• Gary Leffew Bull Riding School | Participant Agreement & Liability Release

  • RIDER / LEGAL GUARDIAN WAIVER — READ ALL SECTIONS BEFORE SIGNING

    1. Participant information & Texas warning

This agreement covers only the school or private-training session identified below. Read every section before signing. Ask the school about anything you do not understand. An adult rider age 18 or older signs personally. For a rider under 18, a parent or legal guardian must complete the guardian information, authorize participation, and sign in the stated capacity.

    WARNING

UNDER TEXAS LAW (CHAPTER 87, CIVIL PRACTICE AND REMEDIES CODE), A FARM ANIMAL PROFESSIONAL OR FARM OWNER OR LESSEE IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OF A PARTICIPANT IN FARM ANIMAL ACTIVITIES, INCLUDING AN EMPLOYEE OR INDEPENDENT CONTRACTOR, RESULTING FROM THE INHERENT RISKS OF FARM ANIMAL ACTIVITIES.

This is the Chapter 87 statutory warning. The contractual adult release in Section 2 is separate and has its own limits. Complete all identification and contact details accurately. A payment by someone else does not authorize that person to sign for an adult rider.

  • 2. Adult release of liability

READ CAREFULLY — THIS SECTION RELEASES CLAIMS FOR ORDINARY NEGLIGENCE.

For the training session identified in this form, “School” means Gary Leffew’s Bull Riding School LLC. “Released Parties” means the School; Gary Leffew; its owners, officers, employees, instructors, agents, volunteers, and independent contractors acting in connection with the session; and the owners, lessees, and operators of the property hosting the session, including Running Gun Ranch to the extent it is a hosting owner or operator.

IF I AM AN ADULT PARTICIPANT, I VOLUNTARILY RELEASE AND AGREE NOT TO SUE THE RELEASED PARTIES FOR CLAIMS THAT I MAY LAWFULLY RELEASE FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE ARISING FROM MY PARTICIPATION IN THE IDENTIFIED SESSION, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY A RELEASED PARTY’S OWN ORDINARY NEGLIGENCE, WHETHER SOLE OR CONCURRENT.

This includes ordinary-negligence claims relating to instruction, supervision, animal selection and handling, equipment, premises, and school-arranged training activities. This agreement applies only to the identified session and directly related use of its facilities, including agreed lodging. It is not a release of unrelated future activities.

LIMITS: This agreement does not purport to release gross negligence, reckless or intentional misconduct, or any claim or duty that applicable law does not allow to be released. Statutory protections remain subject to statutory exceptions.

MINORS: A parent/legal guardian authorizes the minor’s participation and acknowledges the disclosed risks. The release above applies only to the signer’s own claims that the signer may lawfully release. This form does not represent that a parent can extinguish a minor’s personal-injury claims. A minor’s signature is not a substitute for a parent/legal guardian’s signature. An adult rider must sign for themselves, regardless of who paid.

Texas law governs training conducted in Texas, subject to mandatory applicable law. If a provision is unenforceable, the remaining provisions apply to the extent permitted by law; severability does not expand an invalid release. Written booking terms remain separate.

By signing below, I acknowledge the conspicuous ordinary-negligence release and its limits, and sign voluntarily in the capacity identified in Section 1.

  • 3. Safety, conduct, lodging & property

Follow staff instructions. Use only assigned animals, equipment, and areas. Do not enter pens, chutes, arenas, machinery areas, or other restricted locations without permission. Do not handle, feed, or ride animals without staff approval. Tell staff immediately about unsafe equipment or conditions. Do not alter equipment or training devices.

Protective equipment. Wear the helmet, protective vest, suitable footwear, and other gear required for the assigned activity. Ask staff to check fit or function if uncertain. Protective gear reduces some risks but cannot prevent every injury. Stop if gear is damaged, missing, or improperly fitted.

