  • Bear Creek Lake Park Backyard Ultra - Participant Waiver

  • Oct 23, 2026

  • Read before signing

  • This is a legal document. By signing it, you give up your right to sue the people and organizations listed below, including for their negligence. Read it carefully. Do not sign it if you do not agree.

Event: Bear Creek Lake Park Backyard Ultra

    Date: October 31, 2026, 8:00 AM start

Location: Pelican Point, Bear Creek Lake Park, Lakewood, Colorado

Organizer: Yay Ultra, LLC, 2735 King St, Denver, CO 80211

Participants under 18 on race day must also have a parent or legal guardian sign the consent section at the end. In this agreement, "I" and "me" mean the participant signing it.

  • 1. Assumption of risk

  • I understand that running a backyard ultra is a strenuous, inherently dangerous activity. The race requires me to run a loop of about 4.17 miles every hour, for up to 11 hours, on trails and roads. Risks include, but are not limited to:

    • Falls, sprains, fractures, cuts, and other injuries from uneven, rocky, muddy, or icy terrain
    • Heat illness, hypothermia, dehydration, hyponatremia (low blood sodium), and exhaustion
    • Heart attack, sudden cardiac arrest, stroke, and other medical events, which can be fatal
    • Changing Colorado weather, including cold, wind, rain, snow, sun, and lightning
    • Reduced visibility at dawn or dusk
    • Wildlife, insects, dogs, plants, and water hazards near Bear Creek Lake
    • Contact with other runners, park visitors, cyclists, horses, and vehicles on park roads and trails
    • Food, drink, and supplies at the aid station
    • Medical help that may be limited on the course and may take time to arrive
    • The acts or mistakes of other participants, volunteers, and race staff

I knowingly and voluntarily assume all of these risks, known and unknown, even if they arise from the negligence of the Released Parties named in Section 3.

  • 2. Fitness and health

  • I confirm that I am physically fit and have trained enough to take part safely. I have no medical condition that makes it unsafe for me to run this race, or my doctor has cleared me to run it.

I am responsible for my own health and safety during the race. I will stop running and get help if I feel unwell, and I will tell race staff if I withdraw.

  • 3. Release of liability and promise not to sue

  • "Released Parties" means:

    • Yay Ultra, LLC, and its owners, members, managers, employees, and agents
    • All race volunteers, including volunteer medical personnel
    • American Trail Running Association
    • The City of Lakewood, Bear Creek Lake Park, and their officials, employees, and agents
    • Any landowners, sponsors, and permitting agencies connected with the event

To the fullest extent allowed by law, I release the Released Parties from all claims, demands, and liability for injury, illness, disability, death, or property loss or damage arising from my participation in the event, INCLUDING CLAIMS CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES. I promise not to sue any of them for such claims.

This release covers the race itself, travel on the course, the start/finish area, the aid station, and any activity at the event before or after the race. It binds me, my heirs, my estate, and anyone who might make a claim for me.

This release does not cover willful and wanton conduct, or anything else Colorado law does not allow a person to waive.

  • 4. Indemnification

  • I agree to defend, indemnify, and hold harmless the Released Parties from any claims, losses, costs, and legal fees that arise from my participation in the event, including claims brought by me or on my behalf, and claims caused by my own actions.
  • 5. Medical treatment

  • I authorize race volunteers, volunteer medical personnel, and emergency services to give me first aid and emergency medical care, and to transport me to a hospital, if they believe I need it. This applies even if I cannot give consent at the time.

I understand that any medical help at the event is limited and is not a substitute for a hospital. I am responsible for all costs of my medical care and transport. The event's accident insurance is limited, pays only after my own health insurance, and covers accidental injuries only.
  • 6. Rules and race officials

  • I will follow the race rules, park rules, and instructions from race staff and park rangers. I will stay on the marked course and share trails and roads safely with the public.

Race staff and volunteer medical personnel may stop me from continuing if they believe it is unsafe for me or others. Their decision is final. The organizer may change, delay, shorten, or cancel the event for weather, safety, or park requirements.
  • 7. Photos and media

  • I allow Yay Ultra, LLC, and its partners to use photos, video, recordings, my name, and my race results from this event to promote the race and future events, without payment to me.
  • 8. General terms

  • This agreement is governed by Colorado law. It is meant to be as broad as Colorado law allows. If any part is found unenforceable, the rest stays in full effect.

This is the complete agreement between me and the organizer about these matters. I am signing it voluntarily, and no one has made promises to me that are not written here.
