This is an agreement between Earthroots Field School (“Earthroots”) and the undersigned participant (“Participant”). By signing this agreement, Participant acknowledges and accepts the risks associated with participation in the Activities (as defined below) and agrees to abide by the terms and conditions outlined herein. This agreement applies to Participant personally and, if Participant has any minor children (under 18) enrolled in any Earthroots’ programs (“Minor” or “Minors”), Participant also agrees to these terms on behalf of each such Minor. All references below to “Participant” include Participant and any of Participant’s Minors.
Earthroots provides hands-on activities at various wilderness and other outdoor areas, which may include, among other things, guided hiking, biking tours, team-building, gardening, and tidepooling (collectively the “Activities”). Wilderness areas pose
certain risks, such as poison oak, insects, native animals, rocky trails, and unpredictable weather conditions, which could result in personal injury or death. Participant certifies that Participant is in good physical condition and capable of participating in the Activities and agrees to participate in the Activities solely at Participant’s risk. To the extent Participant has any medical conditions or allergies that would affect Participant’s participation in the Activities, Participant will disclose them in writing to Earthroots. By voluntarily participating in the Activities, Participant assumes all risk of injury to Participant. To the fullest extent permitted by applicable law, Participant hereby agrees on behalf of Participant and Participant’s successors, assigns, representatives and affiliates, to fully and forever release, discharge, and dismiss all claims, demands, actions, causes of action and rights (known, unknown, contingent, accrued, or otherwise) that Participant has or may have against Earthroots and its agents, officers, directors, administrators, employees, representatives, insurers, vendors, successors, assigns, and attorneys from any and
all actions, causes of action, claims, interest, demands, damages, costs, expenses, and compensation, on account of, or in any way arising out of Participant’s participation in the Activities. Participant expressly waives and releases any and all rights and benefits under Section 1542 of the California Civil Code (or any analogous law of any other state), which reads as follows: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
Participant consents to and authorizes medical and/or dental care for Participant in case of an emergency, including x-ray examination, anesthetic, medical/dental or surgical diagnosis or treatment, and hospital care under the general or special supervision and upon the advice of or to be rendered by a licensed physician, surgeon, or dentist. This consent and authorization is given pursuant to California Family Code section 6910.
