Who do you wish to appoint as guardians after your partner has died?
Normally a couple who you would envisage looking after the day to day needs of your children.Please note a father only has the power to appoint a guardian if he has parental responsibility to do so. A mother always has parental responsibility. A father only has parental responsibility if he is married to the mother at the date of birth, if he applies for it at court, if he from 1 December 2003 (15th April 2002 in Northern Ireland) jointly registers the birth of the child with the mother or by a parental responsibility agreement with the mother.
Please note - if you are naming children as beneficiaries under your Will, you should name two executors in addition to your partner, assuming that you wish your partner to be an executor). Please also note that if you are appointing guardians then it is better to name one of the guardians as an executor but NOT the guardians exclusively.
