ACKNOWLEDGEMENT AND ASSUMPTION OF RISKS AND RELEASE AND INDEMNIFICATION AGREEMENT

I fully understand and agree to assume all risks involved in any activities that I take part in at the Animal Adoption Center and I agree to hold the Animal Adoption Center harmless for any injury(s), which I might sustain during the course of my interactions with the Animal Adoption Center.

The volunteer duties are as follows but are not limited to; interacting with dogs in the Center, walking dogs, interacting with the cats in Kitty City and fostering animals.

This waiver does include myself, all of my family members and descendents forever from seeking any legal action whatsoever against the Animal Adoption Center or its representatives.

ASSUMPTION OF THE RISK AND WAIVER OF LIABILITY RELATING TO CORONAVIRUS/COVID-19

PLEASE READ AND SIGN BELOW

The coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. The Animal Adoption Center (“AAC”) has put in place preventative measures based on best available recommendations to reduce the spread of COVID-19; however, even with these preventative measures, the AAC cannot guarantee that you will not become infected with COVID-19. Further, participation in the AAC’s programs could increase your risk of contracting COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by participation in AAC programs; and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the AAC may result from the actions, omissions, or negligence of myself and others, including, but not limited to the AAC employees, volunteers, program participants and their families. I agree that I am personally responsible for my safety and actions while participating in AAC activities and programs. I further agree to comply with all AAC policies, rules, guidelines and signage related to COVID-19 preventative measures.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my participation in the AAC’s programs. On my behalf, I hereby release, covenant not to sue, discharge, and hold harmless the AAC, its employees, agents, contractors and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the AAC, its employees, agents, contractors and representatives, whether a COVID-19 infection occurs before, during, or after participation in AAC programs.

By signing this document, I agree that if I am exposed or infected by COVID-19 during my participation in any activity related to the AAC, then I may be found by a court of law to have waived my right to maintain a lawsuit against the parties being released on the basis of any claim for negligence.
