Terms and Conditions

Session Information

1.  The session deposit is due at the time of booking. Upon payment of session deposit, Photographer will reserve the time and date agreed upon.

2.  If there are any costs/fees associated with the location the client has chosen for their session, you, the client, will be responsible for those fees.  The Photographer will not guarantee or arrange payment on any location.  A travel fee of $20 + $0.575/mile (standard IRS mileage rate) is incurred for locations over 20 miles from zip code 60630.

3.  Cameras or recording devices are prohibited from the session.

4.  Client is responsible for their own safety and actions, as well as the safety and actions of their children, while at the location of the portrait session. Photographer is not responsible for any liability, accidents, illnesses, damage or loss to person or property that may result from the photography session itself or anything related to the photography session.

5.  If anyone should fall ill or another emergency arises, contact the Photographer as soon as possible to reschedule the session. If, in the opinion of the Photographer, inclement weather or other adverse conditions prevent the creation of a portrait meeting the artistic standards of the Photographer, Photographer may elect to use an alternate location or to reschedule the session.

6.  Cancellations require at least 48 hours’ notice.  Any cancellations made prior to then will receive a full refund of session deposit.  Cancellations made less than 48 hours in advance of the scheduled session will not receive any refunds.

7.  If the Photographer cannot perform this contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, and Photographer is unable to reschedule the session, then the Photographer shall return any deposit or session fee to the client but shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged. In the event the photographer fails to perform for any other reason, the photographer shall not be liable for any amount in excess of the retail value of the client’s order.

8.  The Photographer does have the right to stop a session early due to inclement weather, unsafe behavior of the participants, rude, obnoxious and abusive behavior directed towards the Photographer by participants of the session, with no refund of deposits or fees paid.

Proofing and Ordering

9.  If Client is dissatisfied with the provided images, notice must be sent to photographer within 24 hours of receipt of the images. A re-shoot may be scheduled, solely at the discretion of the Photographer, as quickly as reasonably possible, and all images from the first session will be deleted. Re-shoots will not be offered due to hair or wardrobe choices. 

10.  Images are selected and edited at the Photographers' discretion. The artist reserves the right to edit and release only those images deemed creditable as professional in quality and within the Photographers' artistic standards.

11.  When the Client gallery is ready, the Photographer will post the gallery to an online format.  The Photographer will contact the Client with login information.  The online gallery will remain active for only 7 days.  If Client has not chosen images and completed transactions by midnight on day 7, the gallery will be closed.  Gallery may be re-activated for a fee of $50.

12.  Simple fixes, such as crops and blemish removal may be completed at the Photographer's discretion. More extensive retouching is done at a fee of $25 an hour.

13.  Purchased images are kept on file by Photographer for 1 year after portrait session. Images that have not been purchased are permanently deleted after 30 days. Every effort is made to secure equipment back-up, however due to the unreliability of digital equipment, data loss can occur at any time; except as explained herein, Photographer shall not be liable for any loss of digital data whatsoever.

14.  No part of any order will be delivered until the balance is paid in full.

15.  Print issues (i.e. damage during shipping, discoloration of photo, missing items) must be reported to the photographer within 7 days of receiving order for the issue to be resolved. Order corrections will not be completed after the 7 day time period.

16.  Client is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of dyes, and client releases photographer from any liability for any claims whatsoever based upon fading or discoloration of any photographs.

 

All sessions with Rebecca Hellyer Photography are all inclusive.

That means you always get digital images and there are no hidden costs.

Balance is due upon receipt of your gallery approximately 2 weeks after your session.

All sessions are subject to IL sales tax 1.025% (excluding mini sessions).

 $150 retainer required to book.

 

 PORTRAIT SESSIONS – $600

Families, children, maternity, couples

Up to 2 hours shooting time on-location

30+ images edited in both color and black & white in a private online gallery for viewing and sharing

All digital images via digital download with print release

$150 print credit

 

MINI SESSIONS – $400

 Up to 2 participants

 20 minutes of shooting time

 Choice of 10 full-resolution images via digital download

 

Notice of Copyright

Rebecca Hellyer Photography retains all copyrights to all images created during client’s session. A print release will be provided with digital files to print portraits for personal use. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission. It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Rebecca Hellyer Photography during client’s photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images. If client steals images via any method listed above, or any other method, client will be invoiced for the cost of EACH digital image client has stolen, at photographer’s current price per digital file. Exception: client will receive watermarked, web-size, low-resolution image (by email or on purchased disc of images) for all ordered images (print or digital file) for use in online sharing.

Note from Photographer: I work very hard to create images that reflect you and your family, while keeping in line with my artistic vision and creativity. I know you will want to share them and include a sneak-peek for that very reason. However, I ask that you simply link back to my blog/website/Facebook page instead of right-clicking, saving, and sharing the image via your own page. (You will receive a low-res, watermarked web-image for use in online sharing for every image you purchase) I hope that you will respect not only my hard work, but the time, money, and dedication that I have put into training and equipment to capture these images for you. Please do not steal them.

Model Release

I ("Client") hereby grant to Rebecca Hellyer ("Photographer") and her employees, legal representatives, transferees and assigns, the irrevocable and unrestricted right to use and publish photographs of me and the people listed above, or photographs in which I or the people listed above may be included, for editorial, trade, advertising, commercial, publicity, illustration and any other lawful purpose and in any manner and medium; to alter the same without any restriction; and to copyright the same for Photographer's sole and exclusive use and benefit. I hereby release Photographer and her employees, legal representatives, transferees and assigns from any and all claims and/or liability relating to said photographs. I further release Photographer and her employees, legal representatives, transferees and assigns from any and all claims and/or liability relating to all photography sessions. 

 

NOTE: Having permission to share these images is vital to the continued success of my business, and I greatly appreciate your participation.

 

This contract incorporates the entire understanding of the parties. Any modifications of this contract must be in writing and signed by both parties.

I agree to all terms and conditions laid forth in the Session Contract Agreement.
