• Seller Disclosure Statement

  • Important Notice

  • We are preparing the Form 2 Seller Disclosure Statement required under Queensland legislation for the sale of your property.

This is a strict disclosure document. Buyers may have a right to terminate the contract if the disclosure is inaccurate, incomplete or misleading. We will be relying entirely on the information you provide. If any information is incorrect or omitted, the Form 2 may be invalid and this could give the buyer a right to terminate.

If you are unsure about any of the details, please select "Not sure" so we can conduct searches at an additional cost, which will provide definitive answers.

Please review each question carefully. If a question does not apply, please answer "No".

  • Seller And Property Details

  • Please give the seller details exactly as they appear on the title to the property. We use these details in the Form 2 and in the contract, so a misspelt name or missing seller can cause delays at settlement.

You will find the lot and plan number on your council rates notice or water notice. If you can't find them, leave those fields blank and we will look them up.

  • How You Are Selling

  • Who is selling the property?*
  • We may need extra documents (e.g. company search, trust deed, probate or power of attorney). We will contact you.

  • Community Titles Scheme / BUGTA

  • Is the property part of a Community Titles Scheme or BUGTA scheme?*
  • We will check the title for you.

  • Do you have a current Body Corporate Certificate (Form 33)?*
  • We will need to order a Form 33 for you. The cost is approximately $80–$120.

  • Are you aware of any of the following for the body corporate? (tick all that apply)*
  • Encumbrances and Tenancy

  • An "encumbrance" is a right someone else has over your property, or a restriction on it. Some are registered on the title and we will find those in our searches. This section asks about the ones that are not on the title, which only you may know about. Think about any arrangement, written or just a handshake, that lets someone else use, access, occupy or take something from your land, and that will still be in place after the buyer takes over.

  • Examples of things to tell us about:

    • A tenant who will still be living in or renting the property after settlement.
    • A granny flat, shed, or room rented to someone, even informally or to a family member.
    • An arrangement letting a neighbour use your driveway, cross your land or park on it, where this is not a registered easement.
    • A shared driveway, boundary fence, water tank, bore or drainage arrangement with a neighbour.
    • A lease or licence for a phone tower, billboard, solar panels or battery owned by someone else.
    • Someone grazing livestock or keeping horses on your land (agistment), or storing a boat, caravan or equipment there.
    • An agreement with a gas, mining or energy company about access to the land.

You do not need to include:

    • Your bank mortgage. It is registered and will be paid out at settlement.
    • Easements or covenants already shown on your title. We will pick these up in our title search.
    • Shared walls, pipes and services in a unit complex that the body corporate legislation already covers.

If you are not sure whether something counts, choose "Not sure" and describe it. We would rather know about it.

  • Unregistered Encumbrances

  • Are there any encumbrances not registered on title that will continue to affect the property after settlement (including any unregistered lease)?*
