  • This is an agreement for the agistment of:

  • Between:

    Agistor: PVS Training & Equine Services (Pamela Kingwill) Lot 5 & 6, 203 Bowen Developmental Road, Bowen, QLD, 4805 ("the agistor")

    And:

    The horse owner/trainer ("the owner") whose particulars are:

  • Whereby the agistor agrees to agist the owner’s horse or horses identified below ("the horse") at the Agistment property at Lot 5 & Lot 6, 203 Bowen Developmental Road, Bowen, QLD, 4805.
    Commencing from the date of this agreement on the conditions set out below:
    1) The owner agrees to pay all the Agistor’s agistment and other charges, which will be  rendered and payable monthly. Interest at 10% per month on outstanding accounts overdue for 14 daysor more.
    2) The horse/s is at the Owner’s risk at all times. It is the owners responsibility to insure the horse/s and any progeny against all risks while they are at the Agistment property or being transported to and from the property. The Agistor shall not be responsible for any disease, accident, illness or injury whatsoever caused or arising to the horse whilst transporting to or from the Agistment property or at the property.
    3) The owner must notify the agistor immediately the owner becomes aware that the horse/s suffers or has been in contact with any significant or notifiable sickness, disease or injury.
    4) Veterinary services for the horse and or progeny may be provided at the discretion of the Agistor in consultation with the Agistor’s veterinarian. The owner will pay all veterinary charges and other charges incurred while the horse is at the agistment property and  irrevocably indemnifies the agistor for these charges.
    5) The owner gives the agistor a lien over the horse/s and progeny for payment of the  agistment fees and all other charges and expenses which the owner must pay under this agreement. This means the owner may NOT remove the horse/s or its progeny from the property while any part of this agreement in NOT fulfilled by the owner.
    6)The agistor may sell the horse/s and or its progeny at public auction or by private sale to recover any monies owed and or unpaid for 30 days after the agistor has sent the tax invoice or account for payment.
    7) The owner irrevocably appoints the agistor as the owner’s attorney with power to sell the horse/s and or its progeny furthermore to sign all transfers and other documents and do everything necessary to effect and complete the sale and to receive the purchase price and credit it towards the costs of the sale and all monies owing.
    8) Any unlawful behaviour and or breach of the Rules and or Regulations of PVS Training &
    Equine Services may result in immediate dismissal and the owner will
    need to arrange for removal of the horse/s from the property within 7 days. All fees and/or  charges must be paid

  • Conditions of Agistment
  • Agistment Types:

    1. Private Full Service - $38.00 per day ***

    Private paddock with 2 hard feeds and hay per day supplied by PVS Training and fed out by PVS Training. Rug changes (where necessary - owner to supply rugs), twice daily checks and full* use of facilities are included.  

    2. Private Semi Service - $31.50 per day

    Private paddock with 2 hard feeds per day (owner to supply the feed), fed out by PVS Training. Rug change (where necessary - owner to supply rugs). Twice daily checks and full* use of facilities are included.

    3. Shared/Private Full Service - $34.50 per day ***

    Private paddock for 12hrs (approx.) and shared grass paddock for 12hrs (approx.). 2 hard feeds per day to be supplied by PVS Training and fed out by PVS Training. Rugging is available but not recommended for shared paddocks. The agistor will change rugs where necessary (owner to supply rugs), twice daily checks and some use of the facilities included.

    4. Shared/Private Semi Service - $28.00 per day

    Private paddock for 12hrs (approx.) and shared grass paddock for 12hrs (approx.). 2 hard feeds per day to be supplied by the owner and fed out by PVS Training. Rugging is available but not recommended for shared paddocks. The agistor will change rugs where necessary (owner to supply rugs), twice daily checks and some use of the facilities included.

    5. Shared Only Grass Paddock - $21.00 per day

    Shared paddock only, twice daily checks, all extra's are additional. Some use of the facilities included.

    6. Others & Special Arrangments

    As agreed by the Agistee and the Agistor.

    Hard feeding can not be included in option 5. due to all horses being in the same paddock together. Shared/Private or Private Service's are the recommended services for hard feeding options.

  • Additional Charges: (Schedule of charges as at 01.01.2024)

    Horses agisted under options 1 to 4 are entitled to free use of the facilities. Facilities include: Undercover 61m x 24m fully enclosed dressage arena, horse wash bays and tie-up area, stables for a max of 1hour (to be cleaned on departure), float parking (where possible), some storage (where possible), tea room and amenities in the PVS Flat.

    Stables for the horses are available for agisters on a casual basis (when possible) - $15.00 per day

    *Lights on the arena - $10 per session (max 2hrs)

    Rug Washing - $2.00 per cycle (Full Service agisters this is included)

    Worming - $25.00

    Tetnus & Strangles Booster - $35.00

    Farrier - POA

    Dentist - POA

    Theraputical Visits - POA

    Veterinarian - POA

    All additional charges are payable at time of booking the service.

    Surplus Feed - If your horse requires a surplus of feed, special feed or an increased rate of feed a special negotiated agistment rate will have to be discussed to cover the costs.

