Private Basketball Training – Terms & Conditions and Participation Waiver
By registering for private basketball training with B-Ballerz Athletic Academy (“B-Ballerz” or “the Academy”), the participant and/or their parent or legal guardian acknowledges and agrees to the following terms and conditions.
1. Training Services
B-Ballerz provides personalized basketball training focused on skill development, physical coordination, basketball knowledge, confidence, and athletic performance.
Training activities may include shooting, ball handling, footwork, agility, conditioning, game decision-making, and other basketball-related exercises.
The Academy does not guarantee specific athletic results, performance improvements, or team selection.
2. Payment and Training Packages
Private training is offered through single-session and multi-session packages.
The full price, number of sessions, session duration, and applicable taxes are displayed at registration.
B-Ballerz’s standard purchasing option requires full payment upfront. Any alternative payment arrangements required by applicable law will be made available.
Purchased sessions are subject to the terms of this agreement and the Academy’s booking policies.
3. Cancellation and No-Refund Policy
All training purchases are considered final and non-refundable after the expiry of any legally required cancellation period, except where a refund is required by applicable law.
B-Ballerz does not ordinarily provide full or partial refunds due to a participant’s change of mind, loss of interest, scheduling preferences, or voluntary withdrawal from training.
Unused training sessions cannot be redeemed for cash or exchanged for monetary reimbursement, except where required by law.
4. Unused Training Sessions
Private training packages do not have a standard three-month expiration date.
Unused sessions remain available for future scheduling during the applicable agreement term, subject to coach and facility availability and applicable law.
Purchasing a package does not guarantee specific recurring appointment times or a particular coach unless expressly confirmed.
5. Medical Conditions, Illness and Injury
If a participant experiences an injury, illness, or medical condition preventing safe participation, the Academy may place remaining unused sessions on hold.
The participant may resume training when medically able to do so, subject to scheduling availability.
Medical documentation or clearance may be requested when reasonably necessary for participant safety.
An approved medical hold does not result in the forfeiture of unused sessions.
Any accommodation, cancellation, or refund rights provided by law remain unaffected.
6. Family Transfers
Unused private training sessions may be transferred to another eligible family member with prior approval from B-Ballerz.
Eligible recipients may include siblings, parents, guardians, or other family members approved by the Academy.
Every new participant must complete the required registration, medical disclosure, and participation waiver before attending.
Adult participants must provide their own consent and signature. Parents or legal guardians must provide consent for minors.
All transfers are subject to appropriate coaching availability, participant suitability, safety requirements, and insurance coverage.
Transfers do not increase the number of purchased sessions or create a cash redemption entitlement.
7. Gifting Sessions
Unused sessions may be gifted to another eligible individual with the Academy’s prior approval.
Gift recipients must complete the required registration and participation documentation.
Gifted sessions remain subject to applicable scheduling and safety requirements.
No cash redemption is provided except where required by law, including any applicable gift-card or prepaid-service protections.
8. Scheduling and Rescheduling
All training sessions must be scheduled through the Academy’s designated booking process.
Participants are requested to provide at least 24 hours’ notice to cancel or reschedule a booked session.
Late cancellations and missed appointments may result in the session being counted as used, except where applicable law, approved medical accommodations, or exceptional circumstances require otherwise.
If B-Ballerz cancels a session, it will not be deducted from the participant’s package balance. An alternative appointment or other legally required remedy will be provided.
9. Health and Safety
Participants are expected to be reasonably fit to participate in basketball-related physical activities.
Parents, guardians, and adult participants agree to disclose relevant injuries, medical conditions, allergies, physical limitations, or other health information that may affect safe participation.
Participants must follow all coaching instructions, safety guidelines, and facility rules.
B-Ballerz may modify or discontinue participation in an activity when reasonably necessary to protect participant safety.
10. Acknowledgment of Risk and Participation Consent
Basketball training involves inherent physical risks, including but not limited to falls, collisions, muscle strains, sprains, fractures, overexertion, and other injuries.
The participant or their parent/legal guardian acknowledges these general risks and consents to participation in age-appropriate training activities.
This acknowledgment does not exclude liability that cannot lawfully be excluded, nor does it waive the independent legal rights of a minor participant.
11. Emergency Medical Assistance
In the event of an injury or medical emergency, B-Ballerz may contact emergency services and take reasonable steps to obtain appropriate medical assistance.
The Academy will make reasonable efforts to contact the parent, guardian, or designated emergency contact as soon as practicable.
12. Conduct and Sportsmanship
Participants and accompanying family members must demonstrate respect, cooperation, and appropriate sportsmanship.
Bullying, harassment, discrimination, intimidation, violence, unsafe behaviour, and disrespectful conduct toward coaches, staff, or other participants are not permitted.
B-Ballerz may take appropriate action in response to misconduct, including suspension or termination of participation where justified and legally permitted.
13. Changes to Training Arrangements
B-Ballerz may make reasonable changes to coaching assignments, schedules, or training arrangements due to operational needs, coach availability, or facility requirements.
The Academy will communicate significant changes and provide appropriate alternatives or legally required remedies.
14. Photography and Video
Training activities may involve instructional video analysis where appropriate and with the required consent.
Photographs or videos identifying participants will not be used for public marketing or social-media promotion without separate, voluntary consent.
Declining promotional media consent will not affect training eligibility.
15. Privacy and Personal Information
Information collected during registration will be used for training administration, scheduling, payment processing, communications, and participant safety.
Relevant medical and emergency information will be handled confidentially and shared only where reasonably necessary.
Personal information will be managed in accordance with applicable privacy laws and the Academy’s privacy practices.
16. Applicable Law and Consumer Rights
This agreement is governed by applicable Ontario and Canadian law.
Nothing in these Terms & Conditions limits mandatory consumer cancellation rights, refund entitlements, payment protections, or other rights that cannot legally be waived.
If a provision is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
17. Final Acknowledgment
By signing and submitting the registration form, the adult participant or parent/legal guardian confirms that they:
