ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM

hereby assume all of the risks of participating in this EV Annual Tournament, Including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them, or because of their possible liability without fault.

I certify that I am physically fit and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this EV Annual Tournament. I acknowledge that this Accident Waiver and Release of Liability Form will be used by the organizers of the EV Annual Tournament in which I may participate and that it will govern my actions and responsibilities at said tournament.

In consideration of my application and permitting me to participate in this EV Annual Tournament, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this EEV Annual Tournament. THE FOLLOWING ENTITIES OR PERSONS: EVERYDAY VOLLEYBALL, Maurice Veneracion and/or their coaches, agents, representatives or volunteers.

(B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this EV Annual Tournament, whether caused by negligence or otherwise.

I acknowledge that this EV Annual Tournament may carry with it the potential for death, serious injury, and personal loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, and lack of hydration.

I consent and agree that EV Annual Tournament, and/or their coaches, agents, representatives or volunteers may take photographs or digital recordings of me as a participant during this event and use these in any and all media for training or promotional purposes. I further consent that my identity may be revealed therein or by description text or commentary. I waive any rights, claims or interest and I understand that there will be no financial or other remuneration.

The accident waiver, release of liability and image release shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SUBMIT THIS ON MY OWN FREE WILL.

No Refund Policy for League Fee

 

Please read the following disclaimer carefully before proceeding with the league fee process. By submitting your league fee, you acknowledge and agree to the terms outlined below:

1. League fee: The league fee is a non-refundable payment required to secure your slot and initiate the registration process for the specified EV Annual Tournament.

2. Non-Transferable: The league fee is non-transferable and cannot be applied to any other program, course, or service offered by EV Annual Tournament.

3. Commitment: The league fee demonstrates your commitment to the tournament or service and enables us to allocate necessary resources, staff, and materials to accommodate your league registration.

4. No Refunds: Once the league fee is submitted, it is non-refundable under any circumstances, including but not limited to, withdrawal, cancellation, program or service discontinuation, or dissatisfaction with the program or service.

5. Understanding: By submitting the league fee, you acknowledge that you have reviewed and understood the program or service details, including dates, requirements, and policies. It is your responsibility to make an informed decision before submitting this form.

6. Waiver: You waive any rights to a refund, whether statutory or otherwise, for the league fee paid and agree not to initiate any dispute.

7. Exceptions: In rare cases where EV Annual Tournament determines that a refund is warranted due to extenuating circumstances, such decisions will be made at its sole discretion.

8. Termination: EV Annual Tournament reserves the right to terminate your participation in the program or service for any violation of policies, codes of conduct, or any other relevant guidelines. In such cases, the league fee remains non-refundable.

9. Modifications: EV Annual Tournament reserves the right to modify, amend, or update this no refund policy for the league fee at any time without prior notice. Any changes made will be effective immediately upon posting the updated policy on our official Facebook page.