Fitness and behavior. No riding or training under the influence of alcohol, illegal drugs, or medication that impairs safe participation. No threats, fighting, harassment, theft, or deliberate disregard of safety instructions. Staff may stop an activity or require a person to leave for unsafe conduct or an immediate health or safety concern. Payment consequences are governed by the booking terms separately agreed before payment and applicable law.

Minors. A parent or legal guardian must remain on-site and available throughout the minor’s training and supervise the minor outside direct instruction. Training is not a childcare service. The accompanying adult must follow visitor rules and arrange and pay for their own lodging and meals separately unless expressly included in the written booking.

Lodging and visitors. Stay only in approved accommodations, observe posted house rules, respect other occupants, and keep exits clear. Obtain approval before bringing visitors or animals or using additional facilities. Each adult visitor must complete any applicable visitor agreement before entering activity areas. Children and pets must be supervised and kept out of restricted areas.

Personal property. Label and secure belongings and report missing property promptly. Staff may ask for cooperation in locating a missing item. Any inspection of a bag, vehicle, or personal property requires separate, specific, voluntary consent at the time, unless otherwise authorized by law. This form is not blanket permission to search or detain a person. Suspected theft may be referred to law enforcement.

Booking terms. Tuition, deposits, cancellations, refunds, credits, rescheduling, early departure, and lodging charges are governed by the written booking/payment terms accepted for the session. Any discretionary credit must be confirmed in writing. This waiver does not retroactively change an existing booking or impose a new payment policy. Weather, animal condition, participant ability, and safety may require changes to exercises or scheduling; no particular number of rides or competitive result is guaranteed.

  • 4. Training risks & voluntary participation

BULL RIDING AND RELATED TRAINING CAN CAUSE SERIOUS INJURY, PERMANENT DISABILITY, PARALYSIS, OR DEATH. These outcomes can occur even when instructors act carefully and protective equipment is used.

Activities covered. The identified session may include bull riding; handling or working near bulls, cattle, horses, and other farm animals; horse-based drills, lunging, bareback balance work, or jumping exercises when assigned; stationary and drop barrels; mechanical or simulated bucking equipment; mounting, dismounting, strength and balance drills; and moving through arenas, chutes, pens, barns, and related training areas.

Specific risks include being thrown or falling; being kicked, stepped on, bitten, struck, gored, crushed, dragged, or trapped; unpredictable animal movement; collisions; ropes, tack, gates, fences, and moving equipment; loss of balance or grip; equipment failure; uneven, slippery, hard, or hidden ground conditions; dust, heat, weather, exertion, and delayed emergency response at a rural location. Other participants may act unpredictably or fail to follow instructions. This list is not exhaustive.

My responsibility. I will accurately disclose my experience, limitations, and health restrictions; ask questions when I do not understand; follow the assigned progression; and stop and tell staff if an activity exceeds my ability or I feel unsafe, ill, or injured. I may decline an exercise. Completing this form does not require me to ride a bull or perform every exercise.

Assumption of risk. Knowing these risks, I voluntarily choose to participate in the identified session and assume the inherent risks of the activities to the extent permitted by law. Any contractual release of a Released Party’s ordinary negligence is stated separately in Section 2 and remains subject to its limits. This acknowledgment does not eliminate duties or claims that cannot lawfully be waived.

Parents/legal guardians. I acknowledge these disclosed risks for the minor’s authorized participation, have the opportunity to discuss the minor’s experience and limitations with staff, and will not authorize participation contrary to medical restrictions. This acknowledgment does not claim to waive the minor’s nonwaivable rights.

  • 5. Emergency contact & rider experience

Provide an adult emergency contact who can be reached during training. Include full name, relationship to the rider, and mobile number. For a minor, identify the parent/legal guardian who will remain on-site and provide a backup contact if available.

Also describe the rider’s recent bull-riding and horse experience, approximate number of rides, training-device experience, and any exercises the rider has not done before. Accurate information helps staff plan an appropriate progression; completing the form does not replace an individual safety assessment.

Notify the school promptly if these details change. Provide only information needed for training safety and emergency response.

