  • Sorry, we can't rent this trailer to you yet

  • Thanks for checking! Based on your answers, your vehicle or hitch isn't set up to safely tow this trailer, so we can't rent it to you right now. Common fixes: a brake controller, a 7-pin plug, a 2-5/16" ball, or a heavier-rated hitch. If something was entered wrong, go back and fix it, or call or text 360-261-4207. No payment has been taken.

  • Trailer Rental Agreement

  • COWLITZ RENTALS LLC

    TRAILER RENTAL AGREEMENT, ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND INDEMNITY AGREEMENT

    Owner: Cowlitz Rentals LLC, a Washington limited liability company, UBI 606 311 205 ("Owner," "we," "us")
    200 Coyote Ln, Castle Rock, WA 98611 · Phone/Text: 360-261-4207 · Email: Colt_sambrano@aol.com

    Renter: The person identified in Schedule A who signs this Agreement ("Renter," "you"). If you rent for a business, you sign both for yourself and for that business, and both are jointly and severally responsible.

    "Owner Parties" means Owner and its members, managers, employees, agents, successors, and assigns.

    PLEASE READ THIS ENTIRE AGREEMENT CAREFULLY. IT CONTAINS AN ASSUMPTION OF RISK, A RELEASE OF LIABILITY, AND AN INDEMNITY THAT AFFECT YOUR LEGAL RIGHTS (SECTIONS 21–24).

    1. Equipment

    Owner rents to Renter the following trailer and accessories (together, the "Trailer"):

    • 7 ft × 14 ft bumper-pull hydraulic dump trailer, GVWR 14,000 lb
    • Make/model/year, VIN, Washington plate, empty (curb) weight, and maximum payload (14,000 lb GVWR minus empty weight; never exceed) as listed in Schedule A
    • Coupler: 2-5/16 in. ball coupler · Electrical: 7-way RV blade connector · Brakes: electric brakes on both axles with breakaway switch and battery
    • Hydraulic pump, battery, and dump remote, plus any tarp, ramps, spare tire, coupler lock, or other accessories checked in Schedule A
    • The Trailer may be equipped with a GPS tracking device (see Section 18)

    2. Rental Period

    The rental period starts at the pickup date and time and ends at the return date and time shown in Schedule A (standard rental: 24 hours). The rental period ends only when the Trailer is returned to the Return Location, locked, and the return photos in Section 10 are submitted. The rental fee is $99 per 24-hour period, plus applicable sales tax. Extensions are allowed only if Owner approves in writing (text or email is enough) and are charged at $99 per additional 24-hour period.

    3. Renter Eligibility and Verification

    Renter must, and represents that Renter does:

    1. Be at least 25 years old;
    2. Hold a valid, unrestricted (other than corrective lenses) driver's license, and upload a clear photo of the front of the license before pickup;
    3. Carry current automobile liability insurance on the tow vehicle and upload proof (insurance card or declarations page) before pickup;
    4. Not be under the influence of alcohol, cannabis, or any drug that impairs driving at any time while towing or operating the Trailer; and
    5. Provide true and complete information. Giving false information is a material breach.

    Only Renter and the Authorized Drivers listed in Schedule A may tow or operate the Trailer. Each Authorized Driver must meet these same requirements. Owner may refuse or cancel any rental, at any time before pickup, for any lawful reason (with a full refund of amounts paid for that rental).

