1. Activities Covered

I understand that AspenOUT, a program of the Roaring Fork Gay and Lesbian Community Fund dba AspenOUT, offers a variety of recreational, social, educational, cultural, and community activities.

This Waiver applies to my participation in AspenOUT activities and programs, including, but not limited to:

• hiking and walking
• biking and other outdoor activities
• art clubs, workshops, and activities
• book clubs and discussion groups
• social gatherings and community events
• educational and cultural activities
• recreational clubs and activities
• activities led or facilitated by AspenOUT employees, volunteers, independent contractors, instructors, or other program leaders
• other similar activities sponsored, organized, or facilitated by AspenOUT.

I understand that the specific activities, locations, conditions, and level of physical activity may vary from one program or event to another.

2. Assumption of Risk

I understand that participation in AspenOUT activities is voluntary and that some activities may involve inherent or other risks.

Depending on the activity, these risks may include, but are not limited to, falls, slips, uneven or changing terrain, rocks, roots, trails, weather conditions, temperature, altitude, wildlife, water, bicycles or other equipment, physical exertion, interaction with other participants, transportation associated with an activity, and other conditions or hazards that may arise during participation.

I understand that some risks may be foreseeable and others may not be foreseeable.

I voluntarily choose to participate in AspenOUT activities and knowingly assume the risks associated with my participation, including risks that may arise from the ordinary negligence of AspenOUT or persons acting on its behalf, to the extent permitted by Colorado law.

I understand that I am responsible for determining whether an activity is appropriate for me based on my own abilities, experience, physical condition, and comfort level.

I agree to:

• follow reasonable instructions provided by AspenOUT and activity leaders;
• use reasonable care for my own safety and the safety of others;
• use appropriate clothing, footwear, equipment, and safety gear for the activity;
• notify the activity leader if I am unable or unwilling to continue an activity; and
• follow applicable rules, trail requirements, venue rules, and safety instructions.

I understand that AspenOUT does not guarantee that any particular activity, route, location, equipment, or program will be free from hazards.

To the fullest extent permitted by Colorado law, I release and agree not to hold liable Roaring Fork Gay and Lesbian Community Fund dba AspenOUT, and its directors, officers, employees, volunteers, agents, independent contractors, instructors, activity leaders, representatives, and program partners (collectively, the "Released Parties") for claims arising from my participation in AspenOUT activities, including claims for personal injury, illness, death, property damage, or loss.

This release applies to claims arising from the ordinary negligence of a Released Party, to the extent such a release is permitted and enforceable under applicable Colorado law.

This release does not apply to conduct for which liability cannot legally be waived or released under Colorado law.

In the event of an emergency, I authorize AspenOUT and its representatives to obtain reasonable emergency medical assistance on my behalf if I am unable to do so myself.

I understand that AspenOUT is not responsible for the cost of medical treatment or transportation provided to me.

I understand that AspenOUT is not responsible for loss, theft, or damage to personal belongings brought to or used during an AspenOUT activity, except to the extent liability cannot legally be excluded.

By signing below, I acknowledge that:

• I have read and understand this Waiver;
• I understand that AspenOUT activities vary and may include both low-risk social activities and activities involving physical or outdoor risks;
• I have had the opportunity to ask questions about the activities in which I intend to participate;
• I am voluntarily participating; and
• I agree to the terms of this Waiver.

I understand that this Waiver applies to AspenOUT recreational activities and community programs during the program year indicated below, unless AspenOUT requires a new waiver for a particular activity.