  • 6A. Contagious illness declaration & illness credit policy

DO NOT ARRIVE SICK. NOTIFY THE SCHOOL BEFORE ARRIVAL.

My declaration. To the best of my knowledge, I (or the minor rider for whom I am responsible) do not currently have a known or suspected contagious illness that would make attendance, shared lodging, or training unsafe. Examples include active strep throat, active infectious mononucleosis (mono), influenza, COVID-19, or a contagious vomiting/diarrheal illness. I have disclosed any relevant diagnosis, symptoms, pending evaluation, or medical restriction to the school before arrival. I understand that a person can have an infection without knowing it; this is a truthful knowledge-based declaration, not a guarantee that transmission is impossible.

Symptoms and disclosure. I will not attend with an unexplained fever, significant sore throat, vomiting, diarrhea, or other symptoms suggesting contagious illness without notifying the school and obtaining appropriate medical advice. I will follow a treating clinician’s instructions about contagiousness, isolation, and physical activity, and immediately report symptoms that start or worsen during the session. I will not conceal an illness to avoid losing a payment.

Illness before arrival — credit preserved. If I am sick before arrival and notify the school before arriving, the school will preserve my paid school/training fees as a credit toward a future school session of my choice, arranged with the school and subject to availability. This is a credit, not a cash refund. I should notify the school by text or email so the notice and credit can be documented. The school will confirm the credit in writing. No credit expiration date is imposed by this section. Any separately purchased third-party travel or lodging is governed by that provider’s terms.

Arrival while ill — removal and no cash refund. If I arrive with an active contagious illness or a health condition requiring exclusion for safety, the school may deny participation, require me to stop training, and require me to leave school accommodations or activity areas. No cash refund of school/training fees will be issued for that exclusion, to the extent permitted by law. The advance-notice credit above is available when the school is notified before arrival. This does not excuse delayed reporting of symptoms or override rights that cannot lawfully be waived.

Return to training. Return requires meeting applicable medical/public-health guidance and the school’s safety requirements. The school may request appropriate written medical clearance, especially after mono or another condition affecting safe strenuous or contact activity. Clearance should address fitness for bull riding and assigned physical drills; a statement about reduced contagiousness alone may not address physical safety.

Scope. These are the illness terms for bookings made with this policy. They do not retroactively remove rights under an earlier booking. Other payment terms remain governed by the booking agreement. By printing my name, initialing, dating, and signing the illness acknowledgment below, I confirm that I have read and understand this policy and agree to give truthful, timely information.

  • 6B. Health disclosure & emergency care

Tell the school before arrival about any illness, recent concussion, injury, surgery, medication effect, restriction, or other condition that could affect safe participation. Do not ride while impaired or contrary to medical restrictions. Report new symptoms or injuries immediately. The school may stop or postpone training for safety and may require appropriate medical clearance before return. Do not enter another person’s private medical details here without authority.

Emergency response. Staff may call 911 and provide first aid within their training. If I select “yes,” I authorize qualified medical professionals to provide emergency care and transport when I cannot consent, subject to applicable law. Staff will try to contact the emergency contact when practicable; emergency care should not be delayed while waiting for that contact. My selection does not require staff to withhold legally permitted emergency assistance.

Expenses. I am responsible for medical and transport charges that I am legally obligated to pay. The school does not promise medical insurance or on-site medical personnel. This paragraph does not eliminate any liability that cannot lawfully be waived.

Choose below: “yes” = I give the emergency authorization above; “no” = I do not give additional advance consent; “get emergency contact permission” = contact my emergency contact when practicable. This last choice does not make that person a legally authorized medical decision-maker.

Final acknowledgment. I have read all sections, may ask questions before signing, and voluntarily provide my electronic signature with intent to sign. I confirm that the information I provide is accurate. An adult rider signs for themselves even if another person paid. A parent/legal guardian signs for a minor’s participation and in their own capacity as expressly stated in this agreement.