    4. Tow Vehicle Requirements

    Renter must use a tow vehicle and hitch that meet all of the following. Renter is solely responsible for confirming these ratings from the vehicle's owner's manual, door-jamb sticker, and hitch labels:

    1. The tow vehicle's rated towing capacity is equal to or greater than the estimated loaded trailer weight Renter reported on the Tow-Vehicle Questionnaire and the actual loaded weight of the Trailer (never more than 14,000 lb), and the combined weight of the tow vehicle, passengers, cargo, and loaded Trailer does not exceed the tow vehicle's GCWR;
    2. The receiver hitch, ball mount, and pin are rated for the loaded Trailer weight and tongue weight (tongue weight on a loaded 14,000 lb trailer can be roughly 10–15% of trailer weight — about 1,400–2,100 lb);
    3. A 2-5/16 in. hitch ball rated at or above the loaded Trailer weight, tightened to spec;
    4. A working 7-way RV blade connector and a properly installed, working electric brake controller, adjusted for the loaded weight before driving;
    5. Working tail, brake, turn, and marker lights through the connector;
    6. Tow mirrors or mirrors that give a clear view behind the Trailer, as required by law; and
    7. The tow vehicle is currently registered and insured.

    Half-ton (1500/150-series) pickups are allowed only if both the truck's rated towing capacity and the hitch's rating equal or exceed the estimated loaded trailer weight. With any tow vehicle, Renter must load the Trailer so the actual loaded weight never exceeds the lowest of: the tow vehicle's towing capacity, the hitch/ball mount/ball rating, the tow vehicle's GCWR, or the Trailer's 14,000 lb GVWR. Renter must not exceed any of these ratings.

    Renter's answers to Owner's Tow-Vehicle Questionnaire are part of this Agreement, and Renter represents they are true. Owner may refuse to release the Trailer if Owner reasonably believes the tow vehicle or hitch is not adequate, but Owner has no duty to inspect Renter's vehicle, and any check by Owner does not shift responsibility to Owner.

    5. Licensing, Commercial Use, and Legal Compliance

    There is no mileage limit and no geographic limit on where Renter may tow the Trailer. Renter must comply with the laws of every state, province, and locality the Trailer travels in or through, and is responsible for complying with all laws that apply to Renter's use, including licensing, registration, weight limits, load securement, and any commercial-vehicle rules. If Renter uses the Trailer for business purposes, the combination of tow vehicle and loaded Trailer may require a Class A commercial driver's license (CDL) and/or a USDOT number (for example, WA DOL requires a Class A CDL for combinations with a gross combination weight rating of 26,001 lb or more when the towed unit is rated over 10,000 lb). Renter must determine whether these rules apply and must obtain any required license or number before towing.

    6. Hitching and Pre-Trip Check (Renter's Responsibility)

    Because pickup is contactless, Renter is solely responsible for hitching, connecting, and checking the Trailer before each trip, including:

    1. Coupler fully seated on the ball, latch closed, and safety pin or lock installed;
    2. Two safety chains crossed under the coupler and attached to the tow vehicle's frame/hitch (not to the hitch ball or the removable ball mount), with enough slack to turn but not drag;
    3. Breakaway cable attached to the tow vehicle (not to the safety chains), and breakaway battery charged;
    4. 7-way plug connected; lights and turn signals tested; electric brakes tested with the brake controller before entering traffic;
    5. Tongue jack fully raised; dump bed fully lowered and secured; tailgate/rear doors closed and latched;
    6. Tires visually inspected for proper inflation and damage; lug nuts visually checked; and
    7. Load secured and covered as required (Section 7).

    If anything is damaged, missing, or not working, do not tow the Trailer — contact Owner immediately (Section 17).

    7. Loading and Safe Operation

    Renter agrees to:

    1. Never exceed the maximum payload or the GVWR (14,000 lb total), the tow vehicle's ratings, or any axle, tire, or road weight limit. Note that dense materials (wet soil, gravel, rock, concrete, roofing) can exceed the payload long before the bed is full.
    2. Load evenly, with roughly 60% of the load in front of the axles, so tongue weight stays within the hitch and vehicle ratings.
    3. Secure and cover every load so nothing can fall, blow, leak, or shift. Dirt, sand, and gravel must be covered unless the load has at least six inches of clearance below the top of the sides, as required by RCW 46.61.655. Renter pays all citations and costs from unsecured loads.
    4. Obey all traffic laws and never exceed 60 mph (the Washington maximum for vehicles towing a trailer) or the posted limit, whichever is lower; slow down for weather, curves, and grades.
    5. Never carry people or animals in or on the Trailer.
    6. Dump only on firm, level ground; check for overhead power lines, trees, and structures before raising the bed; keep all people clear of the bed, tailgate, and hinge area while raising, lowering, or dumping; never stand, reach, or work under a raised bed unless it is fully supported by its safety prop; never move the Trailer with the bed raised; never use the bed as a lift or jack.
    7. Not tow off paved or firm gravel surfaces, into mud, sand, or water, or on any surface where the Trailer could get stuck or tip.
    8. Keep the Trailer locked and secured when unattended.
    9. Not use the Trailer for any illegal purpose, for racing or stunts, to tow any other vehicle, or while any driver is impaired.

    8. Prohibited Materials

    Renter shall not load, carry, or dump any of the following: hazardous materials or hazardous waste of any kind; asbestos or asbestos-containing material; lead-paint abatement debris; fuels, oils, solvents, paints, chemicals, pesticides, or their containers (unless empty and dry, where legal); batteries; propane or compressed-gas tanks; explosives or fireworks; medical, biological, or sharps waste; dead animals or animal waste in bulk; radioactive material; hot ashes or any burning material; liquids or wet concrete; any material that is illegal to transport or dump; or appliances that still contain refrigerant. Tires and mattresses may be hauled, but Renter must dispose of them properly and pay any disposal surcharges. Renter is responsible for all cleanup, testing, decontamination, disposal, fines, and damage resulting from prohibited materials, at actual cost (Schedule B).

    9. Condition, Inspection, and Photos

    Before towing away, Renter will inspect the Trailer and submit time-stamped photos of all four sides, the bed, the tailgate, the coupler, the safety chains, all tires, and the lights through the link Owner provides. Renter accepts the Trailer in good, safe working condition except for damage shown in Renter's pickup photos or reported to Owner before towing. If Renter does not submit pickup photos, the Trailer is presumed to have been delivered in good condition with no damage.

    10. Contactless Pickup and Return

    1. After Owner approves the booking, the rental fee is paid, and the deposit hold is in place, Owner will send the lockbox/lock code and pickup instructions. The code is valid only for this rental. Renter must not share it with anyone other than an Authorized Driver.
    2. Renter must return the Trailer by the return time in Schedule A to the Return Location, parked where instructed, unhitched, bed fully down, tailgate latched, tongue jack down, plug stowed, empty, broom-clean, and with the coupler lock and any lockbox reattached and locked.
    3. At return, Renter must submit time-stamped return photos of the same items listed in Section 9, plus a photo of the locked coupler.
    4. Owner will inspect the Trailer within 24 hours after return and will notify Renter of any damage, cleaning, or other charges with photos.

    11. Rental Charges and Fees

    Renter agrees to pay the charges in Schedule B, including: rental fee and applicable sales tax; late return fees; cleaning fee; dump/landfill/disposal fees (Renter pays all dump fees directly); decontamination fee; lost or damaged accessories, lock, or remote; towing, recovery, storage, or impound costs; all tolls, parking tickets, traffic citations, camera tickets, and unsecured-load citations incurred during the rental, plus an administrative fee per citation; and reasonable collection costs.

    12. Security Deposit

    Before pickup, Owner will place a $250 authorization hold on Renter's payment card. This is a hold, not a charge. Owner will capture all or part of the hold only for charges documented under this Agreement (for example, with return photos, receipts, or citations), and will send Renter an itemized list with photos of anything captured. Owner will inspect the Trailer within 24 hours after return and will release the hold (or any uncaptured remainder) promptly after the inspection, no later than 24 hours after the inspection is complete. Card issuers control how long a released hold takes to disappear from Renter's account. If a hold expires before the rental ends or the inspection is complete, Renter authorizes Owner to place a new hold of up to $250 on the same card. The deposit hold is not a limit on Renter's responsibility. If documented charges exceed $250, Renter pays the full amount, including the full cost of repair or replacement for damage.

