All entrants enter and participate in the Your Theatrics International Cabaret Contest according to the General Conditions set out below:
For the purposes of the following, ‘YTICC’ refers to the Your Theatrics International Cabaret Contest and 'YT' refers to Your Theatrics International, being the organising body responsible for the Cabaret Contest internationally.
CONDITIONS OF ENTRY
1. Events are open to all comers, subject to stipulated conditions of YTICC.
2. Entries must be received by YT no later than 5pm on 27th December, 2013. Entrants must use the official YTICC Submission Form which must be submitted electronically through the Your Theatrics Website, yourtheatrics.com, or the YTICC website, yticc.com. Forms must be properly completed and accompanied by the full entry fee or will not be processed. Responsibility for correct entry rests with the entrant. YT cannot be responsible for entries delivered incorrectly or lost through failed electronic transmission. A receipt acknowledging your submission will be issued via email to entrant immediately after submitting and entrants should contact YT if they have not received notification after submitting their application. Please Note: Due to the number of submissions, all who enter will not be selected to participate in the Contest Heats. Selection of applicants will be based upon performance clips submitted, as well as performance education/background, and performance credits from the entrant's CV/Resume.
3. Submission Fees are non refundable except when an event is cancelled.
4. Late Entries received after 5pm on 27th December, 2013 will be subject to an additional (late) fee of $10. Late entries are only accepted subject to our final timetabling capacity and without obligation.
5. No person may enter under a name other than his or her own legal name. Entries are not transferable from one person to another.
6. YT reserves the right to amend or refuse any entry, to disqualify or deny participation, to alter or reduce the prizes as published, or to amend, cancel or combine any heat or event.
7. Entrants perform at their own risk. Entrants agree they are of good health and fitness and physically able to participate.
8. The use of private tape recorders, videos or cameras is not allowed. Mobile phones, pagers, alarms and personal headsets must be switched off during performances.
9. While all due care will be taken, YT will not be liable for personal items lost or stolen during the running of any YTICC related activities.
10. YT will not be liable for any copyright infringement relating to the submission of photocopies. Entrants should be aware of the rules of copyright.
11. Behaviour which is contrary to the spirit of the event will result in the offender(s) being asked to leave. Offending entrants will be disqualified at the discretion of YT.
12. The directions of YT and YTICC staff must be followed at all times.
13. YT reserves the right to record, film, broadcast, telecast, videotape or photograph any entrant or item in YTICC without notification and any such photograph, recording or broadcast may be used at YT’s discretion for publicity or promotional purposes, but shall not necessarily constitute an endorsement of any participants, and no remuneration or compensation whatsoever shall be attributable to any participants so featured.
14. YT, at its sole discretion, may promote or publicise the profile of any entrant and their participation and may subsequently also publish results of YTICC and its entrants.
15. Personal details provided by an entrant on the entry form are for YT’s use only and are not released to third parties except at their discretion after consultation with the entrant to known organisations when an opportunity may be beneficial to an entrant.
16. Failure to comply with any of the foregoing rules and conditions may cause withholding of prizes, disqualification, and a future bar from YTICC. The decision of YT and event organisers of YTICC in all questions or disputes arising out of, or not provided for, by these rules and regulations will be final. All entries are received according to this condition and in the spirit of friendly competition upon which YTICC is based, and no dispute shall become the subject of any appeal at law.
17. Entrants should submit along with this entry form a copy of their performance resume/CV, along with a recent headshot or photograph of themselves and a recent link of them in performance.
18. Entrants acknowledge that if they should be selected as the overall Winner/s, that they will be required to sign a contract agreeing to the commitments, obligations and expectations resulting from their win in order to claim their prizes. This agreement between the individual and YT, will include an obligation to representation by Your Theatrics International for future performances of the solo cabaret show that they will devise as a result of their win. It will not preclude them from seeking other representation and shall not inhibit already existing representation agreements with the individuals, if they are already in existence.
AGE LIMITS
19. Age is determined as at the entrant’s first appearance in YTICC, at which time all entrants must be 18 years of age or above. Where requested, every entrant must have proof of age available on the spot if requested by YT (e.g. copy of birth certificate, drivers license etc) or risk disqualification.
PERFORMANCE
20. Entrants must register with YTICC event staff, for both sound checks and all performances, at least 15 minutes prior to the start of the nominated time as directed. Please allow time for transport delays or parking. Non-attendance at designated entrant sound checks will result in the removal of entrants from YTICC, unless otherwise approved by YT.
21. The order of performance in both Heats and Finals is at the discretion of YT. All entrants must be ready to perform when called. Latecomers, or those who miss their turn, may only perform at the end of the heat or final at the discretion of YT.
21. The onus of choosing the ‘right’ material rests with the entrant. YTICC judges are instructed to view each entrant’s performance as a self-contained piece of cabaret. This includes suitability and relationship between song choices/patter, quality of choices, overall presentation and adherence to given time limits.
23. Published or unpublished work is allowed. Where the entrant chooses to use YTICC's Musical Director provided, no hand-written transposition of music shall be permitted, unless approved in advance by YT (in conjunction with YTICC's official Musical Director in each city).
