HIGHKEY RUN CLUB

PARTICIPANT WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK

PLEASE READ CAREFULLY BEFORE SIGNING.

In consideration for being permitted to participate in activities, runs, walks, workouts, social gatherings, special events, and other activities organized, hosted, promoted, or coordinated by HighKey Run Club (“HKRC”), I voluntarily agree to the terms of this waiver.

1. CONTINUING WAIVER
I understand and agree that this Waiver, Release of Liability, and Assumption of Risk applies to my current participation and all future participation in HighKey Run Club activities and events, unless and until HighKey Run Club requires me to execute a new or updated waiver.

I understand that I am not required to sign a new copy of this waiver before each individual HighKey Run Club event unless requested by HighKey Run Club.

2. ASSUMPTION OF RISK
I understand that participating in running, walking, fitness activities, group workouts, social activities, and related events involves inherent and other risks, including but not limited to:

• Falls, slips, trips, and collisions;

• Uneven pavement, sidewalks, roads, trails, curbs, potholes, or other surfaces;

• Vehicle, bicycle, pedestrian, and other traffic;

• Weather conditions, including heat, humidity, rain, storms, and lightning;

• Dehydration, exhaustion, overexertion, muscle strains, sprains, fractures, illness, or other injuries;

• Contact or interactions with other participants, members of the public, animals, equipment, property, or other hazards;

• Risks associated with participating at restaurants, bars, businesses, parks, parking lots, public roads, private property, and other event locations.

I voluntarily choose to participate and knowingly assume the risks associated with my participation, whether known or reasonably foreseeable.

3. PERSONAL RESPONSIBILITY
I am responsible for determining whether I am physically capable of participating in any HighKey Run Club activity.

I agree to participate within my own abilities and understand that HighKey Run Club does not provide medical advice, medical supervision, or individualized fitness instruction.

I am responsible for seeking appropriate medical advice before participating if I have any concerns regarding my health or ability to participate safely.

4. RELEASE AND WAIVER OF LIABILITY
To the fullest extent permitted by Florida law, I release and hold harmless HighKey Run Club, its owner(s), organizers, employees, volunteers, representatives, agents, event staff, sponsors, vendors, collaborating businesses, and participating/host venues from claims arising from injuries, losses, or damages associated with my voluntary participation in HighKey Run Club activities, including claims arising from ordinary negligence, except to the extent such a release is prohibited by applicable law.

I understand that this release does not waive rights or claims that cannot legally be waived under Florida law.

5. PARTNER VENUES, SPONSORS & THIRD PARTIES
I understand that HighKey Run Club events may take place at or in collaboration with restaurants, bars, fitness facilities, businesses, sponsors, vendors, municipalities, property owners, or other third parties.

I understand that these entities may have their own rules, requirements, or waivers, and I agree to comply with applicable requirements while participating.

6. ROUTES & TRAFFIC
I understand that HighKey Run Club routes may use public sidewalks, roads, crossings, parking lots, trails, or other areas that remain open to vehicles and members of the public.

I understand that roads are not necessarily closed to traffic and that participation in a HighKey Run Club event does not give me the right of way.

I agree to obey traffic laws, pedestrian signals, posted signs, property rules, and reasonable safety instructions.

7. ALCOHOL
I understand that certain HighKey Run Club events may take place at establishments that serve alcoholic beverages.

Any decision to purchase or consume alcohol is voluntary and is my personal responsibility. I agree not to participate in physical activities while impaired and understand that HighKey Run Club does not assume responsibility for my alcohol consumption or transportation decisions.

8. EMERGENCY MEDICAL CARE
If I become injured or ill during an event and am unable to make decisions for myself, I authorize reasonable emergency assistance to be requested on my behalf.

I understand that HighKey Run Club does not guarantee the availability of medical personnel and that I remain responsible for medical expenses incurred as a result of my participation.

9. PHOTO & VIDEO RELEASE
I understand that photographs and videos may be taken during HighKey Run Club events.

I grant HighKey Run Club permission to photograph, record, reproduce, publish, and use images or recordings in which I may appear for legitimate promotional, social media, marketing, and community purposes without compensation.

 10. CONTINUING EFFECT
I understand that this agreement is intended to remain effective for all future HighKey Run Club events and activities in which I participate unless:

• HighKey Run Club provides me with a replacement or updated waiver;

• HighKey Run Club informs me that a new signature is required; or

• Applicable law requires a new agreement.

I understand that choosing to participate in future HighKey Run Club activities does not require HighKey Run Club to provide me with a new copy of this waiver before every event.

11. ACKNOWLEDGMENT
I acknowledge that:

• I have read this entire agreement;

• I understand its terms;

• I understand that I am giving up certain legal rights by signing it;

• I am signing voluntarily;

• I have had the opportunity to ask questions before signing; and

• I intend my signature to apply to my current and future participation as described above.

12. IDENTITY & ACCURACY CERTIFICATION
I certify that I am at least 18 years of age and that all information I provide on this form is true, accurate, complete, and belongs to me.

I understand that I may not complete, sign, or submit this waiver using another person’s name, identity, or information, or falsely represent myself as another person.

I understand that intentionally providing false or misleading information, misrepresenting my identity, or submitting this waiver on behalf of another person without authorization may affect the validity or effectiveness of this waiver and may result in my being denied participation in HighKey Run Club activities.

HIGHKEY RUN CLUB

MINOR PARTICIPANT + PARENT/LEGAL GUARDIAN WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK

PLEASE READ CAREFULLY BEFORE SIGNING.

I am the parent or legal guardian of the minor participant identified on this form. I give permission for the minor participant to participate in activities, runs, walks, workouts, social gatherings, special events, and other activities organized, hosted, promoted, or coordinated by HighKey Run Club (“HKRC”).

I knowingly and voluntarily permit the minor participant to participate and assume the risks associated with their participation, whether known or reasonably foreseeable.

2. PARENT/GUARDIAN RESPONSIBILITY
I am responsible for determining whether the minor participant is physically capable of participating safely.

I understand that HighKey Run Club does not provide medical advice, medical supervision, childcare, or individualized fitness instruction.

I understand that my permission for the minor to participate does not make HighKey Run Club responsible for supervising the minor. I remain responsible for ensuring appropriate supervision of the minor before, during, and after HighKey Run Club activities.

3. RELEASE AND WAIVER OF LIABILITY
To the fullest extent permitted by Florida law, on behalf of myself and the minor participant, I release and hold harmless HighKey Run Club, its owner(s), organizers, employees, volunteers, representatives, agents, event staff, sponsors, vendors, collaborating businesses, and participating/host venues from claims arising from the minor participant’s voluntary participation in HighKey Run Club activities, including claims arising from ordinary negligence, except to the extent such a release is prohibited by applicable law.

I understand that this release does not waive rights or claims that cannot legally be waived under Florida law.

I understand that HighKey Run Club does not guarantee the availability of medical personnel and that I remain responsible for medical expenses incurred as a result of the minor participant’s participation.

I certify that I am the parent or legal guardian of the minor participant identified on this form and that I have legal authority to provide consent on the minor participant’s behalf.

I acknowledge that I have read and understand this agreement, understand that it affects legal rights, and voluntarily consent to the minor participant’s participation subject to these terms.