    13. Payment Authorization

    Renter authorizes Owner to charge the payment card Renter provides (or used to pay) for all amounts due under this Agreement, including the rental fee, deposit, and any charges in Sections 11, 12, and 14, after Owner sends Renter an itemized statement. Amounts not covered by the hold are due within 30 days of the statement. Renter may dispute a charge by contacting Owner within 14 days of the statement.

    14. Damage, Loss, and Theft

    1. From pickup until return, Renter is responsible for all loss of, theft of, and damage to the Trailer, whatever the cause, except normal wear and tear and damage documented in Renter's pickup photos or caused by a mechanical defect Renter did not cause.
    2. Renter will pay (a) the reasonable cost of repair, or, if the Trailer is stolen or not economically repairable, its replacement value shown in Schedule A; (b) loss of use at $99 per day for each day the Trailer is out of service for repair, up to 30 days; and (c) reasonable towing, storage, and appraisal costs.
    3. If the Trailer is stolen or vandalized, Renter must file a police report within 24 hours and send Owner a copy.
    4. If the Trailer is not returned within 24 hours after the return time and Renter has not contacted Owner, Owner may treat the Trailer as stolen, report it to law enforcement, and recover it using GPS location data, all at Renter's expense.
    5. Any insurance Owner carries is for Owner's benefit only and does not cover Renter.

    15. Insurance — Renter's Insurance Is Primary

    1. Renter must keep automobile liability insurance on the tow vehicle in at least the amount required by Washington law (and by the law of any state where the Trailer is towed) for the entire rental.
    2. Renter's insurance is primary for any injury, death, or property damage arising from the towing, loading, unloading, operation, or use of the Trailer during the rental. Any insurance Owner has is excess and non-contributing, to the extent the law allows.
    3. Renter understands that many personal auto policies do not pay for damage to a rented trailer. Renter is responsible for confirming with Renter's own insurer what is covered. Lack of insurance does not reduce Renter's obligations under this Agreement.

    16. Accidents and Incidents

    If there is an accident, injury, theft, fire, rollover, sway incident, load spill, or damage involving the Trailer, Renter must: (1) call 911 if anyone is injured or if the road is blocked; (2) make the scene safe; (3) notify Owner by phone or text at 360-261-4207 within one hour (or as soon as safely possible); (4) obtain a police report where required; (5) take photos and collect the names, contact, and insurance information of everyone involved and any witnesses; (6) not admit fault on Owner's behalf; and (7) cooperate with Owner and Owner's insurer.

    17. Breakdowns and Defects

    If any brake, light, tire, wheel, coupler, chain, breakaway, hydraulic, or structural problem appears, Renter must stop towing as soon as it is safe and contact Owner. Renter may not repair or modify the Trailer without Owner's approval, except emergency steps needed for safety. Owner will reimburse pre-approved repairs with receipts. Owner's only responsibility for a defect not caused by Renter is to repair or replace the Trailer when practical or to refund the rental fee for unused time; Owner is not liable for lost time, lost profits, labor, delays, or any other indirect or consequential damages.

    18. GPS Tracking Disclosure and Consent

    The Trailer may be equipped with a GPS tracking device. Renter consents to Owner collecting and using the Trailer's location data to locate and recover the Trailer, verify return times, investigate incidents and charges, and protect Owner's property. The device is not monitored for emergencies. Renter must not remove, disable, cover, or tamper with any tracking device; doing so is a material breach and Renter will pay its replacement cost.

    19. No Subrenting or Transfer

    Renter may not sublease, lend, re-rent, sell, pledge, or otherwise transfer the Trailer or this Agreement, or let anyone other than an Authorized Driver tow or operate it.

