  • CROWN LOGISTICS INC. | SAFETY & COMPLIANCE

  • 1. DRIVER QUALIFICATION & LICENSING

  • I will maintain all licenses, endorsements, medical qualification, and documents required for the commercial motor vehicle and operation. I will immediately report any suspension, revocation, disqualification, out-of-service order, restriction, or other condition affecting my legal ability to drive.

    Legal / regulatory reference: 49 CFR Part 391; Fla. Stat. § 322.53.
  • 2. PRE-TRIP, EN-ROUTE & POST-TRIP INSPECTIONS

  • Before moving a tractor or trailer, I will perform a meaningful inspection and be satisfied that the equipment is in safe operating condition. I will not rely solely on a prior driver, mechanic, dispatcher, warning light, or electronic system.
    • Inspect tires, wheels, rims, hubs, lug nuts, brakes, air system, steering, suspension, coupling components, lights, mirrors, windshield, wipers, horn, seat belt, emergency equipment, trailer condition, cargo securement, seals, and reefer condition when applicable.
    • Report observable safety defects immediately and do not knowingly operate equipment in a condition likely to cause an accident or breakdown.
    Legal / regulatory reference: 49 CFR §§ 396.3, 396.7, 396.11 and 396.13; Fla. Stat. § 316.3025.
  • 3. DEFECTS, BREAKDOWNS & MAINTENANCE REPORTING

  • If a defect, breakdown, warning light, tire issue, brake issue, air leak, reefer alarm, or other safety concern occurs, I will stop when necessary, report the problem immediately, document the condition, and follow lawful repair instructions.
    • I will provide photos/video, exact location, unit information, and repair information when requested.
    • I will not hide or delay reporting a known safety defect or deliberately continue operating unsafe equipment.
    Legal / regulatory reference: 49 CFR §§ 396.3 and 396.7.
  • 4. ELD & HOURS OF SERVICE

  • I will comply with Hours-of-Service and ELD requirements at all times.
    • No log falsification, hidden driving time, account sharing, improper Personal Conveyance/Yard Move, or use of another driver's ELD account.
    • No unplugging, disabling, or tampering with ELD/GPS/camera equipment to conceal activity.
    • I will immediately report an ELD malfunction and will not accept or request dispatch that requires an HOS violation.
Legal / regulatory reference: 49 CFR Part 395.
  • 5. SEAT BELT, CELL PHONE & DISTRACTED DRIVING

  • I understand that safe driving requires my full attention.
    • Seat belt use is mandatory whenever the CMV is in motion.
    • No texting or prohibited hand-held mobile telephone use while driving.
    • No watching videos, social media, streaming, or entertainment content while driving. If manual interaction is required, I will safely park first.
    Legal / regulatory reference: 49 CFR §§ 392.16, 392.80 and 392.82.
  • 6. UNAUTHORIZED PASSENGERS

  • No friend, family member, spouse/partner, child, hitchhiker, or other unauthorized person may ride in the truck without prior written Company authorization and satisfaction of applicable legal and insurance requirements.
  • Crown Logistics Inc. | MC 443091 | USDOT 1063121 | Driver Safety & Responsibility Acknowledgment
  • Legal / regulatory reference: 49 CFR § 392.60.

  • 7. CARGO, BOL, SEAL & REEFER RESPONSIBILITIES

  • I will protect the load and shipping documents entrusted to me and follow lawful cargo and customer requirements.
    • Before leaving the shipper, obtain and protect the BOL and required documents; document shortage, overage, damage, count restrictions, seal discrepancies, or temperature issues.
    • When required, send photos of loaded freight, cargo placement, seal, BOL, and reefer temperature before departure.
    • For reefer loads, verify set point, Continuous/Cycle mode, fuel level, alarms, and temperature instructions. Do not alter a seal without authorization except when required by law or receiver procedure; document any seal change.

Legal / regulatory reference: 49 CFR Part 393 and applicable Company/customer procedures.

  • 8. ACCIDENTS, INCIDENTS & ROADSIDE INSPECTIONS

  • Every crash, cargo incident, property damage event, injury, citation, roadside inspection, out-of-service order, tow, theft, attempted theft, or major mechanical event must be reported to Safety immediately or as soon as safely possible.
    • Stop safely and contact emergency services when appropriate; notify Safety/Dispatch; obtain police/inspection and witness information; take photos/video when safe.
    • Do not argue or make admissions of legal liability. Send every roadside inspection report to Safety promptly and cooperate with legally required post-accident testing.

Legal / regulatory reference: 49 CFR Parts 382, 390 and 396, as applicable.

  • 9. ALCOHOL, CONTROLLED SUBSTANCES & SAFETY-SENSITIVE CONDUCT

  • I will comply with all applicable federal drug/alcohol testing prohibitions, Clearinghouse requirements, and return-to-duty obligations, and I will not perform a safety-sensitive function when prohibited by law.

Legal / regulatory reference: 49 CFR Parts 382 and 40.

  • 10. EQUIPMENT CUSTODY & RETURN / NO ABANDONMENT

  • Unauthorized abandonment of a tractor, trailer, load, keys, fuel card, shipping documents, or other Company property is strictly prohibited. If I stop driving, refuse further dispatch, become unable to continue, or am instructed to return equipment, I remain responsible for safeguarding it and following lawful written return/recovery instructions unless a genuine emergency makes that impossible.
    • I will not intentionally leave equipment or cargo at an unauthorized truck stop, residence, repair shop, roadside location, terminal, tow yard, or other location without Company authorization.
    • If an emergency prevents normal return, I will immediately provide exact GPS location, current photos/video, truck/trailer condition, cargo/seal status, and location of keys/documents, and cooperate with a reasonable recovery plan.
    • If equipment is not returned after lawful demand, Crown Logistics may pursue lawful recovery and civil remedies for actual documented losses permitted by contract and law. Law-enforcement contact will be based on facts and applicable law.

