  • 7XL RANCH — HORSE BOARDING AGREEMENT, ASSUMPTION OF RISK & LIABILITY RELEASE (ARIZONA)
  • This agreement is between 7XL Ranch (“Ranch”) and the undersigned horse owner or authorized representative (“Owner”) and applies to each horse identified in this intake. This agreement covers BOARDING ONLY. Roping membership, arena/cattle access, lessons, training, exercise, leasing, third-party riding and transport are not included unless separately authorized in a signed agreement.
  • 1. BOARDING SERVICES AND EXCLUSIONS. Ranch provides an assigned stall, hay feeding twice daily, fresh water, daily stall cleaning, reasonable visual wellness observation, and routine hoof trims through Ranch-designated farrier unless Owner elects their own farrier. Ranch may reassign stalls and reasonably adjust care timing for weather, staffing, emergencies or welfare. Visual observation is not a veterinary examination. Owner choosing their own farrier schedules and pays for all farrier care. Ranch routine trims do not include shoeing or specialty work. Not included unless agreed in writing: grain, supplements, medication administration, veterinary/dental care, training, exercise, guaranteed turnout, transport, trailer parking, special handling, lessons, cattle or arena privileges, and third-party use. Owner supplies specialty feed, supplements and medications with written instructions. Ranch may decline care it cannot safely provide.
  • 2. PAYMENT AND TERM. Board is due in advance on the first day of each calendar month and renews month-to-month. The selected Boarding Start Month and Year means the first day of that month. Autopay is arranged through a separate secure payment process; this form does not collect bank/card details. A $75 late fee applies if payment is not received by the end of the fifth day. Unpaid accounts by the fifteenth may be subject to termination and lawful collection; humane care continues while a horse remains in Ranch custody. No refund for voluntary nonuse or temporary absence. Either party may terminate with at least 30 days' written notice; Owner remains responsible for charges through the effective termination date and while horse remains onsite. Ranch may require prompt removal for serious safety, welfare, contagious disease or misconduct concerns, subject to humane arrangements. Any lien, retention, transfer or disposition for unpaid charges must follow applicable Arizona law and required judicial procedures; there is NO automatic sale or transfer after 90 days.
  • 3. OWNER DISCLOSURES AND RULES. Owner confirms ownership or legal authority and must accurately disclose dangerous behavior, illnesses, medications, allergies and special care. Owner maintains appropriate health records, tack and equipment. No unauthorized horse use by Ranch or others. No drugs/alcohol on property, animal abuse, harassment, unsafe riding or unauthorized equipment use. Supervise children; dogs require approval; secure gates and report hazards/injuries. Guests and riders need separate permission and releases.
  • 4. EMERGENCY VETERINARY AUTHORIZATION. Ranch will try Owner and emergency contacts if urgent care appears necessary. If they cannot be reached promptly, Owner authorizes Ranch to seek a licensed veterinarian and arrange reasonable emergency examination, treatment and transport for the horse. Owner pays associated costs unless law or a separate written agreement provides otherwise. Ranch need not advance funds or guarantee transportation. Owner retains major decisions when reachable. If unreachable and a licensed veterinarian determines immediate action is needed to prevent severe irreversible suffering, Ranch may follow the veterinarian's lawful emergency recommendation. Any stated spending preference is guidance, not a guaranteed cap in a life-threatening emergency.
  • 5. ASSUMPTION OF EQUINE RISK. Owner understands horses are unpredictable and boarding, handling and visiting involve risks including bites, kicks, spooking, escape, falls, collisions, illness, colic, injury, property loss and death even with reasonable care. Owner voluntarily assumes inherent risks. Ranch does not guarantee the horse's health, soundness or performance.
  • 6. RELEASE AND COVENANT NOT TO SUE. To the fullest extent allowed by Arizona law, Owner releases 7XL Ranch, its legal operating entity, owners, managers, employees, agents and volunteers (“Released Parties”) from claims arising from inherent equine risks and ordinary risks of boarding and premises use, including injury to Owner or loss/injury to the horse or personal property, and agrees not to sue for claims validly released here. This release does not waive legally nonwaivable claims or excuse gross negligence, reckless, willful, wanton or intentional misconduct, or failure to disclose a known or reasonably knowable hazardous condition where applicable law imposes liability. Arizona Revised Statutes §12-553 governs to the extent applicable; a separate signed release is required before a person takes control of a horse in activities covered by that statute. This Owner agreement does not release claims for unsigned guests or minors.
  • 7. INDEMNIFICATION AND INSURANCE. Owner agrees to defend, indemnify and hold Released Parties harmless from third-party claims and reasonable expenses to the extent arising from Owner's or authorized persons' acts or omissions, the horse's behavior, or materially inaccurate or withheld disclosures, except to the extent caused by Released Parties' legally actionable conduct. Ranch does not insure the horse, Owner's tack, trailer, vehicle or other property; Owner may obtain mortality, medical, liability and property insurance. 8. HUMAN EMERGENCIES, ACKNOWLEDGMENT AND GENERAL TERMS. Ranch may call emergency services if Owner is injured; Owner is responsible for personal medical costs. Owner confirms opportunity to read, ask questions and seek independent advice and voluntarily accepts the legal consequences of this agreement. Arizona law governs. Invalid provisions are severed to the extent lawful; material changes require written agreement. Owner signature acknowledges all boarding, payment, disclosure, emergency care, assumption-of-risk, release, covenant-not-to-sue and indemnification terms. Optional photo consent remains a separate choice and is not required for boarding.