    20. Booking Requests, Cancellations, and No-Shows

    1. Bookings are requests until Owner approves them in writing and Renter has completed the verification form, signed this Agreement, and paid. Owner may decline any request; declined requests are refunded in full.
    2. Renter cancellation 24 hours or more before the pickup time: full refund, and any deposit hold is released.
    3. Renter cancellation less than 24 hours before the pickup time, or a no-show: a $25 cancellation fee; the rest of the rental fee is refunded and any remaining hold is released. Owner may collect the fee from the rental payment, the deposit hold, or the card on file.
    4. If Owner cancels for any reason (including the Trailer being unavailable or unsafe), Renter receives a full refund, which is Renter's only remedy.
    5. Weather: if Owner determines conditions are unsafe for towing, either party may reschedule without penalty.

    21. ASSUMPTION OF RISK

    RENTER UNDERSTANDS THAT TOWING, LOADING, UNLOADING, AND OPERATING A 14,000 LB HYDRAULIC DUMP TRAILER IS INHERENTLY DANGEROUS AND CAN CAUSE SERIOUS INJURY, DEATH, AND PROPERTY DAMAGE. Risks include, without limitation: trailer sway, jackknifing, rollover, and loss of control; hitch, coupler, chain, or breakaway failure; brake, tire, wheel, bearing, or light failure; overloading and shifting loads; crushing and pinch points at the bed, hinge, tailgate, coupler, and jack; contact with overhead power lines while dumping; falling or flying debris; hydraulic failure or unexpected bed movement; road, traffic, and weather conditions; and the acts of other drivers. RENTER KNOWINGLY AND VOLUNTARILY ASSUMES ALL OF THESE RISKS, BOTH KNOWN AND UNKNOWN, INCLUDING RISKS ARISING FROM THE ORDINARY NEGLIGENCE OF THE OWNER PARTIES, for Renter, Renter's Authorized Drivers, passengers, helpers, and anyone Renter allows near the Trailer.

    (Renter initials required in the form field below.)

    22. RELEASE AND WAIVER OF LIABILITY

    TO THE FULLEST EXTENT PERMITTED BY WASHINGTON LAW, RENTER, FOR RENTER AND RENTER'S HEIRS, PERSONAL REPRESENTATIVES, AND ASSIGNS, RELEASES, WAIVES, AND AGREES NOT TO SUE THE OWNER PARTIES FOR ANY AND ALL CLAIMS, DEMANDS, LOSSES, AND LIABILITIES FOR BODILY INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE ARISING OUT OF OR RELATED TO THE RENTAL, TOWING, LOADING, UNLOADING, DUMPING, OR USE OF THE TRAILER, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE OWNER PARTIES. This release does not apply to claims arising from the Owner Parties' gross negligence or willful or wanton misconduct, or to any other claim that cannot be released under Washington law.

    (Renter initials required in the form field below.)

    23. INDEMNIFICATION AND HOLD HARMLESS

    RENTER WILL DEFEND, INDEMNIFY, AND HOLD HARMLESS THE OWNER PARTIES FROM AND AGAINST ALL CLAIMS, LAWSUITS, DAMAGES, LOSSES, FINES, PENALTIES, JUDGMENTS, SETTLEMENTS, COSTS, AND REASONABLE ATTORNEYS' FEES, MADE OR BROUGHT BY ANY PERSON (INCLUDING RENTER'S AUTHORIZED DRIVERS, PASSENGERS, HELPERS, EMPLOYEES, CUSTOMERS, AND ANY THIRD PARTY), ARISING OUT OF OR RELATED TO THE POSSESSION, TOWING, LOADING, UNLOADING, DUMPING, OR USE OF THE TRAILER DURING THE RENTAL PERIOD OR RENTER'S BREACH OF THIS AGREEMENT, INCLUDING CLAIMS ALLEGING THE ORDINARY NEGLIGENCE OF THE OWNER PARTIES, except to the extent caused by the Owner Parties' gross negligence or willful misconduct. Owner may choose its own counsel at Renter's expense if Renter fails to defend promptly.

