IN SHORT. By signing, I accept that basketball carries real risk of injury, I release Ballin' 4 Peace, Elite32, and Basketball City from claims for injuries, I authorize emergency medical care for the player, and I allow photos and video from the event to be used. The full terms are below.
FALL BRAWL 2026 PARTICIPATION WAIVER, RELEASE OF LIABILITY, AND MEDIA RELEASE
Event: Fall Brawl 2026, October 31, 2026, Basketball City, Pier 36, New York, NY (the "Event"). "Released Parties" means Ballin' 4 Peace, Inc., Elite32, Basketball City, the owners, lessors, and operators of the venue, Event sponsors and partners (including Trace), and each of their officers, directors, employees, coaches, officials, volunteers, contractors, and agents. "Player" means the participant named in this form. "I" means the Player's parent or legal guardian who signs below, or the Player if the Player is 18 or older.
1. PERMISSION AND AUTHORITY. I am the Player's parent or legal guardian with authority to sign, or I am the Player and I am 18 or older. I give permission for the Player to take part in the Event, including games, warm-ups, practices, and related activities at the venue.
2. ASSUMPTION OF RISK. I understand that basketball is a fast, physical contact sport. Risks include, but are not limited to, falls, collisions with other players, officials, spectators, and equipment, contact with the floor, walls, backboards, and benches, sprains, fractures, ligament and joint injuries, head and neck injuries, concussions, paralysis, and in rare cases death. Risks also come from the conduct of other participants and spectators, from equipment or facility conditions, and from travel to and from the Event. These risks exist even when reasonable care is used, and I knowingly and voluntarily accept them on behalf of the Player.
3. RELEASE OF LIABILITY. To the fullest extent permitted by New York law, I release, waive, and discharge the Released Parties from all claims, demands, and liability for injury, illness, death, or loss to the Player or the Player's property connected to the Event, including claims based on the ordinary negligence of a Released Party. I agree not to sue or bring claims against any Released Party for these matters. This release binds me, the Player, and our heirs, guardians, and representatives.
4. INDEMNITY. I agree to defend and reimburse the Released Parties for costs, losses, and legal fees arising from any claim brought by or on behalf of the Player, or by anyone else because of the Player's conduct, that is covered by this release.
5. HEALTH AND FITNESS. I confirm that the Player is in good health and physical condition, has no condition that would make participation unsafe, and has been cleared for athletic activity if a physician's clearance is needed. I am responsible for telling Event staff about any condition they should know about.
6. MEDICAL CARE. If I cannot be reached in an emergency, I authorize Event staff to arrange emergency medical care, including first aid, ambulance transport, and treatment by a licensed provider, and to share needed information with those providers. I am responsible for all medical and transport costs. Event staff are not required to provide medical care, and the Released Parties do not provide medical insurance for the Player.
7. CONCUSSIONS AND HEAD INJURIES. I understand the risks of concussion. A player showing signs of a concussion or head injury will be removed from play and may return only with written medical clearance. Event staff and officials may make this decision, and I will not hold them responsible for making it in good faith.
8. RULES, CONDUCT, AND ELIGIBILITY. The Player and everyone attending with the Player will follow Event rules, venue rules, and the instructions of staff and officials. Official decisions are final. The Player will compete only in the age or grade division the team registered for, and the information given in registration is accurate. The Event may remove or disqualify any player, coach, or spectator for unsafe, abusive, or unsportsmanlike conduct or for providing false information, without refund.
9. PHOTO, VIDEO, AND LIKENESS. Games and activities are photographed and recorded, including by Trace camera systems and livestreams. I give Ballin' 4 Peace, Elite32, Basketball City, Trace, and their partners and sponsors the free, worldwide, permanent right to record and use the Player's name, image, voice, likeness, and performance from the Event in photos, video, livestreams, social media, websites, fundraising, sponsorship, and promotion, in any media, without payment or approval. I release these parties from claims related to this use.
10. PERSONAL PROPERTY. The Released Parties are not responsible for lost, stolen, or damaged belongings.
11. SCHEDULE, WEATHER, AND CANCELLATION. Game times, courts, brackets, and Event details can change. The Released Parties are not liable for changes, delays, or cancellation for reasons beyond their control. Refunds follow the policy shown at registration.
12. COMMUNICATIONS AND INFORMATION. I agree that the Event may contact me at the email I provide about this registration, schedules, safety, and Event updates. Marketing emails are sent only if I check the optional box. The information I provide is used to run the Event and to keep records.
13. ELECTRONIC SIGNATURE. I agree that my drawn electronic signature is legally binding and has the same effect as a handwritten signature, and I consent to receive a copy of this waiver electronically.
14. GENERAL TERMS. This waiver is governed by the laws of the State of New York, and any dispute will be brought in the state or federal courts located in New York County. If any part of this waiver is found unenforceable, the rest stays in effect. This waiver applies to the whole Event and any related activity.
15. ACKNOWLEDGMENT. I have read this waiver, I understand it, I understand that I am giving up legal rights, and I sign it voluntarily.
