BEACON HOME INSPECTION SERVICES
Environmental Services & Testing
Pre-Inspection Agreement - Contract Terms and Disclosures
Florida Licensed Mold Assessor MRSA1586 | Florida Licensed Home Inspector HI3928 | (561) 889-3595
1. Agreement and Contract Terms
This agreement governs the environmental assessment, inspection, sampling, and testing services selected by the client and accepted by Beacon Home Inspection Services ("Beacon").
Services may include mold testing and sampling, comprehensive mold assessments, written remediation protocols, Advanced Indoor Air Quality testing, private well water sampling, FHA/VA-related water testing, and Chinese drywall inspections or testing.
The scope of services is determined by the services selected, the agreed sampling or assessment plan, and the conditions encountered at the property.
Services not selected or otherwise agreed upon are not included. All services are performed in accordance with applicable Florida laws and professional requirements.
2. Client Responsibilities and Property Access
The client or authorized representative is responsible for obtaining all necessary property-access permissions and ensuring that areas requiring assessment or testing are accessible. Claims resulting from failure to obtain required authorization are addressed under Section 17.
Utilities, air-conditioning systems, water supplies, and other equipment necessary for the requested services must be operational unless otherwise agreed upon.
The client is responsible for providing relevant information concerning previous water intrusion, mold concerns, remediation activities, renovations, and other conditions that may affect the assessment.
If access restrictions, unavailable utilities, unsafe conditions, or circumstances within the client's responsibility prevent the scheduled service from proceeding, Beacon reserves the right to assess a $175 rescheduling fee, payable before rescheduling.
3. Environmental Assessment Scope and Invasive Procedures
Environmental assessments and inspections performed by Beacon Home Inspection Services are generally visual and non-invasive unless otherwise agreed upon in writing by the actual property owner and Beacon Home Inspection Services.
Evaluations include readily accessible areas, observable conditions, appropriate testing equipment, and sampling procedures included in the agreed scope of services.
More invasive evaluations, including removal of building materials, opening of walls or ceilings, or access to concealed areas, may be performed when specifically authorized in writing by the actual property owner and agreed upon by Beacon Home Inspection Services.
Any such evaluation will be limited to the scope of the written authorization.
Beacon's experience in home inspections and building systems assists in recognizing construction, roofing, plumbing, HVAC, and moisture-related conditions that may contribute to environmental concerns.
An environmental assessment does not constitute a comprehensive home inspection unless that service is separately requested and agreed upon.
4. Mold Testing and Sampling
Mold testing and sampling may include airborne mold-spore collection, surface sampling, moisture observations, and laboratory analysis, depending on the services requested.
Sampling locations and quantities are determined by the agreed scope, observed conditions, and professional judgment.
Mold testing is a limited environmental service focused on the samples collected and the conditions associated with those sampling locations.
A limited mold-testing appointment does not automatically include a comprehensive property assessment or written remediation protocol.
Laboratory results and an emailed professional evaluation will be provided as described in Section 11.
5. Comprehensive Mold Assessments and Remediation Protocols
Comprehensive mold assessments may include visual examination of accessible areas, moisture measurements, evaluation of conditions conducive to mold growth, review of relevant building systems, and appropriate environmental sampling.
The assessment may address observable roofing, plumbing, HVAC, ventilation, or other building conditions contributing to moisture intrusion or microbial growth.
Clients selecting a comprehensive mold assessment will receive a professionally prepared written assessment addressing relevant observations, identified concerns, laboratory findings when sampling is performed, and recommendations appropriate to the evaluation.
Written mold remediation protocols will be provided when included in the agreed service or required by applicable law.
A remediation protocol is a separate professional document describing identified areas of concern, recommended remediation procedures, and appropriate corrective measures.
Remediation work is performed by the client's selected remediation contractor and is not part of Beacon's assessment services.
6. Advanced Indoor Air Quality Testing
Advanced Indoor Air Quality testing evaluates selected airborne particulates through the applicable laboratory analysis.
Depending on the testing requested, laboratory findings may identify fiberglass and insulation fibers, construction dust, pollen, insect fragments, pet-related debris, soot, and other airborne materials.
Advanced Indoor Air Quality testing may be performed independently or combined with mold air sampling.
Results reflect the samples collected and conditions present during testing. Recommendations for further evaluation, cleaning, or corrective measures may be provided when warranted.
Indoor air quality testing provides environmental information and is not a medical evaluation or diagnosis of an occupant's health.
7. Private Well Water Sampling and Testing
Private well water sampling is available for homeowners, buyers, sellers, and real estate transactions, including applicable FHA and VA mortgage requirements.
Samples are collected and submitted for the laboratory testing requested.
Depending on the agreed testing, laboratory analysis may include total coliform bacteria, E. coli, nitrates, nitrites, and other water-quality parameters.
The client is responsible for providing any lender-specific, transaction-specific, or other testing requirements before sampling.
Laboratory results reflect the water sampled at the time of collection. Water quality may change over time, and additional evaluation, treatment, or testing may be recommended based on the findings.
