TERMS AND CONDITIONS
By requesting service, authorizing work, signing a work order, approving an estimate, or establishing an account with Mondak Equipment & Hose, the customer agrees to the following terms:
1. Payment Terms
Payment is due upon receipt unless credit terms have been approved in writing by Mondak Equipment & Hose. Approval of credit terms is not automatic and will require a separate credit application and approval through our financing partner.
2. Card on File
A valid payment card is required to be kept on file unless otherwise approved in writing by Mondak Equipment & Hose. Card information will be collected through a secure payment method. Keeping a card on file does not by itself authorize charges outside the customer's applicable agreements or authorizations.
3. Estimates and Authorization
Estimates are based on information available at the time they are prepared and are not fixed-price guarantees unless specifically stated in writing. Additional labor, parts, travel, diagnostics, freight, shop supplies, outside services, or other charges may become necessary as work progresses. Mondak Equipment & Hose will make reasonable efforts to obtain approval for material additional work when practical.
4. Labor, Travel and Diagnostic Charges
Customer is responsible for authorized labor, diagnostic time, travel time, parts, materials, freight, outside services, and other applicable charges. Travel time for field service is billable at the applicable field-service rate.
5. Parts and Special Orders
Special-order, custom, electrical, programmed, or non-returnable parts may require advance payment and may not be refundable once ordered. Parts returns are subject to manufacturer and supplier return policies and may be subject to restocking or freight charges.
6. Completion and Payment
Invoices are issued when work is completed or as otherwise determined by Mondak Equipment & Hose. Payment is expected according to the terms shown on the invoice or approved account terms.
7. Past-Due Accounts
Balances remaining unpaid more than 15 days after their due date may be subject to a finance charge of 1.5% per month (18% annually) or the maximum amount permitted by applicable law, whichever is less.
Customer is responsible for reasonable costs incurred in collecting unpaid balances, including collection expenses, attorney fees, court costs, and other lawful recovery expenses.
8. Lien and Collection Rights
Mondak Equipment & Hose reserves all lien, possessory, mechanic's lien, statutory, contractual, and other collection rights available under applicable law for unpaid labor, parts, materials, storage, or other charges.
9. Customer Responsibility
The customer represents that they own the equipment or are authorized to request and approve work on behalf of the owner. The customer is responsible for providing accurate billing, equipment, access, and authorization information.
10. Equipment and Property
Mondak Equipment & Hose will exercise reasonable care while equipment or property is in our possession. Mondak Equipment & Hose is not responsible for pre-existing conditions, concealed defects, failures unrelated to the work performed, or loss or damage caused by circumstances outside our reasonable control.
11. Warranty
Any warranty on labor or parts is limited to the specific work performed and parts supplied by Mondak Equipment & Hose and is subject to applicable manufacturer or supplier warranty terms. Warranty coverage does not include unrelated failures, abuse, misuse, improper operation, contamination, accidents, unauthorized repairs, or subsequent damage caused by another condition.
12. Acceptance of Terms
By signing below or electronically accepting these terms, the customer confirms that they are authorized to act on behalf of the company or account listed and agrees to Mondak Equipment & Hose's payment requirements and Terms and Conditions.
