Warrior Revival

PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS. BY SIGNING, YOU GIVE UP THE RIGHT TO SUE WARRIOR REVIVAL AND OTHERS FOR INJURIES, INCLUDING INJURIES CAUSED BY THEIR NEGLIGENCE.

I, {fullName}, the participant named above, wish to take part in events, programs, and activities organized, sponsored, or promoted by Warrior Revival, a Utah nonprofit corporation ("Warrior Revival"). In exchange for being allowed to participate, I agree to the following terms.

Terms and Conditions
1. Covered Activities. This agreement covers every Warrior Revival event, program, and activity I take part in, now or in the future, including travel to and from them. Activities may include, without limitation: skydiving and tandem skydiving; aviation and aircraft flights; golf; hiking, camping, and backcountry outings; hunting, fishing, and shooting sports; water sports and boating; equestrian activities; fitness, sports, and team-building exercises; retreats and overnight stays; and social gatherings where food or alcohol may be served ("Activities").

2. Assumption of Risk. I understand the Activities involve inherent and other risks that cannot be eliminated, including physical exertion, falls, collisions, equipment failure, weather and environmental conditions, wildlife, the conduct of other participants, and delays in emergency care at remote locations. Skydiving and aviation in particular carry a risk of serious injury, permanent disability, paralysis, and death, including from aircraft accidents, parachute or equipment malfunction, hard or off-target landings, mid-air collisions, instructor or pilot error, and sudden changes in weather. I knowingly and voluntarily assume ALL of these risks, both known and unknown, even if they arise from the negligence of the Released Parties.

3. Release of Liability. To the fullest extent permitted by law, I release, waive, discharge, and agree not to sue Warrior Revival and its directors, officers, members, employees, volunteers, agents, sponsors (including the J. Parker Christensen Memorial Fund), donors, partners, and the owners and operators of any venue or service used for an Activity (the "Released Parties") from any and all claims, demands, losses, or liability for injury, illness, disability, death, or property damage arising out of or related to the Activities, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY. This release does not apply to gross negligence or intentional misconduct to the extent the law does not allow it to.

4. Third-Party Providers. Some Activities, including skydiving, are run by independent businesses (for example, Skydive Ogden for skydiving events). Warrior Revival does not own, operate, train, or control these providers, their aircraft, or their equipment. I understand I may be required to sign the provider's own waiver, and that it is separate from and in addition to this one. I agree to follow all of the provider's rules and instructions.

5. Indemnification. I agree to defend, indemnify, and hold harmless the Released Parties from any claim, cost, or attorney fees brought by me, my family, my estate, or anyone acting on my behalf that arises from my participation or my breach of this agreement.

6. Health and Fitness. I confirm I am physically and mentally able to participate, and I have disclosed to Warrior Revival and any provider any condition, medication, injury, pregnancy, or limitation that could affect my safety. I will meet any weight, age, or health limits set by a provider. I will not participate under the influence of alcohol or drugs that impair me. I understand it is my responsibility to consult a healthcare professional before participating.

7. Emergency Medical Treatment. I authorize Warrior Revival and its representatives to seek emergency medical care, transport, or treatment for me if I am unable to consent. I accept responsibility for all resulting costs. Warrior Revival does not provide medical or accident insurance for participants, and I am responsible for my own coverage.

8. Code of Conduct. I will follow all rules, safety briefings, and instructions from Warrior Revival and any provider, and act respectfully toward others and property. Warrior Revival may remove me from any Activity at any time, without refund, if it believes my conduct is unsafe or inappropriate. I am responsible for any damage I cause.

9. Photo and Media Release. I allow Warrior Revival to use photos, video, and recordings of me taken during Activities for its nonprofit purposes, including its website, social media, and fundraising, without payment. 

10. Minors. Participants under 18 may take part only with a parent or legal guardian's signature below and only in Activities the provider allows for minors. The parent or guardian agrees to all terms of this agreement on the minor's behalf and on their own behalf, and agrees to indemnify the Released Parties for any claim brought by or for the minor.

11. Governing Law and Venue. This agreement is governed by the laws of the State of Utah. Any dispute will be brought only in the state or federal courts located in Salt Lake County, Utah.

12. Severability and Entire Agreement. This agreement is intended to be as broad as Utah law allows. If any part is found unenforceable, the rest stays in full effect. This agreement binds me, my heirs, executors, administrators, and assigns, and remains in effect for all future Activities unless I revoke it in writing.

Skydiving and High-Risk Activity Acknowledgment
Required for the October 31, 2026 tandem skydive at Skydive Ogden (3463 Airport Road, Ogden, UT) and any other skydiving or aviation Activity.

- I understand tandem skydiving can result in serious injury, paralysis, or death, even when everyone follows proper procedures.

- I understand Skydive Ogden is an independent business that Warrior Revival does not own or control, and that I must also sign Skydive Ogden's own waiver.

-I release the Released Parties from all claims arising from skydiving, including claims based on their negligence.

-I am between 18 and 65 years old and weigh less than 200 lbs on the day of the jump.

-I have no condition that makes skydiving unsafe for me, such as pregnancy, heart or respiratory problems, seizure disorders, recent surgery, or significant back or neck injury, or I have consulted my healthcare provider and Skydive Ogden and been cleared.

-Any costume I wear will meet Skydive Ogden's safety requirements. I accept any added risk from it, and staff may require me to remove it or not jump.

-Any Hand Cam or other add-on I purchase is a separate arrangement between me and Skydive Ogden, at my own expense and risk.

-I understand jumpers are chosen by random lottery, signing this waiver does not guarantee a jump, and I must hold an active Warrior Revival membership to be eligible.

I, {fullName}, I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, FULLY UNDERSTAND IT, AND SIGN IT VOLUNTARILY. I UNDERSTAND I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR NEGLIGENCE. I AM AT LEAST 18 YEARS OLD.