  • Payment of Accounts:


    Agistment is to be paid monthly, fortnightly or weekly or part there of, in advance (of the same period), by the end of the first week. Invoices will not be issued unless requested.

    Payment may be made:

    Cash in a named envelope and give to Pamela Kingwill.

    Cheque made payable to PVS Training & Equine Services

    Direct Debit into our ANZ account. BSB: 014-504 Account Number: 192132912 Name: PVS Training & Equine Services.

    Dishounoured cheques attract a $25.00 fee for each dishounoured time. Bank fees are payable immediately by owner/s of the horse.

    One months notice is required if a horse is to be removed from PVS Training & Equine Services otherwise a month's agistment must be paid in lieu. PVS Training & Equine Services reserves the right to terminate this agreement at any time by giving an agister a months notice without the need for any explaination.

  • Agisters Responsibility:

    Agisters are responsible for the health and general care of their horses. Staff will assist whenever possible but cannot provide 24 - hour service. Agisters are responsible for keeping clean the wash bays and tie up areas plus removing any manure droped by your horse/s in and around the stable, wash bays, tie up, yard area and arena.

    Horses must be wormed every 3 months (which the Agistor can arrange at a fee if requested by the agister) and vaccinated against tetnus and strangles (which the agistor can arrange at a fee if requested by the agister).

  • Veterinary Care:

    Should an agisted horse require urgent veterinary attention and the agister can not be contacted (in a time deemed suitable by the agistor) or fails to attend when called, the agister authorises PVS Training & Equine Services to obtain such veterinary services (by a veterinary used by the agistor) as they deem necessary and agrees to pay any associated expenses (Section 4 of the Agistment Agreement). In the unlikely circumstances that it is necessary to put a horse down for humane reasons the agister authorises that this be done by the veterinarian.

  • Legal Liability:

    All possible care is taken of horses agisted at PVS Training & Equine Services. However, agistment is provided at PVS Training & Equine Services on the understanding that neither the proprietor/s of PVS Training & Equine Services nor anyone acting on their behalf accepts liability for any loss, damage, accident, injury or illness to horses, riders, owners, spectators or any other person/s or property. The agister agrees to indemnify and keep indemnified and to hold harmless PVS Training & Equine Services and their staff and or agents from and against all actions, costs, claims, charges, expenses and damages whatsoever which may be bought or made and or claimed against them or any of them arising out of or in relation to the use of the property known as PVS Training & Equine Services situated at Lot 5 & 6, 203 Bowen Developmental Road, Bowen, QLD, Australia, 4805 for the period of agistment.

    The PVS Training & Equine Services Indemnity and Relase of Liability Waiver Form must be signed and this form is part of this agreement.

    Please send into PVS Training & Equine Services, Lot 5, 203 Bowen Developmental Road, Bowen QLD 4805 or alternatively you can fill this in online at PVS Training when you drop the horses off for their first day of Agistment.

  • Insurance:

    Agisters are advised to obtain Personal Public Liability Insurance (frequently part of standart household contents insurance). If this is done they should present a copy of the certificate from their insurance company to PVS Training & Equine Services.

    Agisters are advised to obtain a Personal Accident and Ambulance cover for injuries incurred whilst riding. (The cover provided by membership with EA, HRCA or PCAQ is adequate).

    PVS Training & Equine Services does not provide insurance cover for agisters and other users of PVS Trainng & Equine Services. If agisters regard the property they have at PVS Training & Equine Services including their horse to be valuable, the property must be insured.

  • Safety:

    Every effort must be made to avoid situations which have the potential to create accidents.

    Not to drink alcohol or take drugs prohibited by law before or during a ride/lesson.

    Agisters are required to report any safety issues to the proprietor in writing immediately.

    Riders must wear and approved helmet when mounted or lunging their horse. The below list is the current approved safety helmet standards issued by Equestrian Australia. It is the rider or parent/guardians responsibility to ensure that the agistee/riders helmet meets the current standard.

    • Current Australian standard AS/NZS 3838 (2006 onwards) provided they are SAI Global marked.
    • New Australian standard ARB HS 2012 provided they are SAI Global marked.
      Current American standard ASTM F1163 (2004a or 04a onwards) provided they are SEI marked.
    • Current American standard SNELL E2001.
    • Current British standard PAS 015 (1998 or 2011) provided they are BSI Kitemarked.
    • Interim European Standard VG1 (01.040: 2014-12) with or without BSI Kitemark.

    A saddle and bridle must be used whenever riding.

    Only one horse may be led at a time. Dog are allowed but must remain on a leash at all times.

    When saddling or grooming horses in the wash bay and tie up area, these must be clean when vacated.

    Horses must be walked unless being ridden in the arena. Lunging is not permitted in the arena whilst another horse is being ridden.

    After signing this document it becomes a Legal Contract between the signed parties.

    PVS Training & Equine Services reserves the right to change without notice this document or any rules,  guidlines and prices within this document or on the website's. Please be aware of any additional changes and regularly check the website for possible updates.
