Risk Warning and Liability Waiver
The Harbour Shot is a recreational activity involving obvious and inherent risks. These include being struck by a golf club or ball, slips, trips and falls, contact with water or watercraft, falling into water, physical strain or injury, and exposure to sun, heat and weather. These risks may result in serious personal injury or death.
By purchasing a ticket or participating, you acknowledge these risks and participate at your own risk.
To the maximum extent permitted by law, including section 5N of the Civil Liability Act 2002 (NSW) and section 139A of the Competition and Consumer Act 2010 (Cth), Waterfront Golf Ventures Pty Ltd trading as The Harbour Shot, Place Management NSW trading as Placemaking NSW, the State of New South Wales, and their respective officers, employees, contractors, agents and volunteers exclude liability for death, physical or mental injury, disease or another harmful condition arising from the recreational services, including where caused by negligence. You release those parties from claims for such harm to the same extent.
This exclusion and release do not apply to liability that cannot lawfully be excluded, including liability for significant personal injury caused by reckless conduct, fraud or deliberate misconduct.
