  • Release and Waiver of Liability

RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, INDEMNITY, MEDICAL AUTHORIZATION, AND PARENTAL CONSENT AGREEMENT (“AGREEMENT”)

Safe Streets Petaluma (“SSP”) is a fiscally sponsored project of Rebuilding Together Petaluma (“RTP”). In consideration of being permitted to participate in the 2026 Holiday Lighted Bike Ride on December 18, 2026, including check-in and assembly at McNear Park, the ride itself, and any gathering before or after the ride (the “Activity”), I, for myself, for any minor listed on this form, and for my personal representatives, assigns, heirs, and next of kin:

    1.  Fitness and Conditions. I acknowledge, agree, and represent that I understand the nature of the Activity and that I and any minor listed on this form are qualified, in good health, and in proper physical condition to participate. I understand that the Activity takes place after dark, on public streets that remain open to traffic and to the public, where the ordinary hazards of travel are to be expected. I will obey traffic laws and the instructions of ride leaders, marshals, and police. If at any time I believe conditions are unsafe, I will immediately stop participating.

    2.  Assumption of Risk. I fully understand that: (a) bicycling, including riding at night and in a group, involves risks of serious bodily injury, including permanent disability, paralysis, and death, as well as damage to property (“Risks”); (b) these Risks may be caused by my own actions or inactions, the actions or inactions of other participants or motorists, road, weather, lighting, or equipment conditions, or the negligence of the Releasees named below; (c) there may be other risks not known to me or not reasonably foreseeable at this time; and (d) I fully accept and assume all such Risks and all responsibility for losses, costs, and damages I or any minor listed on this form incur as a result of participating in the Activity.

    3.  Release and Indemnity. I hereby release, discharge, and covenant not to sue the following (each a “Releasee”): RTP, including its project SSP; event partners Aqus Community Foundation, the City of Petaluma (including the Petaluma Police Department), and Old Caz Backyard; each of their directors, officers, members, employees, volunteers, agents, ride leaders, and marshals; other participants; sponsors and advertisers; and owners and lessors of premises on which the Activity takes place. I release the Releasees from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise, including negligent rescue operations. If, despite this Agreement, I or anyone on my behalf makes a claim against any Releasee, I will indemnify, defend, and hold harmless each Releasee from any litigation expenses, attorney fees, loss, liability, damage, or cost any of them may incur as a result of that claim.

    4.  Medical Authorization. I authorize the Releasees to obtain emergency medical treatment for me and for any minor listed on this form if I am unable to give consent at the time, and agree that I am responsible for the cost of any such treatment and transport.

    5.  Parental Consent (if minors are listed). As the parent or legal guardian of each minor listed on this form, I understand the nature of the Activity and the minor’s experience and abilities, and I believe the minor is qualified to participate. I agree that the minor will ride with me and that I am responsible for the minor’s safety. On the minor’s behalf and my own, I release, discharge, covenant not to sue, and agree to indemnify, defend, and hold harmless each Releasee from all liability, claims, demands, losses, or damages on the minor’s account caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise, including negligent rescue operations. If, despite this release, I, the minor, or anyone on the minor’s behalf makes a claim against any Releasee, I will indemnify, defend, and hold harmless each Releasee from any litigation expenses, attorney fees, loss, liability, damage, or cost any of them may incur as a result of that claim.

    6.  General. I agree that this Agreement is governed by California law; that it is intended to be as broad and inclusive as California law permits; that if any part is held invalid, the rest remains in full force and effect; and that my electronic signature on this form has the same effect as a handwritten signature.

    7. By registering, I agree that for myself and every rider in my group:
    • Every rider under 18 will wear a properly fitted bicycle helmet, as California law requires. Helmets are strongly encouraged for adults.

    • Every bike will have a white front light and a red rear light or reflector, as California law requires for riding after dark.

    • Our bikes will be in safe working order (brakes, tires, chain).

    • We will follow traffic laws and the instructions of ride leaders, volunteer marshals, and police.

    • Lights and decorations will not block our view, cover our bike lights, or tangle in wheels or chains.

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING MY RIGHT TO SUE AND THE RIGHT OF ANY MINOR LISTED ON THIS FORM TO SUE. I SIGN IT FREELY AND VOLUNTARILY, WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY KIND, AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
