The Makers' Retreat 2027 — Liability Waiver & Release

This Participation Agreement, Liability Waiver, and Release ("Agreement") is entered into between the participant named below ("Participant") and Magpie Fibers, LLC, a Maryland limited liability company ("Magpie Fibers"), in connection with participation in The Makers' Retreat, May 26 –31, 2027, in Guatemala ("Retreat").

By signing this Agreement, Participant agrees to all terms set forth herein, including the Release of Liability, Assumption of Risk, and Cancellation Policy.

Contract:

Welcome to Magpie Fibers, LLC (“we”, “us”, “our” and “Magpie Fibers”). Our goal is to design inspiring travel retreats that offer immersive, cultural experiences in a creative and nurturing environment. We ask each participant (“you”, “participant”, “guest”) to read the following Terms and Conditions carefully and let us know if you have any questions. These Terms and Conditions including all brochures, documents, correspondence and the terms and conditions of our suppliers form the basis of the contract with you. The Terms and Conditions contain waivers of liability and other important clauses that affect your legal rights. All persons wishing to make a booking acknowledge that they have carefully read and understand the Terms and Conditions that follow.

By making a booking with Magpie Fibers, you accept on behalf of yourself and all those named on the booking, to be bound by these Terms and Conditions.

A booking is confirmed upon receipt of deposit and registration form, upon which Magpie Fibers sends a confirmation email.

Changes:

From time to time, we may find it necessary to change these Terms and Conditions. If we make material changes, we will notify you. Updated versions of the Terms and Conditions will be posted on our website and are effective immediately on posting. Please check frequently, especially before you make a booking, to see if these Terms and Conditions have changed. Your continued use of our services including continuing to use or maintain any bookings after any changes to the Terms and Conditions constitutes your consent to the changes.

Please let us know about any pre-existing conditions, physical limitations, or dietary restrictions when you book your reservation so we can assist you in choosing appropriate activities and communicate your needs to our Guatemala coordinator, in advance.

Antigua's streets are largely cobblestone, and Antigua sits at approximately 5,000 feet of elevation, which can affect some guests. Antigua is a centuries-old colonial city located in Guatemala, not the United States, and its infrastructure — including cobblestone streets, uneven terrain, and older buildings — was not constructed to meet U.S. Americans with Disabilities Act (ADA) standards or any equivalent accessibility code. Participants should not expect ADA-level accommodations at the hotel, activity venues, or elsewhere during this retreat.While we will make every effort to accommodate dietary restrictions, food allergies, and physical limitations, options may be more limited than what participants are accustomed to at home. Certain venues, excursions, and facilities may have physical access constraints that are beyond our control. We encourage guests with specific needs to contact us before booking so we can have an honest conversation about what is and is not feasible.

Magpie Fibers will always follow government guidelines when it comes to health and safety. Your health matters to us and we will do everything we can to protect it.

You acknowledge that exposure to illness is an inherent risk of traveling that cannot be controlled or eliminated by Magpie Fibers. Therefore, if you choose to participate in this retreat, you agree that you are assuming the risk that you may be exposed to illness and that such exposure can lead to personal injury, illness, permanent disability, or death.

You agree that due to the uncertainty of travel there may be changes to your booking due to illness or health-related circumstances, for which there may be no refund. You agree to be aware of and abide by any rules and regulations for entry into Guatemala and the rules of any of our suppliers.

You, for yourself, and any minors traveling with you, and on behalf of your and their heirs, assigns, personal representatives and next of kin (The Releasors), HEREBY RELEASE, AND HOLD HARMLESS Magpie Fibers, LLC, its members, officers, agents, and/or employees, suppliers, and other retreat members (Releasees), of, from and against any and all claims, damages, demands, losses, and liability arising out of or related in any way, in whole or in part to any postponement, cancellation, changes, injury, disability, death or any other loss you may suffer due to exposure, infection, spread, closure, and travel restrictions related to illness or other health conditions, whether arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by law.

Travel insurance is mandatory for all participants. Proof of insurance must be submitted to Magpie Fibers within 7 days of your deposit being received. Failure to provide proof of travel insurance within this window may result in cancellation of your booking, with the $150 processing fee retained.