24. The same ‘set’ is required for each heat or final, unless permission is sought from YT to make changes in advance of the next performance.
25. Accompaniment must be acoustic piano except where permission is sought from YT in advance.
26. Official accompanists may not play illegible or poorly presented music at sight.
27. No entrant may rehearse in YTICC venues during the period of YTICC, other than at official sound checks.
28. Performances must be kept within specified time limits. If a performance goes over the maximum time the entrant may be disqualified from consideration of a place. Except for announcement of the item title, time is determined from the start of the first song/patter until the musical end of the final song, or word of spoken patter. The Timekeeper’s record is final.
29. Entrants are expected to be prepared for their event at the time of performance. Event staff and judges are not permitted to advise, interpret, or vary any rules, conditions, or any aspect of conduct of YTICC and will not accept responsibility for any effect arising from such un-authorised comment.
30. YTICC is open to individual performers, or self-contained duos (a pair of performers entering as one act/entry, that does not require an additional [third] member/accompanist.)
JUDGES
31. The judge’s decision, in accordance with the rules, is final.
32. If fewer than five entrants register on the day of performance, or if a satisfactory standard is not achieved, the decision to award or not to award places, or prizes at any heat or final, will be at the discretion of the judges and YT. Prizes cannot be divided. Should YTICC judges decide not to give a place or prize, such decision shall be final and binding.
REPRESENTATIONS AND WARRANTIES
33. Each party hereby represents and warrants to the other that: (i) such party has the full power and authority to enter into this Agreement and perform its obligations and grant all rights granted hereunder; (ii) such party’s performance hereunder has not, does not, and will not conflict with, violate, result in a breach or default of, or otherwise adversely affect (a) any existing agreement or understanding to which such party is a party or any such agreement or understanding that such party may enter into subsequent to the date of this Agreement, or (b) any rights of any third party whatsoever, whether now existing or hereafter arising or occurring; and (iii) no pending or threatened claims or litigations exist that actually or potentially adversely affect such party’s ability to fully perform its obligations hereunder or grant the rights it must grant hereunder.
INDEMNITY
34. (a) YT agrees to defend, indemnify, and hold harmless you, your partners and affiliates, and all of the managers, members, shareholders, general and limited partners, directors, trustees, principals, officers, employees, interns, volunteers, licensees, and independent contractors, and the successors and assigns of all of the foregoing, from and against any and all claims, liabilities, damages, costs, and expenses, including, without limitation, all reasonable attorneys’ fees, court witnesses’ fees and costs, and other related expenses (collectively, "Claims"), arising out of (i) any actual or alleged breach of any warranty, representation, agreement, or obligation of YT hereunder, or (ii) any actual or alleged act or omission of YT (or any of its managers, members, shareholders, general or limited partners, directors, principals, officers, employees, agents, successors, or assigns).
(b) You agree to defend, indemnify, and hold harmless the YT Parties from and against any and all Claims arising out of (i) any actual or alleged breach of any warranty, representation, agreement, or obligation of yours hereunder or (ii) any actual or alleged act or omission of yours (or any of your managers, members, shareholders, general or limited partners, directors, principals, officers, employees, agents, successors, or assigns).
COMPLIANCE WITH LAW, RULES, AND REGULATIONS
35. You shall abide by all laws, rules, and regulations applicable to your providing services hereunder, including, without limitation, the rules, regulations, and policies of YT, YTICC, and any of their Contest’s venues, as some may be modified from time to time.
NON-DISPARAGEMENT
36. Each party agrees to not disparage or make any derogatory statements regarding (i) the other party (or such other party’s partners and affiliates, and such other parties and their respective managers, members, shareholders, general and limited partners, directors, trustees, officers, or employees, interns, volunteers, licensees, independent contractors, and sponsors, and the successors and assigns of the foregoing) in connection with the provision of services hereunder, or (ii) this Agreement or YTICC (including, without limitation, any participant, show, or event therein).
GOVERNING LAW; ARBITRATION
37. This Agreement shall be governed by and construed in accordance with the laws of the States of New Zealand and Australia, without giving effect to either territory’s principles regarding conflicts of laws and choice of law. Any controversy or claim arising out of or in relation to this agreement or the validity, construction, performance, or breach thereof (a "claim"), shall be resolved by arbitration in accordance with the rules of the territory from which entrant legally resides, under its jurisdiction before a single arbitrator with at least five (5) years of experience with the principal subject matter of the issues to be arbitrated. The parties hereto shall have the right to engage in pre-hearing discovery in connection with such arbitration proceedings. The parties hereto agree that they will abide by and perform any award rendered in any arbitration conducted pursuant hereto, and that any court having jurisdiction thereof may issue a judgment based upon such award. The arbitration will be held in either New Zealand or Australia, and any award shall be final, binding, and non-appealable.
NO INJUNCTION
38. You agree and acknowledge that in the event of a breach by YT hereunder, the damage caused thereby shall not be irreparable or otherwise so sufficient as to give rise to a right of injunctive or other equitable relief, and your right and remedy in the event of any such breach shall be limited to the right, if any, to recover damages in an action at law and shall not include the right to enjoin the development, production, presentation, advertising, promotion, or other exploitation of YTICC or any part thereof.
