JIANFENG CHEN DBA DAO UNIVERSE & OREGON TAI CHI WUSHU (DU/OTW)
WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT
Travelers/participants are expected to conduct themselves in a professional and positive manner at all times.
All travelers/participants are responsible for knowing the Terms and Conditions of traveling with Dao Universe/Oregon Tai Chi Wushu (“DU/OTW”).
LIABILITY WAIVER / RISK ACKNOWLEDGEMENT
I understand that participation in trip activities includes inherent risks, such as physical injury, illness, death, or property loss. I, the participant, voluntarily assume all risks associated with my participation, whether known or unknown, foreseeable or unforeseeable, including risks arising from the inherent nature of travel and activities, environmental conditions, or ordinary negligence.
DU/OTW does not provide health and accident insurance for trip travelers/participants. Therefore, it is recommended that all participants secure their own travel insurance that covers medical expenses and emergency evacuation. The U.S. State Department also recommends travel insurance.
I understand that any medical expenses, property loss, or other personal expenditures that result during or from this trip are to be borne by the traveler/participant. I also hereby consent to and authorize trip leaders to secure any emergency medical treatment in the event that I am unable to do so, and I release them from liability related to obtaining such treatment. I agree to be responsible for all associated costs.
I acknowledge that DU/OTW makes no representations regarding the adequacy, availability, or quality of medical care, equipment, or supplies. In the event of injury or illness, I authorize DU/OTW, at my expense, to arrange or obtain medical treatment, evacuation, or other services deemed reasonably necessary for my safety and well-being.
It is the responsibility of the traveler to manage and monitor their own food intake if they have any food allergies.
I further acknowledge that if I drive my own vehicle, including a motorbike, or am a passenger in another person’s private vehicle in connection with this trip, DU/OTW cannot be responsible for assuring the safety or reliability of such private transportation or driver. DU/OTW is also not responsible for any non-sponsored activities or travel that I may choose to participate in before, during, or after the trip. I therefore accept the risks and responsibilities associated with such private vehicle travel and activities.
In consideration for participating in the trip, YOU, THE TRAVELER/PARTICIPANT, VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR AND HEREBY RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS, AND COVENANT NOT TO SUE DU/OTW, ITS OFFICERS, MEMBERS, AGENTS, CONTRACTORS, EMPLOYEES, VOLUNTEERS, GUIDES, AND OTHER REPRESENTATIVES (each a “Company Party” and collectively, the “Company Parties”) FOR ANY AND ALL CLAIMS, DEMANDS, ACTIONS, CAUSES OF ACTION, AND/OR LOSSES, including but not limited to exemplary, direct, indirect, incidental, special, consequential, punitive, or other damages; medical expenses; lost wages or income; loss of services; lost profits; property damage; pain; illness; and death (collectively, “Liabilities”).
You have been advised to obtain travel insurance to cover Liabilities resulting from trip cancellation or interruption, weather, natural disaster, strike, illness, employment-related reasons, accident, sickness, evacuation, pre-existing medical conditions, baggage delay, loss, theft, and other Liabilities associated with travel and participation in the trip.
There are no refunds if the trip, or any part of the trip, is cancelled. Invoice amounts and other agreed-upon amounts remain due in accordance with the terms presented at checkout/registration and/or on the invoice for the selected Package/Trip.
While on a DU/OTW trip, you may have the opportunity to engage in a number of activities that may include, but are not limited to
- Bus, airplane, and train travel
- Hikes
- Walking tours and night markets
- Martial arts and Tai Chi practice
- Historical tours
- Group meals featuring local foods
- Art and tea demonstrations
The traveler(s) irrevocably authorize DU/OTW, its successors and assigns, and those acting under its authority, to copy, use, and publish photographic portraits, images, pictures, or video recordings of me, or of the student for whom I am signing, in which I may appear in whole or in part, for art, advertising, promotional, trade, or any other lawful purpose.
YOU ACKNOWLEDGE THAT YOU ARE AWARE OF THE POTENTIAL DANGERS AND RISKS ASSOCIATED WITH PARTICIPATING IN THE TRIP. YOU FURTHER ACKNOWLEDGE THAT THIS AGREEMENT CONSTITUTES A CONSENT, RELEASE OF LIABILITY, AND WAIVER OF CERTAIN LEGAL RIGHTS TO COLLECT DAMAGES IN THE EVENT OF INJURY, DEATH, PROPERTY DAMAGE, OR OTHER LIABILITY, AND THAT IT CREATES A CONTRACT BETWEEN YOU AND DU/OTW.
BY MAKING PAYMENT AND PARTICIPATING IN THE TRIP, YOU EXPRESSLY ASSUME ALL RISKS OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE, AND OTHER LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW, AND AGREE TO RELEASE DU/OTW AND ALL COMPANY PARTIES FROM LIABILITY FOR SUCH INJURY, DAMAGE, DEATH, OR OTHER LIABILITIES.
In consideration of the opportunity afforded to participate, and with full knowledge and acceptance of the risks associated with this trip and any recreational activities included within it, I acknowledge that I understand the conditions and risks described above. I hereby release, indemnify, and hold harmless DU/OTW and its staff members and volunteers from all risks inherent in participation and from all claims, suits, demands, or causes of action arising from participation in the itinerary, trip, or related activities, to the fullest extent permitted by law.
I confirm that I am legally competent to enter into this Agreement, that I have carefully read and fully understand its contents, and that I enter into this Agreement voluntarily and without reliance on any oral representations outside of this Agreement.
BY SIGNING THIS AGREEMENT, I UNDERSTAND THAT I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO MAKE CERTAIN CLAIMS FOR INJURY OR DAMAGES.
