KENNEDY MEADOWS MUSIC FESTIVAL
TICKET TERMS, ASSUMPTION OF RISK & RELEASE OF LIABILITY
PLEASE READ CAREFULLY. THESE TERMS AFFECT YOUR LEGAL RIGHTS.
PART I — TICKET TERMS, ASSUMPTION OF RISK & RELEASE
1. TICKET HOLDER AGREEMENT
Each ticket, wristband, camping pass, parking pass or other admission credential issued for the Kennedy Meadows Music Festival (“Event”) is a revocable license subject to these Terms.
By purchasing, accepting, receiving, registering, possessing or using an Event credential, and/or by entering any Event area, each attendee (“Holder”) acknowledges that they have had access to these Terms and agrees to be bound by them.
Event areas include the Kennedy Meadows Music Festival grounds, Kennedy Meadows Resort & Pack Station, associated campgrounds, parking and loading areas, shuttle vehicles and stops, access routes, and other areas used in connection with the Event.
A purchaser obtaining credentials for other adults must provide or make these Terms available to those individuals. Each adult Holder accepts these Terms individually by accepting or using the credential and/or entering the Event.
2. ASSUMPTION OF RISK
Holder understands that the Event is conducted in a remote mountain and outdoor environment and involves inherent, known, unknown and potentially significant risks.
These risks include, but are not limited to:
uneven, rocky, steep, wet or unimproved terrain;
slips, trips, falls and falling objects;
darkness and limited outdoor lighting;
nearby rivers, waterways and natural hazards;
high elevation and changing temperatures;
severe or rapidly changing weather, including heat, cold, rain, wind and lightning;
wildfire, smoke, poor air quality and evacuation conditions;
wildlife, insects, horses, mules, livestock and other animals;
camping and outdoor activities;
motor vehicles, parking areas, roadways, shuttle transportation and pedestrian traffic;
crowds and the acts or omissions of other attendees;
consumption of food or alcoholic beverages and the conduct of persons who may be impaired;
communicable illnesses;
limited or unavailable cellular telephone service;
distance from hospitals and emergency medical facilities;
delayed emergency, rescue or medical response; and
other risks associated with attending an outdoor music festival in a remote mountain location.
Holder knowingly and voluntarily assumes all risks of injury, illness, death, property damage or loss associated with attending or participating in the Event, whether known or unknown and whether specifically described above or not.
3. RELEASE OF LIABILITY — INCLUDING ORDINARY NEGLIGENCE
To the fullest extent permitted by California law, Holder RELEASES, WAIVES AND DISCHARGES Kennedy Meadows Music Festival, Kennedy Meadows Resort & Pack Station, the owners and operators of the Event and Event property, and their respective owners, members, managers, officers, employees, volunteers, agents, contractors, shuttle operators, security personnel, sponsors, vendors, performers, representatives, successors and affiliates (“Released Parties”) from claims arising from Holder’s attendance at or participation in the Event, including claims for personal injury, illness, death, property damage or property loss.
THIS RELEASE EXPRESSLY INCLUDES CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY, including ordinary negligence relating to the condition, maintenance, operation or use of Event premises, facilities, equipment, parking areas, campgrounds or transportation.
Holder understands that this means Holder is agreeing not to hold a Released Party legally responsible for injuries or damages caused by that Released Party’s ordinary negligence, to the fullest extent permitted by law.
This Release does not release claims for gross negligence, reckless or willful misconduct, intentional misconduct, or any other liability that cannot lawfully be waived under California law.
4. EMERGENCY AND MEDICAL RESPONSE
Because the Event occurs in a remote location, emergency medical or rescue response may be delayed.
Holder authorizes Event personnel to contact emergency responders and provide reasonable assistance when an injury, illness or emergency is observed or reported.
Holder is responsible for medical, ambulance, rescue, evacuation, transportation or other expenses incurred on Holder’s behalf to the extent permitted by law.
5. PERSONAL PROPERTY
Holder is responsible for personal belongings brought to the Event. The Released Parties are not responsible for lost, stolen, misplaced or damaged personal property except where liability cannot legally be excluded.
6. MINORS
A parent or legal guardian who purchases, accepts or uses an Event credential for an accompanying minor acknowledges the risks described in these Terms and agrees to these Terms on behalf of themselves and the minor to the fullest extent permitted by California law.
Parents and guardians remain responsible for appropriate supervision of minors while attending the Event.
7. REVOCABLE LICENSE
Admission to the Event is a privilege and revocable license.
Kennedy Meadows Music Festival and Kennedy Meadows Resort & Pack Station may deny admission, revoke a credential, remove an attendee or terminate camping privileges when an attendee violates these Terms or Event rules or engages in conduct that is unsafe, unlawful, threatening, harassing, disruptive or materially interferes with the safety or enjoyment of others.
An attendee removed for violation of Event rules may be denied re-entry and may forfeit admission or camping privileges without refund to the extent permitted by law.
