IMPORTANT — READ BEFORE SIGNING. THIS IS A LEGAL DOCUMENT. BY SIGNING, YOU GIVE UP THE RIGHT TO SUE THE RELEASED PARTIES FOR INJURY, ILLNESS, DEATH, OR PROPERTY LOSS CAUSED BY THEIR ORDINARY NEGLIGENCE, AND YOU AGREE TO INDEMNIFY THEM.
This Agreement is made by the parent or legal guardian ("Parent") and the student ("Student") named below ("I" or "we") for the benefit of the Released Parties. ATL Project Launch (the "Program") is a program of The OxStem Foundation (the "Foundation").
1. Who Is Protected
The "Released Parties" are: ATL Project Launch; the Foundation; Chandler McCormack, individually and in every capacity, and any entity he controls; the Foundation's directors, officers, staff, chaperones, and volunteers; host companies and the owners of any premises used; speakers, mentors, and judges; assessment, survey, and data providers, including Pi; sponsors; Atlanta Public Schools; and the owners, officers, employees, agents, insurers, and successors of each. Each Released Party may enforce this Agreement. "Program Activities" means all Program activities, on or off campus, in person or online, including tours, workshops, mentoring, assessments, competitions, internships, events, and travel to, from, and between them.
2. Participation and Conduct
Participation is voluntary and free, and no outcome (internship, job, prize, or funding) is guaranteed. Host companies, speakers, mentors, and judges are independent and responsible only for their own conduct. My Student will follow the Program's Code of Conduct and Safeguarding Policy, staff instructions, and each host's safety and confidentiality rules, and will not record or post anything at a host site without permission. The Program may remove my Student for unsafe or inappropriate conduct. Ideas and business plans my Student shares remain my Student's, but are shared without any duty of confidentiality or compensation, and recipients may already be working on similar ideas.
3. Assumption of Risk
I UNDERSTAND THAT PROGRAM ACTIVITIES INVOLVE RISKS THAT CANNOT ALL BE ELIMINATED, INCLUDING TRAVEL ACCIDENTS, WORKPLACE AND JOB-SITE HAZARDS, WEATHER, ILLNESS AND ALLERGIC REACTIONS, THE CONDUCT OF OTHERS, ONLINE AND DATA-SECURITY RISKS, AND LOSS OF PROPERTY. I KNOWINGLY ASSUME ALL OF THESE RISKS, KNOWN AND UNKNOWN, EVEN IF CAUSED BY THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES.
4. Release, Covenant Not to Sue, and Indemnity
FOR MYSELF, MY HEIRS, AND MY ESTATE, I RELEASE THE RELEASED PARTIES FROM ALL CLAIMS ARISING FROM PROGRAM ACTIVITIES, INCLUDING CLAIMS FOR MY STUDENT'S MEDICAL EXPENSES AND MY OWN LOSSES, WHETHER CAUSED BY THEIR ORDINARY NEGLIGENCE OR OTHERWISE, AND, TO THE FULLEST EXTENT THE LAW ALLOWS, I GIVE THE SAME RELEASE ON BEHALF OF MY STUDENT. I WILL NOT SUE ANY RELEASED PARTY ON A RELEASED CLAIM, AND I WILL INDEMNIFY AND DEFEND EACH RELEASED PARTY AGAINST ANY SUCH CLAIM BROUGHT BY OR FOR MY STUDENT OR ME, INCLUDING REASONABLE ATTORNEYS' FEES. A STUDENT 18 OR OLDER GIVES THIS RELEASE PERSONALLY, AND A STUDENT WHO TURNS 18 AND KEEPS PARTICIPATING ADOPTS IT.
I also indemnify the Released Parties for property damage or third-party claims caused by my Student's intentional misconduct. No Released Party is responsible for the acts of another.
5. Medical Care and Travel
If I cannot be reached, I authorize emergency medical treatment and transport for my Student, and good-faith emergency decisions create no liability. I am responsible for medical costs, and my insurance is primary. I will provide and update the Program's Emergency Contact and Medical Form. I authorize travel by the method the Program describes for each activity and accept its risks under Sections 3 and 4. The Released Parties are not responsible for my Student before arrival or after dismissal when my Student travels independently or with me.
6. Student Information
I consent to the Program collecting my Student's application, contact, assessment (including Pi), attendance, evaluation, business-plan, and medical information, and sharing it only as needed: a student profile (first name, grade, interests, and a strengths summary) with mentors, hosts, speakers, and judges; contact details with hosts for check-in; medical information with chaperones, hosts, and responders when needed for safety; and de-identified data in reports. The Program will not sell this information, use it for advertising, or publish grades, scores, medical information, or contact details. Providers such as Pi follow their own privacy terms, and my Student may need an account with them. I may ask to review, correct, or delete information at hello@atlprojectlaunch.com. TO THE FULLEST EXTENT THE LAW ALLOWS, I RELEASE THE RELEASED PARTIES FROM CLAIMS ARISING FROM THESE AUTHORIZED USES AND FROM SECURITY INCIDENTS NOT CAUSED BY THEIR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
7. Photos and Media
The Released Parties, including host companies during tours and events, may photograph and record Program Activities, including group and team photos, and may use my Student's image, voice, first name, grade, school, and Program work in materials, websites, social media, and news coverage about the Program or their participation in it, without payment or review. Images will not be used to advertise a partner's products, and my Student's last name will not be published without separate permission. This permission applies unless I check the opt-out box below.
8. Limits and General Terms
NOTHING IN THIS AGREEMENT RELEASES ANYONE FROM LIABILITY FOR THEIR OWN GROSS NEGLIGENCE, WILLFUL OR WANTON MISCONDUCT, INTENTIONAL HARM, OR SEXUAL ABUSE OR MISCONDUCT, OR WAIVES ANY RIGHT THE LAW DOES NOT ALLOW TO BE WAIVED.
This Agreement adds to any legal immunity, including under the federal Volunteer Protection Act and O.C.G.A. § 51-1-20. Georgia law governs; the parties will first try mediation in Atlanta, and any lawsuit must be filed in the state or federal courts serving Fulton County, Georgia. If any part is unenforceable, it is enforced to the extent allowed and the rest remains; if the release on behalf of my Student fails, my own release, covenant not to sue, and indemnity still apply. This Agreement covers all Program Activities through the 2026–27 Program year and any later year of participation, unless revoked in writing for future activities. I have authority to sign for my Student and accept the indemnity above for any claim by a non-signing parent. The Program may share this Agreement with any Released Party. I agree that this Agreement may be signed electronically, and an electronic signature has the same effect as a handwritten one. This is the entire agreement on these subjects.
The Student signs to confirm he or she has read this Agreement and will follow the rules.
