  • DRUG AWARENESS PROGRAMDrug & Alcohol Policy • Revised 01/01/06

  • Introduction

This program has been formed to provide employees of Handgards Inc. with a safe working environment free of alcohol and illegal substances. The company prohibits the use of alcohol or non-prescribed drugs at the workplace or while on company premises.

The use, sale, or possession of alcohol or non-prescribed drugs or substances while on the job or on company property will result in immediate termination of employment.

  • Policy

It is the policy of Handgards Inc. to:

    • provide a work environment which is free from the use, sale, possession, or distribution of illegal drugs, or the improper or abusive use of legal drugs or alcohol on its premises.
    • require Handgards employees to perform all job-related duties without the presence of illegal drugs, alcohol, or inappropriate legal drugs in their systems.

Handgards Inc. reserves the right to perform drug screening of an employee for, but not limited to, pre-employment, random, for cause or reasonable suspicion, follow-up, and return to work, and periodically thereafter.

Handgards Inc. also reserves the right to request random drug screening on a more frequent basis of employees whose job function is to operate heavy company owned or leased equipment or whose job function is considered hazardous or safety sensitive. Job functions that are considered high risk or safety sensitive reside in departments including but not limited to: Maintenance, Shipping, Receiving, Machine Operations, and Forklift Drivers.

This Drug Awareness Policy is a zero tolerance policy; therefore, any employee who is found to:

    • use, sell, possess, or distribute any illegal drug
    • abuse the use of legal drugs
    • consume alcohol
    • test positive for illegal substances

while performing job-related duties or while operating any company owned or leased vehicle or equipment, will be subject to immediate termination.

Company policy requires supervisors and managers to address performance problems such as time and attendance, quality, productivity, safety, etc. In the process of addressing such issues, including inappropriate behavior and unacceptable levels of performance, or if the Company develops a reasonable basis to suspect that the problem may be related to the use of illegal drugs or abuse of legal drugs or alcohol, it reserves the right to require an anti-drug test to confirm or rule out that possibility. In accordance with this policy, any employee who tests positive for illegal drugs or alcohol is subject to immediate termination of employment.

Employees exhibiting behavioral characteristics consistent with an individual under the influence of illegal drugs or alcohol will be asked to submit to immediate testing. In accordance with this policy, any employee who refuses to submit to Company-required anti-drug testing will be subject to immediate termination of employment.

  • Procedures

Pre-Employment Drug Testing. As part of the Handgards employment process and once a job offer is made, a pre-employment hair follicle screen will be administered by the company's authorized representative. A positive outcome will result in immediate withdrawal of any job offer. Applicants will be asked to read the policy and sign the Employee Consent Form (Exhibit A).

For Cause or Reasonable Suspicion and Random Testing. Hair follicle and/or urine screening will be performed by the company's representative under the following conditions:

  • NEW HIRE SAFETY ORIENTATION

    • If the employee's supervisor has reasonable cause to suspect that the employee is in violation of this policy; or
    • If the employee's job performance is deficient in a manner which suggests a possible violation of this policy; or
    • If the position is designated as a safety sensitive and/or high risk occupation; or
    • If the employee is selected at random for testing in order to monitor and ensure compliance with this policy.

Reasonable suspicion testing may result from signs of drug abuse including but not limited to: bloodshot eyes, frequent sniffing, tremors, sunglasses worn indoors, profuse perspiration, appearing confused, refusing to talk, talking too loudly, mood swings, lack of coordination, aggressive or violent behavior, frequent unreported absences, unexplained disappearances during work time, difficulty remembering tasks, lapses in concentration, and appearing physically or mentally impaired.

Return to Work. Hair follicle screening will be performed on all employees who have been out of work for any reason for 30 days or longer.

Zero Tolerance. This policy has zero tolerance for the use, sale, possession, or distribution of illegal drugs, or the improper or abusive use of legal drugs or alcohol on its premises.

Confirmation of a Positive Result. Positive results will be handled in accordance with Department of Health and Human Services regulations and as previously explained in this policy. When the employee disputes a positive result, within 5 days the employee will be offered the opportunity to speak to a medical review officer to determine probable cause for a positive test and will also have the opportunity to have a DHHS-certified laboratory repeat the test using the same sample, at the cost of the employee. If the laboratory's test reveals a positive result, Handgards will proceed with the termination of employment as previously explained in this policy.

If either the medical review officer or the laboratory proves the result is negative, the employee will be reinstated with no loss of wages; however, the cost of test confirmation will not be reimbursed.

  • INTRUDER ALARM vs. FIRE ALARMRemember: we have two types of alarms.

  • INTRUDER ALARM — BLUE LIGHT
An intruder alarm or blue light means that we have an intruder in the building.

The best approach will be to HIDE. Stay in your office, lock the door, and turn off the lights. If you have a cubicle, run to the nearest office and lock the door. Do not open the door for anyone, not even if they say that it's the police. You never know who it might be. We have master keys and will come open the door as soon as everything clears.

The second approach is RUN, HIDE, FIGHT. If for any reason you are away from your desk or office, this is the recommended approach.

Q: What does the intruder alarm consist of?
A: Any armed person who has penetrated our facility and is looking to harm people.

Q: How do I know if I should run, hide, or fight?
A: Only you can determine, based on your assessment of the situation, what is the best option for you.

  • Intruder alert strobes
  • “RUN, HIDE, FIGHT!”

  • FIRE ALARM — RED LIGHT
A fire alarm or red light means there's a fire in the building.

With this alarm you will need to evacuate the building immediately. If by any chance you are not at your desk or work area, DO NOT GO BACK TO YOUR WORK AREA. It is very important that you exit the building. Any door you find to the south of both the production building and the warehouse building will be an emergency exit.

Meeting point is by the fence next to the main gate.

We will continue to conduct more drills for both fire and intruder alerts.
