VOLUNTEER PARTICIPATION AND ACKNOWLEDGMENT OF RISK
In consideration of being permitted to volunteer, assist, or otherwise participate in activities, programs, events, or services organized, sponsored, or conducted by Obesity Awareness IN Action (OAA), I, the undersigned, on behalf of myself and my personal representatives, executors, administrators, heirs, next of kin, successors, and assigns (collectively referred to as the "Releasors"), hereby acknowledge, agree, and represent as follows:
1. Acknowledgment and Assumption of Risk
I understand that volunteering with OAA may involve activities that carry inherent risks, including but not limited to physical exertion, walking, standing for extended periods, lifting or carrying supplies, setting up or dismantling equipment, interacting with members of the public, exposure to outdoor weather conditions, uneven surfaces, slips, trips, falls, and other unforeseen circumstances.
I acknowledge that these activities may result in bodily injury, illness, property damage, or, in extreme circumstances, death. I voluntarily assume all risks, both known and unknown, foreseeable and unforeseeable, associated with my volunteer participation, including risks arising from the ordinary negligence of OAA, to the fullest extent permitted by law.
2. Volunteer Responsibilities and Safety
I agree to exercise reasonable care at all times while volunteering, remain aware of my surroundings, and follow all applicable safety procedures, instructions, and guidelines provided by OAA representatives, event coordinators, or designated supervisors.
I agree to immediately notify an OAA representative of any unsafe condition, injury, accident, or potential hazard that I observe or experience. If I believe any activity or condition presents an unreasonable risk to my safety or the safety of others, I agree to discontinue the activity and remove myself from the unsafe situation when appropriate.
I understand that OAA reserves the right to modify, restrict, or discontinue my volunteer activities if necessary to protect the safety and well-being of volunteers, participants, staff, or members of the public.
3. Release, Waiver, and Covenant Not to Sue
I hereby release, waive, discharge, and covenant not to sue Obesity Awareness IN Action, including its officers, directors, employees, volunteers, board members, representatives, agents, sponsors, partners, successors, and assigns (collectively referred to as "OAA"), from any and all claims, demands, causes of action, liabilities, damages, losses, or expenses arising out of or related to my volunteer participation, including claims for personal injury, illness, death, or property damage, whether occurring before, during, or after an OAA activity.
This release includes claims arising from the ordinary negligence of OAA, but does not extend to gross negligence, willful misconduct, or any other liability that cannot lawfully be waived.
4. Indemnification and Hold Harmless
I agree to indemnify, defend, and hold harmless OAA and its officers, directors, employees, volunteers, board members, representatives, agents, sponsors, and partners from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to my acts or omissions, negligent conduct, willful misconduct, or violation of applicable laws, regulations, or OAA policies while volunteering.
This provision shall apply to the fullest extent permitted by applicable law.
5. Personal Responsibility and Property
I understand that I am responsible for my personal belongings and property while volunteering. OAA shall not be responsible for loss, theft, or damage to my personal property, except to the extent caused by liability that cannot lawfully be excluded.
I accept responsibility for my own conduct and agree to act respectfully, responsibly, and in a manner consistent with OAA's mission, values, and applicable volunteer guidelines.
6. Scope and Enforceability
I understand and agree that this Release and Waiver of Liability, Assumption of Risk, and Indemnification Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Colorado, including any applicable governmental or other immunity afforded to OAA by law.
If any provision of this agreement is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect.
EMERGENCY MEDICAL CONSENT
7. Authorization for Emergency Medical Treatment
In the event I experience an injury, illness, or medical emergency while volunteering, I authorize OAA representatives to contact emergency medical services and, when necessary, facilitate transportation to a medical facility.
I authorize licensed medical professionals to provide emergency medical care or treatment deemed reasonably necessary under the circumstances when I am unable to provide consent myself.
I understand that OAA does not provide medical insurance or guarantee the availability of medical personnel at volunteer activities. I accept financial responsibility for any medical treatment, emergency transportation, or related expenses incurred on my behalf.
VOLUNTEER ACKNOWLEDGMENT AND AGREEMENT
I acknowledge that I have carefully read this Volunteer Participation, Release and Waiver of Liability, Assumption of Risk, Indemnification, and Emergency Medical Consent Agreement in its entirety.
I fully understand its terms, acknowledge that I am giving up substantial legal rights by signing it, and voluntarily agree to its provisions without any assurance or guarantee having been made to me.
I intend my signature to constitute a complete and unconditional release of liability to the fullest extent permitted by law.