8. Chinese Drywall Inspections and Testing
Chinese drywall evaluations may include visual examination of accessible building materials and conditions associated with potentially problematic drywall.
These conditions may include unusual corrosion of copper piping, electrical components, air-conditioning equipment, and related materials.
Additional material sampling or specialized laboratory analysis may be performed when included in the agreed scope.
More invasive examinations require written authorization from the actual property owner and agreement by Beacon Home Inspection Services, as established in Section 3.
The assessment and reporting will address the agreed inspection and testing scope.
9. Laboratory Analysis and Sampling Conditions
Environmental samples are collected from selected locations and submitted to an appropriate independent laboratory for analysis.
Laboratory findings represent the specific samples collected, the analytical methods performed, and the conditions present during sampling.
Results from selected sampling locations may not represent every area of the property.
Occupancy, ventilation, HVAC operation, cleaning activities, renovations, previous remediation, weather, and other factors may influence environmental conditions and sampling results.
The client should disclose known conditions that may affect testing, including previous water damage, mold-related concerns, cleaning or remediation, and recent construction activity.
Additional sampling or assessment may be recommended when findings or site conditions warrant further investigation.
Beacon is responsible for its agreed sampling and assessment services. Independent laboratories are responsible for the analytical services and findings they perform.
10. PriorityLab Mold Test Accuracy Guarantee and Claims Procedures
Beacon Home Inspection Services may utilize independent environmental laboratories, including PriorityLab, for professional analysis of collected samples.
Certain qualifying mold-testing services may be eligible for PriorityLab's Mold Test Accuracy Guarantee, offering up to $3,000 toward eligible remediation expenses, subject to the guarantee provider's current written terms, eligibility requirements, coverage period, limitations, and exclusions.
The guarantee does not automatically apply to every mold-testing appointment, environmental assessment, or property. Clients will be provided access to the applicable guarantee information when their service qualifies.
When a concern may qualify under an applicable laboratory guarantee, the client agrees to notify Beacon promptly and cooperate with the guarantee provider's established claims procedures, including applicable documentation and reporting deadlines.
The client agrees to provide reasonable access and an opportunity for investigation before undertaking non-emergency corrective work. Available laboratory guarantee remedies may be pursued in accordance with the provider's terms.
PriorityLab's Mold Test Accuracy Guarantee is a standalone, independently administered program. It is separate from Beacon Home Inspection Services' General Liability and Errors & Omissions insurance and does not modify, reduce, replace, or otherwise affect Beacon's applicable insurance coverage or the rights and obligations under those policies.
Nothing in this section requires the client to waive a legal remedy or prevents Beacon from complying with applicable insurance notification requirements.

11. Environmental Reports, Laboratory Results and Assessments
Beacon Home Inspection Services will provide written documentation appropriate to the environmental services performed. The type and extent of reporting depend on the services requested and agreed upon.
Mold Testing and Sampling: Clients requesting mold testing or sampling will receive the applicable laboratory results along with an emailed professional evaluation explaining the findings, identified concerns, and recommended next steps when warranted.
Comprehensive Mold Assessments: Clients requesting a comprehensive mold assessment will receive a professionally prepared written assessment documenting relevant observations, moisture-related conditions, laboratory findings when testing is performed, and recommendations based on the evaluation.
Mold Remediation Protocols: When a written remediation protocol is included in the agreed service or otherwise required by applicable law, Beacon will provide a separate, professionally prepared document identifying the areas of concern, recommended remediation procedures, and applicable corrective measures.
Advanced Indoor Air Quality Testing: Clients will receive the applicable laboratory analysis and an explanation of significant findings and recommendations when warranted.
Private Well Water Testing: Clients will receive laboratory water-quality results and relevant information concerning findings that may require additional evaluation or treatment.
Chinese Drywall Inspections and Testing: Clients will receive documentation of the agreed evaluation, including relevant observations, laboratory results when testing is performed, and recommendations when warranted.
All findings and reports reflect the conditions evaluated and samples collected at the time of service.
12. Remediation and Further Evaluation
When environmental concerns are identified, Beacon may recommend additional testing, further evaluation, corrective measures, or consultation with appropriately qualified professionals.
The client is responsible for selecting and retaining qualified contractors to perform recommended corrective work.
Additional evaluation, sampling, or post-remediation verification is a separate service unless expressly included in the original engagement.
13. Fees, Payment and Report Delivery
The client agrees to pay the fees associated with the environmental services requested and accepted by Beacon Home Inspection Services.
Additional sampling, laboratory analysis, or services beyond the agreed scope may result in additional charges, subject to client authorization.
Payment in full is required before reports, laboratory results, or assessment documents are released, subject to applicable law.
The client is entitled to the reports and laboratory findings appropriate to the services purchased and performed.
14. Report Confidentiality and Third-Party Authorization
Environmental reports are prepared for the contracting client and the specific services requested.
Reports may be released to real estate agents, property owners, lenders, contractors, or other third parties only with the client's written authorization or as otherwise required by applicable law.
The involvement of a real estate agent, property manager, seller, tenant, or other individual in scheduling or facilitating property access does not automatically authorize that individual to receive the report.