Legal / regulatory reference: Fla. Stat. §§ 812.014 and 812.155 may apply depending on the facts and legal relationship.

  • 11. COMPANY PROPERTY, FUEL CARDS & DEVICES

  • Fuel cards, toll devices, keys, permits, ELD hardware, cameras, tablets, tools, and documents are for authorized business use only.
    • No personal fuel purchases, unauthorized cash advances, credential sharing, or transfer of Company property to another person.
    • No intentional disabling or removal of ELD, GPS, camera, or safety equipment. Lost, stolen, or damaged Company property must be reported immediately and returned upon demand or at the end of the relationship.
  • 12. NEGLIGENCE, DAMAGE & DOCUMENTED LOSSES

  • To the extent permitted by applicable law and the parties' written agreement, I may be held responsible for actual documented losses directly caused by intentional misconduct, theft, fraud, gross negligence, unauthorized use, intentional equipment damage, fuel-card abuse, unauthorized abandonment, or deliberate concealment of known damage. A breakdown, tire failure, crash, cargo claim, or repair does not automatically make me financially responsible; responsibility must be based on documented facts, the governing agreement, and applicable law.
  • 13. COMPANY / MOTOR CARRIER RESPONSIBILITIES

  • I understand that Crown Logistics also has legal safety responsibilities and that this acknowledgment does not shift legally non-delegable motor-carrier duties to the driver.
    • Crown Logistics will maintain required operating authority and insurance; systematically inspect, repair, and maintain Company-controlled equipment as required by law; evaluate reported defects; maintain required driver qualification and safety records; and will not knowingly require operation of legally unsafe equipment or HOS/ELD violations.

Legal / regulatory reference: 49 CFR § 396.3 and other applicable FMCSA regulations.

  • 14. CORRECTIVE ACTION

  • Safety responses depend on seriousness, history, intent, risk, and applicable law. Depending on the facts, violations may result in documented coaching, retraining, temporary removal from dispatch, or termination/end of the driving or contractual relationship.
    • Serious examples include intentional log falsification, prohibited drug/alcohol conduct, serious distracted-driving violations, unauthorized passengers, intentional damage/theft, material dishonesty, repeated refusal to perform required inspections, and unauthorized equipment abandonment.
  • 15. ENFORCEMENT, COURT COSTS & ATTORNEY'S FEES

  • If a dispute arises out of or relates to this signed acknowledgment and Crown Logistics or the driver/contractor brings a legal action to enforce it, the prevailing party may recover reasonable attorney's fees and taxable court costs to the extent permitted by applicable Florida law and ordered by the court. This provision is intended to apply reciprocally to the parties and, unless a court determines otherwise, includes reasonable fees and costs incurred at trial and on appeal. Nothing in this section makes a driver automatically liable merely because a dispute or claim occurs, and nothing authorizes recovery of fees or costs that a court or applicable law does not permit.

Legal / regulatory reference: Fla. Stat. § 57.105(7) provides reciprocity when a contract gives one party attorney-fee rights for enforcement; Fla. Stat. § 59.46 addresses prevailing-party fee provisions on appeal.

  • 16. FLORIDA GOVERNING LAW & SEVERABILITY

  • This acknowledgment will be interpreted under applicable federal law and the laws of the State of Florida, without waiving any mandatory law that applies to an interstate operation or another jurisdiction. To the extent a venue selection is legally enforceable, any civil action arising from this acknowledgment shall be brought in the state or federal court having jurisdiction in the Florida county where Crown Logistics maintains its principal business office, unless the parties agree otherwise in writing or applicable law requires another venue. If a provision is held invalid or unenforceable, the remaining provisions will continue to the extent legally permitted.
  • 17. LIMITED INDEMNIFICATION

  • To the extent permitted by applicable law and the governing written agreement, the driver/contractor agrees to indemnify and hold Crown Logistics harmless from actual, documented third-party losses, damages, claims, penalties, and reasonable recovery expenses to the extent directly caused by the driver/contractor's intentional misconduct, fraud, theft, gross negligence, unauthorized use, or material breach of a lawful duty under this acknowledgment. This provision does not transfer or waive Crown Logistics' non-delegable motor-carrier duties, does not create automatic liability, and does not not require indemnification for losses caused by Crown Logistics' own negligence or legal responsibility except to the extent enforceable under applicable law.

I have read, understood, and agree to comply with this section.
  • 18. ELECTRONIC SIGNATURES & COPIES

  • The parties agree that electronic signatures, electronic acknowledgments, and electronically stored copies of this document may be used to the extent permitted by applicable law. A properly authenticated electronic copy may be treated as a counterpart of the signed original.

I have read, understood, and agree to comply with this section.
  • 19. FINAL DRIVER ACKNOWLEDGMENT & SIGNATURE

  • By signing below, I confirm that I received this Crown Logistics Driver Safety, Equipment Responsibility & Operating Acknowledgment, had the opportunity to read it and ask questions, and agree to comply with its lawful safety and equipment requirements while operating under Crown Logistics authority or while entrusted with Crown Logistics-controlled equipment. I understand that this document does not waive rights that cannot legally be waived and does not replace any separate lease, independent-contractor, compensation, or employment agreement.