Your travel insurance policy must include, at minimum: trip cancellation, medical coverage, and emergency evacuation. We recommend policies that also include "Cancel for Any Reason" (CFAR) coverage given the nature of international travel.

Recommended providers include: Faye (faye.com), Seven Corners (sevencorners.com), Tin Leg Gold (tinleg.com), Allianz (allianztravelinsurance.com), and World Nomads (worldnomads.com). Magpie Fibers is not affiliated with any of these providers and does not receive compensation for these recommendations.

The terms of this hold harmless and release of liability paragraph shall survive any termination or cancellation of this Agreement, whether by operation of law or otherwise.

Magpie Fibers, LLC offers retail travel services to customers, which are provided by separate and independent vendors of travel services. Magpie Fibers does not operate, control, or otherwise provide the services of the independent travel vendors. Customer agrees that Magpie Fibers acts only as agent for the client in acquiring transportation, hotel accommodations, sightseeing, and other privileges or services for the clients' benefit, and on the express condition that Magpie Fibers shall not be responsible for any loss, accident, injury, delay, defect, omission or irregularity which may occur or be occasioned, whether by reason of any act, negligence or default of any company or person engaged in or responsible for carrying out any of the arrangements, or otherwise in connection therewith.

Participant is aware that travel of the nature undertaken on this retreat may involve inherent risks. Inherent risks include, but are not limited to, risk of injury or death from: participation in activities including the guided walking tour of Antigua on cobblestone and uneven terrain, the traditional weaving class, the Guatemalan cooking class, the ancestral cacao ceremony, and any optional excursions such as ATV tours, a Pacaya Volcano hike, or Lake Atitlán boat excursion; participation in informal creative activities including textile arts, weaving, and other crafting; accidents while traveling including motor vehicle collisions, collisions with animals, roadway hazards; slips and falls; criminal or terrorist acts; government actions; consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements including heat, cold, sun, water, wind, and altitude; your own negligence and/or the negligence of others, including tour guides, other participants, Magpie Fibers and its employees, agents and/or representatives; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no available medical services; fatigue, chill, overheating, altitude effects, and/or dizziness; known or unknown medical conditions; physical activity for which you are not prepared; the negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided.

Participant understands that the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death. In order to partake in the enjoyment and excitement of this trip, participant is willing to accept the risks and uncertainty involved as being an integral part of travel. Participant hereby accepts and assumes full responsibility for any and all risks and agrees to and shall hold harmless and fully release Magpie Fibers from any and all claims associated with the trip, including any claims of third-party negligence and/or the negligence of Magpie Fibers, and participant hereby covenants not to sue Magpie Fibers for any such claims or join any lawsuit or action that is suing Magpie Fibers. This agreement also binds your heirs, legal representatives, and assigns.

The cancellation policy below applies to all participants with no exceptions. All cancellation requests must be submitted in writing to retreats@magpiefibers.com.

Cancellation by Participant:

Cancellations 150 or more days before retreat start (before December 27, 2026), i.e. before your balance payment is due: your deposit back in full, less the $150 non-refundable fee.

Cancellations 70–149 days before retreat start (December 28, 2026 – March 17, 2027), i.e. after your balance has been paid: 75% of total price retained by Magpie Fibers; 25% of total price refunded, less the $150 fee.

Cancellations within 70 days of retreat start (after March 17, 2027): No refunds under any circumstances.

Refund amounts are calculated from total retreat cost paid at time of cancellation. Costs already committed to third-party suppliers (lodges, excursions, transportation) are non-refundable and factor into the above calculations. At Magpie Fibers' sole discretion, a refund may be issued if your spot is filled by another participant from a waitlist.

Cancellation — Force Majeure

We schedule our retreats when climate is expected to be most enjoyable and when extreme weather episodes are least likely. However, we cannot predict all events that may occur. Magpie Fibers assumes no liability for any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other Force Majeure condition, including without limitation: fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, flood, water or power shortages or failures, tropical storms, riots or civil disturbances, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics or warnings of any kind, government seizures, refusal or cancellation or suspension of any government authority or license, damages to facilities, or any other unforeseen circumstances that impact negatively on, or hamper, our ability to fulfill any contractual conditions. In circumstances amounting to Force Majeure, we will not be required to refund any money to you, although if we can recover any monies from our suppliers, we will refund these to you less our non-refundable planning service fee ($150).