Reports are nontransferable and are not intended for reliance by unauthorized third parties or use in unrelated transactions without Beacon Home Inspection Services' written consent.
The client agrees not to misrepresent report findings or distribute reports for purposes inconsistent with the original engagement.
15. Notice of Claims and Opportunity to Investigate
The client agrees to notify Beacon Home Inspection Services in writing promptly upon discovering any condition believed to involve an error, omission, or disputed finding associated with an environmental assessment, inspection, sampling, testing, or report.
Before authorizing non-emergency repairs, remediation, demolition, alterations, or other corrective work that may alter or remove evidence of the disputed condition, the client agrees to provide Beacon with at least 72 hours following receipt of written notice to arrange an evaluation, together with reasonable access to the affected areas.
If the client cannot provide access during that period, the parties will cooperate in arranging the earliest reasonably available appointment.
Emergency Exception: This requirement does not restrict immediate action necessary to protect occupants, address an imminent safety concern, or prevent further property damage. Examples include uncontained pressurized plumbing leaks, active flooding, electrical hazards, or other conditions requiring immediate attention.
When emergency work is necessary, the client agrees to notify Beacon as soon as reasonably possible and preserve photographs, videos, invoices, removed materials when practical, and other available evidence documenting the original condition.
Failure to provide the agreed notice or reasonable access may be considered in evaluating the claim and any resulting prejudice to Beacon, to the extent permitted by Florida law.
When an applicable laboratory guarantee may cover the concern, the client also agrees to cooperate with the guarantee provider's established claims and investigation procedures.
16. Property Conditions and Changes
Environmental findings reflect the conditions present at the time of the assessment or sampling.
Subsequent water intrusion, plumbing failures, changes in occupancy, HVAC operation, renovations, cleaning, remediation, weather events, or other property conditions may affect future environmental conditions.
Beacon Home Inspection Services does not guarantee that a property will remain free of mold, airborne particulates, water-quality concerns, problematic building materials, or other environmental conditions following the assessment.
The services performed are not a warranty, insurance policy, or guarantee of future property conditions.
17. Limitation of Liability and Client Indemnification
Limitation of Liability
To the fullest extent permitted by Florida law, the aggregate liability of Beacon Home Inspection Services arising from or related to environmental services performed, whether alleged in contract, negligence, or otherwise, shall be limited to the amount paid to Beacon for the specific environmental service giving rise to the claim.
This limitation reflects the agreed scope and fees associated with the services performed and the parties' allocation of risk.
This limitation shall not apply to conduct or liability for which such limitations are prohibited by applicable law.
Client Indemnification
The client agrees to indemnify and hold harmless Beacon Home Inspection Services from third-party claims, damages, and reasonable expenses to the extent directly resulting from:
- The client's failure to obtain required authorization for property access or invasive procedures.
- The client's unauthorized alteration, misrepresentation, or distribution of environmental reports.
- The client's use of reports for purposes or transactions outside the agreed scope without Beacon's written authorization.
This indemnification does not apply to claims arising from Beacon Home Inspection Services' own negligence, errors, omissions, or professional misconduct, or to the extent otherwise prohibited by applicable law.
18. Dispute Resolution
Any dispute arising from the environmental services performed shall first be presented to Beacon Home Inspection Services in writing, providing a reasonable opportunity for review and resolution.
If the dispute cannot be resolved directly, the parties may mutually agree to binding arbitration under the rules of the American Arbitration Association, with proceedings conducted in the Florida county where the environmental services were performed.
Arbitration shall apply only when both parties separately and expressly agree to it in writing or through an authenticated electronic agreement. A client's acknowledgment of this Pre-Inspection Agreement alone does not constitute acceptance of arbitration.
Any award of attorney's fees or costs shall be determined in accordance with applicable law and the parties' enforceable agreement.
19. Agreement Modifications and Owner Authorization
Changes to the agreed environmental services or testing scope must be documented and accepted in writing by Beacon Home Inspection Services and the appropriate client or authorized party.
Any invasive procedure requires separate written authorization from the actual property owner and written agreement by Beacon Home Inspection Services, as established in Section 3.
Verbal representations do not expand the agreed scope unless confirmed in writing by the appropriate parties.
20. Anonymized Educational and Marketing Use
Beacon Home Inspection Services may use observations, building conditions, inspection methods, testing procedures, and related photographs obtained during environmental assessments for educational, informational, or advertising purposes.
Any such materials will be presented in an anonymized manner without identifying the client, property address, occupants, or other confidential information. No personally identifiable information will be disclosed without separate written authorization.
21. Client Acknowledgment
By signing or electronically authenticating this agreement, the client acknowledges having read, understood, and accepted the terms and conditions governing the environmental services selected.
The client acknowledges that limited mold testing, comprehensive mold assessments, and written remediation protocols represent different services and deliverables depending on the agreed scope.
The client further acknowledges that environmental assessments are generally visual and non-invasive unless additional procedures are agreed upon in writing by the actual property owner and Beacon Home Inspection Services.
The client understands that laboratory results reflect selected samples and conditions evaluated at the time of testing and that additional investigation may be recommended when warranted.