    (Renter initials required in the form field below.)

    24. Disclaimer of Warranties; Limitation of Liability

    EXCEPT AS EXPRESSLY STATED IN THIS AGREEMENT, THE TRAILER IS RENTED "AS IS," AND OWNER MAKES NO WARRANTY, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Owner will make reasonable efforts to maintain the Trailer in safe working condition. To the fullest extent permitted by law, the Owner Parties' total liability for any claim related to this Agreement will not exceed the rental fees Renter paid for this rental, and the Owner Parties are not liable for any indirect, incidental, special, or consequential damages, except where this limitation is not allowed by Washington law (including for gross negligence or willful misconduct).

    25. Owner's Right to Repossess

    If Renter breaches this Agreement, fails to return the Trailer on time, or uses it unsafely or illegally, Owner may end the rental and recover the Trailer wherever it is located, where lawful, at Renter's expense.

    26. Personal Property

    Owner is not responsible for any property left in or on the Trailer or at the pickup/return location.

    27. Personal Information

    Owner collects Renter's driver's license, insurance, contact, payment, photo, and location information only to verify identity and eligibility, operate the rental, collect amounts due, handle claims, and comply with law. Owner will store it securely, will not sell it, and will delete license and insurance images within 90 days after the rental closes unless needed for an open claim, dispute, or legal requirement.

    28. Communications Consent

    Renter agrees that Owner may contact Renter by phone, text message, and email about this rental (codes, reminders, inspections, charges). Message and data rates may apply.

    29. Governing Law, Venue, and Attorneys' Fees

    This Agreement is governed by the laws of the State of Washington. Any lawsuit related to this Agreement must be filed in the state courts located in Cowlitz County, Washington, and both parties consent to that venue and jurisdiction. In any action to enforce this Agreement, the prevailing party may recover its reasonable attorneys' fees and costs.

    30. General Terms

    1. Severability. If any part of this Agreement is found unenforceable, it will be enforced to the maximum extent allowed, and the rest of the Agreement stays in effect. In particular, if any part of Sections 21–24 is limited by a court, the remainder of those Sections will still apply.
    2. Entire Agreement. This Agreement, including Schedules A–C, the Renter's Tow-Vehicle Questionnaire answers, and the booking confirmation, is the entire agreement between the parties about this rental and replaces any prior statements or listings. If the booking site and this Agreement conflict, this Agreement controls.
    3. Changes. Changes must be in writing (text or email is enough) and agreed to by Owner.
    4. No Waiver. Owner's failure to enforce any term is not a waiver of that term.
    5. Survival. Sections 11–16, 18, and 21–29 survive the end of the rental.
    6. Headings are for convenience only.

    31. Consent to Electronic Records and Signatures

    Renter agrees to do business electronically and agrees that this Agreement may be signed electronically. Under Washington's Uniform Electronic Transactions Act (chapter 1.80 RCW) and the federal E-SIGN Act, Renter's electronic signature (including a typed name, drawn signature, or clicking "I agree") has the same effect as a handwritten signature. Renter may request a paper copy at no charge by contacting Owner, and will receive a copy of the signed Agreement by email. Renter confirms that Renter can access and save electronic documents.

    32. Renter Acknowledgments (confirm each in the form below)

    • I am at least 25 years old and hold a valid driver's license, and the license and insurance I uploaded are mine and current.
    • My tow vehicle, hitch, 2-5/16 in. ball, 7-way connector, and electric brake controller meet Section 4 for the loaded weight I will tow.
    • I will hitch, chain, connect the breakaway cable, and test lights and brakes myself before every trip.
    • I will not exceed the maximum payload, and I will cover and secure every load.
    • I will not haul any prohibited materials (Section 8).
    • I will take and submit pickup and return photos, and I understand what happens if I do not.
    • I understand the $250 deposit hold, fees, damage responsibility, and payment authorization (Sections 11–14).