Cancellation — Initiated by Retreat Leaders

Magpie Fibers will only cancel or postpone Antigua Immersion in the event of genuine circumstances beyond our control — such as extreme weather events, geopolitical instability, or public health emergencies. Magpie Fibers will never cancel for anything less than a true emergency, and our commitment to our guests always comes first.

In such an event, Magpie Fibers will make every effort to recover costs from our suppliers and pass those refunds to participants in full. Any costs that cannot be recovered from third-party suppliers are precisely why comprehensive travel insurance with cancel-for-any-reason (CFAR) coverage is required. Participants will also be offered the option to apply payments as credit toward a future retreat. Magpie Fibers, LLC and all retreat leaders are not responsible for additional costs accrued independently by participants — such as airfare — which is another reason travel insurance is essential.

As described above, travel insurance is mandatory for this international retreat. We encourage guests to purchase additional cancel-for-any-reason (CFAR) coverage. Travel protection can help in case your trip is cut short due to medical emergency, can provide for medical costs (including medical evacuation), and assists with missed connections and lost baggage. We are not experts, so you should ask your insurance provider any questions you may have.

 We want to ensure that all participants feel more inspired, healthy, and rejuvenated when they return home. As such, your behavior not only affects your own experience but that of other retreat members. By participating in this retreat, you agree to follow all rules and guidelines established by Magpie Fibers and our suppliers. If you are abusive of others, or your behavior disrupts the retreat, or your physical condition negatively impacts the enjoyment of other participants, you may be asked to leave. Magpie Fibers will make no refund and will accept no liability if you must leave the retreat due to your conduct.

We also value respecting others and impress upon our participants that as guests of Guatemala, each participant agrees to be respectful of people and property. Participant agrees to and shall indemnify and hold harmless Magpie Fibers, LLC, and each of our officers, directors, employees and agents, from any expenses, losses, liabilities, damages, judgments, settlements and costs involved with or incurred by Magpie Fibers with respect to any claims, lawsuits, arbitrations, or other causes of action, which result, directly or indirectly, from participant's breach or violation of this Agreement and/or any damage caused by participant while participating in the retreat.

We are excited to share your retreat experiences with others. As a participant you agree that we may publish any photographs and/or videos of the trip or participants in printed or electronic media without obtaining further consent and without compensation. You release us and our representatives from any liability in connection with any use of such photographs and/or video.

This Agreement and all attachments hereto and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of Maryland, exclusive of conflict or choice of law rules. Any claims shall be brought in a court of competent jurisdiction located in Maryland. You agree that you will only bring claims against Magpie Fibers in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding. Magpie Fibers shall not in any case be liable for other than compensatory damages, and your payment of a deposit on the retreat means that you agree to these conditions of sale and expressly waive any right to punitive damages. You understand and agree that no claims will be considered and that you will not bring suit against Magpie Fibers unless you have first provided a typewritten notice of claim to Magpie Fibers within 30 days after the retreat or cancellation of the retreat.

Travel to certain destinations may involve greater risk than others. Magpie Fibers urges participants to remain informed as to current news, as well as to review travel prohibitions, warnings, announcements, and advisories issued by the United States Government prior to booking travel to international destinations, including all rules and regulations related to health and entry requirements. Should you choose to travel to a country that has been issued a travel warning or advisory, Magpie Fibers will not be liable for damages or losses that result from travel to such destinations.

Travelers to Guatemala are required to present a valid passport. Guatemala's own rule requires passport validity for at least 6 months from your date of entry; however, many airlines apply a blanket 6-month rule at check-in measured from your return date instead. To avoid any risk of being denied boarding, we recommend ensuring your passport is valid for at least 6 months past your return date.

Entry requirements may vary depending on your nationality and travel documents. It is each participant's responsibility to verify entry requirements applicable to them through the appropriate consulate, embassy, or government travel website prior to booking.

By signing below, I certify that I am 18 years of age or older. I have read, understood, and voluntarily agree to all terms, conditions, and waivers set forth in this Agreement.
