CRUISIN’ ENTERTAINMENT
CUSTOMER PARTICIPATION, LIABILITY WAIVER & RESPONSIBLE PARTY AGREEMENT
The individual signing this Agreement is the customer and booking party ("Responsible Party") for the event identified in the applicable booking confirmation.
This Agreement governs participation in Cruisin’ Entertainment activities and should be read together with the Cruisin’ Entertainment Booking Terms & Conditions.
1. ACTIVITIES AND EQUIPMENT
This Agreement applies to participation in, and use of, activities and equipment provided by Cruisin’ Entertainment, including but not limited to:
Video game consoles and gaming equipment;
Gaming trailer facilities;
Televisions, controllers, headphones, and related equipment;
Cornhole;
Jumbo Jenga / Tumble Tower;
Tetris-style games;
PutterBall;
Ladder Toss;
Giant Connect 4;
Family Axe Throwing and similar recreational games;
Karaoke equipment and activities; and
Other recreational games, equipment, and entertainment activities provided by Cruisin’ Entertainment.
Cruisin’ Entertainment may modify, substitute, remove, or discontinue an activity or piece of equipment when reasonably necessary because of weather, safety concerns, equipment malfunction, availability, or other operational considerations.
2. ACKNOWLEDGMENT AND ASSUMPTION OF RISK
I understand that participation in recreational activities and use of gaming and entertainment equipment involves inherent and other risks.
These risks may include, but are not limited to:
Slips, trips, and falls;
Collisions;
Strains and sprains;
Cuts, bruises, and other injuries;
Injuries resulting from physical activity;
Equipment-related injuries;
Improper or unsafe use of equipment; and
Other injuries or losses that may occur during participation.
I understand that participation should be appropriate for each participant's age, physical condition, skill level, and ability.
I voluntarily choose to participate and assume the inherent risks associated with the activities in which I participate.
3. RELEASE AND WAIVER
To the fullest extent permitted by applicable law, I, on behalf of myself, release and agree not to hold Cruisin’ Entertainment, its owners, employees, contractors, agents, representatives, and event personnel responsible for claims, liabilities, damages, losses, or expenses arising from my participation in the activities or use of equipment, including risks inherent in the activities.
This release applies to claims arising from ordinary negligence to the extent such a release is permitted and enforceable under applicable law.
Nothing in this Agreement is intended to release, waive, or limit any liability or claim that cannot legally be released, waived, or limited under applicable law.
I understand that this Agreement applies to my own participation and claims. I understand that the Responsible Party's acceptance of this Agreement does not automatically waive or release the independent legal rights of another adult participant.
4. RESPONSIBLE PARTY
The Responsible Party acknowledges that they are the individual booking and paying for the event.
The Responsible Party agrees to:
Provide accurate booking and contact information;
Communicate applicable Cruisin’ Entertainment safety rules and requirements to guests and participants;
Encourage participants to follow instructions provided by Cruisin’ Entertainment personnel;
Ensure that minors have the consent of a parent or legal guardian when required;
Cooperate with Cruisin’ Entertainment personnel regarding unsafe, disruptive, destructive, abusive, or inappropriate behavior; and
Take reasonable steps to prevent guests from intentionally or negligently damaging Cruisin’ Entertainment property or equipment.
The Responsible Party understands that the Booking Terms & Conditions govern the Customer's contractual and financial responsibilities, including property damage, lost property, payment authorization, and related charges.
The Responsible Party understands that signing this Agreement does not make the Responsible Party the legal guardian or legal representative of another adult or minor participant.
5. PARTICIPANT RESPONSIBILITIES
Participants are expected to:
Follow all instructions provided by Cruisin’ Entertainment personnel;
Use equipment only for its intended purpose;
Treat the gaming trailer, equipment, games, and property with reasonable care;
Refrain from behavior that could endanger themselves or others;
Immediately report damaged equipment, unsafe conditions, or injuries to Cruisin Entertainment personnel;
Follow posted or communicated safety rules; and
Not participate while impaired by alcohol, drugs, or any other substance that could impair judgment, coordination, or ability to safely participate.
Cruisin’ Entertainment reserves the right to remove a participant from an activity or terminate a participant's use of equipment for unsafe, disruptive, destructive, abusive, or inappropriate behavior.
6. MINORS
Participants under the age of 18 must have the consent of a parent or legal guardian before participating when such consent is required by applicable law or by Cruisin’ Entertainment's policies.
The parent or legal guardian must have authority to provide consent on behalf of the minor.
The Responsible Party may not provide parental or legal-guardian consent on behalf of another person's minor child unless the Responsible Party has the legal authority to do so.
By providing consent for a minor, the parent or legal guardian acknowledges the risks associated with the minor's participation and agrees to the applicable waiver and release provisions to the fullest extent permitted by law.
Parents and legal guardians remain responsible for supervising their minor children unless other supervision arrangements have been expressly agreed upon in writing with Cruisin’ Entertainment.
7. MEDICAL ASSISTANCE
Cruisin’ Entertainment does not provide medical services.
In the event of an injury or medical emergency, Cruisin’ Entertainment may contact emergency medical services or obtain reasonable emergency assistance when necessary.
Participants are responsible for their own medical expenses and treatment costs, except to the extent otherwise required by applicable law.
For a minor participant, Cruisin’ Entertainment may seek appropriate emergency medical assistance when reasonably necessary, particularly when a parent or legal guardian cannot be reached promptly.
8. PERSONAL BELONGINGS
Cruisin’ Entertainment is not responsible for lost, stolen, or damaged personal belongings brought to an event or placed inside or around the gaming trailer, except to the extent otherwise required by applicable law.
Participants are responsible for their own personal property.
9. ON-SITE SAFETY ACKNOWLEDGMENT
Before the event begins, Cruisin’ Entertainment personnel may provide the Responsible Party and/or participants with a verbal safety briefing.
The briefing may include:
Proper use of the gaming trailer and equipment;
Proper use of yard games;
Rules regarding unsafe or inappropriate behavior;
Rules regarding food and beverages;
Rules regarding alcohol or impairment;
Procedures for reporting injuries or damaged equipment; and
Other safety requirements applicable to the event.
The Responsible Party agrees to communicate applicable safety instructions to guests and cooperate with Cruisin’ Entertainment personnel in maintaining a safe event environment.
The verbal safety briefing supplements, and does not replace, the written terms and acknowledgments contained in this Agreement.
10. ACKNOWLEDGMENT
By signing or electronically accepting this Agreement, I acknowledge that:
I am the customer and Responsible Party for the event identified in the booking.
I have read and understand this Agreement.
I understand that recreational activities involve inherent risks.
I voluntarily agree to participate in the activities covered by this Agreement.
I agree to follow Cruisin’ Entertainment's safety rules and instructions.
I understand my responsibilities as the Responsible Party.
I understand that the Booking Terms & Conditions govern the Customer's financial and contractual responsibilities.
I understand that I cannot legally waive the independent rights of another adult participant merely by signing this Agreement.
I understand that a parent or legal guardian must provide any consent required for a minor participant.
I have had the opportunity to ask questions regarding this Agreement before accepting it.
I understand that this Agreement is intended to be legally binding to the fullest extent permitted by applicable law.
11. ELECTRONIC ACCEPTANCE
Electronic acceptance of this Agreement through the Cruisin’ Entertainment booking system constitutes the Responsible Party's acknowledgment and acceptance of the terms of this Agreement to the fullest extent permitted by applicable law.
The electronic record may include the customer's name, email address, date and time of acceptance, event information, and the version of the Agreement accepted.
