to the fullest extent permitted by law, claims relating to personal injury, property damage, veterinary expenses, illness, disease, injury to another animal, or other loss associated with the foster dog.

5. FOSTER’S ASSUMPTION OF LIABILITY - While the foster dog is in Foster’s care, custody, possession, or control, Foster assumes responsibility for the dog and for any liability arising from the dog’s actions or from Foster’s handling, supervision, transportation, or care of the dog, to the fullest extent permitted by law. Foster agrees to take reasonable precautions to prevent the dog from causing injury, escaping, or damaging property. Foster further agrees that any household member, guest, visitor, pet sitter, dog walker, or other person to whom Foster provides access to or control of the foster dog is Foster’s responsibility.

6. INDEMNIFICATION - To the fullest extent permitted by applicable law, Foster agrees to indemnify, defend, and hold harmless Peachy Day Farms Rescue and its owners, directors, officers, employees, volunteers, agents, representatives, and affiliates from and against claims, demands, lawsuits, damages, judgments, losses, liabilities, expenses, attorney fees, veterinary expenses, medical expenses, and other costs arising from or related to: (1) Foster’s possession, care, custody, handling, transportation, or supervision of the dog; (2) Any injury or property damage caused by the foster dog; (3) Any injury, illness, or death suffered by the foster dog while in Foster’s care, except to the extent caused by conduct for which liability cannot legally be waived; (4) Foster’s failure to follow the terms of this Agreement or instructions provided by the Rescue; (4) Any act or omission by Foster or anyone acting with Foster’s permission concerning the foster dog.

7. VETERINARY CARE - Foster agrees to promptly notify Peachy Day Farms Rescue of any illness, injury, medical concern, or change in the dog’s condition. Foster shall not authorize elective, non-emergency veterinary procedures without prior approval from the Rescue. In an emergency where the Rescue cannot reasonably be reached, Foster may seek necessary emergency veterinary care to protect the health or life of the dog and shall notify the Rescue as soon as reasonably possible. Unless otherwise agreed to in writing, Foster shall not assume that the Rescue will reimburse veterinary expenses incurred without the Rescue’s prior authorization. Without prior authorization, Foster assumes all veterinary bills while in Foster's care.

8. DOG BEHAVIOR AND SAFETY - Foster acknowledges that the Rescue may not have complete knowledge of the foster dog’s history, temperament, medical condition, or behavioral tendencies. Foster understands that the dog may have unknown behavioral or medical issues. Foster agrees to use appropriate precautions based on the dog’s known or observed behavior and shall immediately report any concerning behavior to the Rescue, including but not limited to: Growling, snapping, or biting; Resource guarding; Aggression toward people or animals; Escape attempts; Separation anxiety; Destructive behavior; Fear or anxiety; Any behavior that presents a safety concern.

9. CHILDREN, HOUSEHOLD MEMBERS, AND OTHER ANIMALS - Foster agrees to exercise appropriate supervision and precautions when the foster dog is around children, vulnerable individuals, visitors, or other animals. Foster understands that the Rescue cannot guarantee that the foster dog is safe with children, cats, dogs, livestock, or other animals. Foster is responsible for determining and maintaining appropriate supervision and separation based upon the dog’s behavior and the circumstances.

10. TRANSPORTATION - Foster assumes responsibility for the foster dog while transporting the dog or allowing another person to transport the dog with Foster’s permission. The dog shall be appropriately restrained during transportation. Foster accepts responsibility for any risks associated with transporting the foster dog, to the fullest extent permitted by law.

11. NO REPRESENTATIONS OR GUARANTEES - Foster acknowledges that Peachy Day Farms Rescue makes no guarantees regarding the foster dog’s health, temperament, behavior, training, breed, age, compatibility with people or animals, or future behavior. Any information provided by the Rescue regarding the dog is provided to the best of the Rescue’s knowledge and is not a guarantee.

12. FOSTER HOME AND PROPERTY - Foster is responsible for ensuring that the foster dog is permitted to reside at the Foster’s property. Foster is responsible for complying with all applicable landlord, homeowner association, municipal, county, state, and other applicable rules concerning animals. Foster accepts responsibility for any damage caused by the foster dog to Foster’s home, yard, vehicle, belongings, or other property.

13. NO BREEDING OR ALTERATION - The foster dog shall not be bred or intentionally used for breeding purposes. Foster shall not have the dog surgically altered, including spaying or neutering, without prior approval from the Rescue unless required as part of an emergency veterinary procedure.

14. NO UNAUTHORIZED TRANSFER - Foster may not give, sell, surrender, abandon, transfer, re-home, or otherwise place the foster dog with another person, rescue, shelter, organization, or business without prior authorization from Peachy Day Farms Rescue. If Foster can no longer care for the dog for any reason, Foster agrees to contact the Rescue immediately so that appropriate arrangements can be made.

15. RIGHT TO REMOVE DOG - Peachy Day Farms Rescue reserves the right to request the immediate return of the foster dog at any time and for any reason. Upon receiving such a request, Foster agrees to cooperate fully with the Rescue and promptly make the foster dog available for return. Foster acknowledges that the foster dog remains the property of Peachy Day Farms Rescue unless and until ownership is formally transferred in writing by the Rescue. If Foster refuses, fails, or otherwise declines to cooperate with a lawful request to return the foster dog, Foster expressly authorizes Peachy Day Farms Rescue and its authorized representatives to enter the outdoor areas of Foster’s property where the foster dog is reasonably believed to be located, solely for the purpose of recovering and safely removing the foster dog. Foster agrees not to obstruct, interfere with, conceal, relocate, or otherwise prevent Peachy Day Farms Rescue or its authorized representatives from recovering the foster dog following a request for its return. This authorization is limited to the recovery of the foster dog and does not authorize entry into Foster’s residence or other enclosed/private structures without Foster’s consent or other lawful authority. Nothing in this provision is intended to authorize conduct prohibited by law, and Peachy Day Farms Rescue reserves the right to pursue any other lawful remedy available if Foster refuses to return the foster dog.

16. FOSTER’S PERSONAL INSURANCE - Foster understands that Peachy Day Farms Rescue does not provide Foster with homeowners, renters, automobile, medical, health, veterinary, or other insurance coverage. Foster is solely responsible for determining whether Foster’s insurance provides adequate coverage for the possession and care of a dog.

17. ACKNOWLEDGMENT OF VOLUNTARY PARTICIPATION - Foster acknowledges that participation in the Peachy Day Farms Rescue foster program is voluntary and unpaid. Foster understands the responsibilities and risks associated with fostering a rescue dog and voluntarily agrees to accept those responsibilities.

18. ENTIRE AGREEMENT - This Agreement constitutes the understanding between Peachy Day Farms Rescue and Foster concerning the foster placement of the dog identified above. Any amendment to this Agreement must be made in writing. If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law. 19. GOVERNING LAW - This Agreement shall be governed by and interpreted under the laws of the State of California, to the extent applicable. 20. ACKNOWLEDGMENT AND SIGNATURE - By signing below, Foster confirms that Foster: (1) Has read and understands this Agreement. (2) Has had the opportunity to ask questions regarding the Agreement. (3) Understands that fostering a dog involves inherent risks. (4) Voluntarily assumes responsibility for the foster dog while the dog is in Foster’s care, custody, possession, or control. (5) Agrees to the release, assumption of responsibility, and indemnification provisions contained in this Agreement. (6) Agrees to comply with all Peachy Day Farms Rescue foster policies and instructions. (7) Understands that Peachy Day Farms Rescue may request the dog’s return at any time.
