Notice to Halt the Interference of Property Rights and to
Uphold the Constitutional Due Process of Law
Notice to Principal is Notice to Agent and Notice to Agent is Notice to Principal
I, __________________________, one of the People as seen in the 51 Constitutions, (Republican in Form), Sui Juris, do send you this Notice that you provide immediate due care to those with all political power, the People. (See evidence below)
Please take notice that private property rights are protected by the Minnesota Constitution (the law of the land) and Common Law, not statutory law, by which People in the private are governed. In order for someone to come against any Constitutionally-secured rights of the People, including property rights, there must be due process of law initiated by sworn facts in an affidavit stating that private rights are being infringed, or an injury has taken place, by another of the People in the private. People in the public, specifically elected, appointed, or hired government officials cannot be the initiator of said injury to private rights as it is the role of the government to protect the private rights of the People. The Constitutions are public trusts, and the government officials are the trustees bound to them by oath to uphold at all times. (See evidence below)
Black’s Law (4th Ed.) definition of Property is: “That which is peculiar or proper to any person; that which belongs exclusively to one; in the strict legal sense, an aggregate of rights which are guaranteed and protected by the government… More specifically, ownership; the unrestricted and exclusive right to a thing; the right to dispose of a thing in every legal way, to possess it, to use it, and to exclude every one else from interfering with it…”
Minnesota Constitution, Art. 1, Sec. 1: “Purpose of Government. Government is instituted for the security, benefit and protection of the people, in whom all political power is inherent, together with the right to alter, modify or reform government whenever required by the public good.”
Minnesota Constitution, Article 1, Section 2: “No member of this state shall be disfranchised or deprived of any of the rights or privileges secured to any citizen thereof, unless by the law of the land or the judgment of his peers.”
Black’s Law Dictionary (4th Ed.) law of the land is, “due process of law. By the law of the land is most clearly intended the general law which hears before it condemns, which proceeds upon inquiry, and renders judgement only after trial…Everything that may pass under the form of an enactment or statute is not the law of the land.”
Black’s Law (4th Ed.) Due Process of Law is, “…Due process of law in each particular case means such an exercise of the powers of the government as the settled maxims of law permit and sanction, and under such safeguards for the protection of individual rights as those maxims prescribe for the class of cases to which the one in question belongs…”
Maxim of Law: “An action is not given to one who is not injured.” Jenk. Cent. 69. (Highlighted for emphasis)
Black’s Law (4th Ed.) Common Law is: “…As distinguished from law created by the enactment of legislatures, the common law comprises the body of those principles and rules of action, relating to the government and security of persons and property…”
Please take notice that all lands in Minnesota are allodial and are free from having statutory conditions and public fees pertain to them as they exist as private property rights with sole private ownership of the land. Having any statutory procedures, ordinances and zoning requirements on the People’s private land is assessing a feudal tenure of the property by acting as a superior over the land ownership. This makes any public legislative requirements, statutes, regulations, or rules on private ownership of land repugnant to the Minnesota Constitution Article 1, Section 15 and thus making them null and void. See evidence below
Minnesota Constitution Article 1, Section 15
“All lands within the state are allodial and feudal tenures of every description with all their incidents are prohibited…”
Maxim of Law: “Allodial land is that possessed by a man in his own right, free and absolute, without owing any rent or service to any superior.” Barker v. Dayton, 28 Wis. 367, 377; 2B1. Comm. 104; 3 Kent, Comm. 495. (Highlighted for emphasis)
Black’s Law (4th Ed.) Constitutional Right is: “A right guaranteed to the citizens by the Constitution and so guaranteed as to prevent legislative interference therewith.”
Please take notice that “where rights secured by the Constitution are involved, there can be no rule making or legislation which would abrogate them.” (U.S. Supreme Court in Miranda v. Arizona 384 U.S. 436 (1966))
Maxim of Law:” Where the law prescribes a form, the nonobservance of it is fatal to the proceeding, and the whole becomes a nullity.” Best, Ev. Introd. s. 59.
Please take Final Notice that it is my demand and wish that you, as a government agent and trustee of the United States and Minnesota Constitutions, do cease immediately all public interference and unlawful actions against one of the People [73-CV-26-451]. If you believe I am wrong in the law, or that you have the constitutional authority to apply statutory obligations to the Peoples’ property in the private, as well as the authority to not follow the constitutional due process of law that is afforded to the People, and that you are also not obligated to the duty of securing the rights of the People, you may submit
(a) A sworn affidavit submitted under penalty of perjury and submitted this publicly so the People can view
(b) The constitutional provision(s) showing your granted powers to inhibit the free exercise of the People’s God-given rights through constitutional due process thus protecting private property ownership and their use of that property.
Or, by tacit acquiescence, you understand and agree with all claims herein, and that this notice shall stand against you as evidence and truth and fact and law in all courts of record and that no court may rehear this matter, and that you do make a conscious effort of inhibiting the free exercise of rights set forth in the Minnesota Constitution with full knowledge, malice, and intent to breach the trust of the Constitution and to use government power to suppress these rights. All responses not submitted under penalty of perjury are considered non-responses and shall stand as consent to all claims herein.
This notice is sent to you in the love and peace of Christ that justice may be had with current and past transgressions so that there is a restoration and amends to those that were not being secured by the trustees of the Constitutions with the People’s God given rights.
