Note to Photographer

PORTRAIT AGREEMENT & MODEL RELEASE: I have read and agree to the following statement: I commission Photos by Ciera (Ciera Bianchi), the photographer, to photograph myself and/or my underage children. I hereby grant Photos by Ciera and her legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of myself, family, and/or child(ren), or in which myself, family, and/or children will be included for editorial, trade, advertising, and any other purpose and in any manner or medium; to alter the same without restriction; and to copyright the same. I hereby release Photos by Ciera and her legal representatives and assigns from all claims and liability relating to said photographs. If you agree but do not wish to have your children's faces on social media/website/advertising, please select the appropriate option for that. This does still allow Photos by Ciera to post photos that do not show the children's face. If you wish for her to not post any at all (with or without faces shown), please email her directly.

COPYRIGHT: As a client of Photos by Ciera, I acknowledge and understand that the images taken by Photos by Ciera, PHOTOGRAPHER; Ciera Bianchi, are protected by Federal Copyright Laws. I understand it is ILLEGAL to copy or reproduce these photographs elsewhere without the PHOTOGRAPHER's permission, and violaters of this Federal Law will be subject to its civil and criminal penalties. A PRINT RELEASE is supplied with digital files to print your portraits for your own personal use. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering your images without the PHOTOGRAPHER's permission. Reproduction includes, but is not limited to scanning, downloading, right-clicking, emailing, saving to harddrive, posting on websites or blogs, photocopying, obtaining screen shots, or printing in any manner. If posted on social media, a direct link to Photos by Ciera Facebook page or Ciera Bianchi personal page will be credited. I agree to honor the copyright laws as stated in this agreement.

LIABILITY: Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business. I am hereby waiving, releasing, and discharging Ciera Bianchi, Photos by Ciera and all its affiliates, from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for death, disability, personal injury, property damage, or actions of any kind which may hereafter occur to me or my family including my traveling to and from this event. Client swears that each person is participating voluntarily in the said photography session and forfeit all right to bring a suit against Ciera Bianchi and Photos by Ciera for any reason.

An $100 non-refundable deposit is due upon booking in order to reserve your mini session time. The non-refundable deposit must be sent to Ciera Bianchi, 4890 Lincoln Avenue, Quinnesec, MI 49876 via cash or check or via Venmo @CieraBianchi. If your down payment is not received by Saturday, October 31, 2026, your mini session time slot will be offered to public and you will receive a notice that your time slot is cancelled. Gifts will be available to children at a first received deposit, first serve basis. All remaining balances must be paid before or at the beginning of your session time. No part of any order, including sneak peeks or any digital images will be delivered until the balance is paid in full. Your desired session is not reserved until the deposit is received. If deposit is not made by Saturday, October 31, 2026, photographer reserves the right to open your slot to another client. The deposit is non-refundable. If you cancel with less than 48 hours notice, you forfeit your deposit and may not reschedule without a new deposit. Re-scheduling of the session due to bad weather may occur at photographers discretion only. If paying with a gift certificate and you do not show and/or cancel without 48 hours notice, your gift certificate balance will be charged $100.

By signing below you certify that You are at least 18 years of age. You have read this portrait agreement/contract and fully understand the contents thereof. You agree that you have the legal authority to grant these permissions and accept all responsibility for such.

Reminders:

Gifts will be provided for all children 10 years old and under. For each gift given, another will be donated to the local Salvation Army for kids in need.

If your down payment is not received by Saturday, October 31, 2026, your mini session time slot will be offered to public. You will not receive a warning for this - you will just be notified that your timeslot is cancelled due to not receiving a down payment. There are no exceptions for this. You can mail non-refundable deposit check/cash to: Ciera Bianchi, 4890 Lincoln Avenue, Quinnesec, MI 49876 or pay via Venmo @CieraBianchi.

**Dogs MUST be on a leash at all times during the session.**

**Limited number of people can fit into sleigh.** If full families do not fit with the sleigh, we will have two other options for photo set-ups outdoors for full families.

The remainder of the session fee must be paid in full by or on the date of your session. The fee includes your session and at least 10 digital images with print release via an online gallery where you are able to download your high-defintion, professionally retouched digitial images. This gallery will only be available to download for 2 weeks. If requested, a USB can be mailed to your home for an additional $45. Prints and products may be purchased through a professional lab, a la carte, through Photos by Ciera within your online gallery.
