This Agreement shall commence on [Start Date/From] and remain in effect until [End Date/Until], unless terminated earlier pursuant to the provisions outlined herein. Both parties acknowledge that any necessary modifications to this Agreement shall be formally documented and executed by authorised representatives of both parties. This Agreement shall be reviewed periodically to ensure alignment with the latest NDIS guidelines and any changes in business operations.
Both Parties Acknowledge and Concur:
- In circumstances necessitating modifications, a revised Service Agreement shall be diligently drafted, executed, and duly dated by both signatories upon communication from either party or pertinent industry professionals. No amendment will take effect unless it is made in writing and signed by both parties.
- Alterations to the provisions of this contract shall be formally documented, mutually endorsed by both parties, and accurately dated. Verbal changes hold no contractual effect unless subsequently recorded in writing.
- The stipulations and terms of this Service Agreement remain open for periodic assessment and review at any juncture to ensure ongoing compliance with NDIS pricing structures, operational requirements, and the Customer’s needs.
- Within the context of this Service Agreement, pronouns such as “I”, “my”, “us”, “we”, “their”, “you”, and “your” shall be expressly interpreted to signify the named Customer (NDIS Participant) and/or the designated representative of the Customer as set out above.
NDIS Pricing Clause
All services provided under this Agreement shall be charged in accordance with the current and applicable NDIS Price Guide in effect at the time the service is delivered. Should the NDIS update its pricing schedule during the term of this Agreement, the updated prices shall automatically apply to all future services.
Agreement Modification or Cancellation Notice
A minimum of seven (7) days’ written notice is required from either party to change, modify, pause, or cancel this Service Agreement. Failure to provide such notice may result in charges consistent with NDIS cancellation rules and any minimum booking or travel charges that apply.
Invoicing & Payment Terms
Invoices will be issued within seven (7) days of completing each service, and payment is due within seven (7) days of the invoice date, unless otherwise agreed in writing. The Customer must ensure sufficient NDIS funds or personal funds are available to meet these obligations.
Funding Exhaustion & Customer Liability
If the NDIS Participant’s assigned funding becomes insufficient or exhausted, any outstanding or future amounts owing for services rendered shall become the Customer’s direct financial responsibility. This includes any services delivered when NDIS funds are unavailable at the time of invoice processing. The Customer remains financially liable for services rendered if NDIS funds are insufficient.
The Parties Agree as Follows:
The Service Provider shall perform professional cleaning and/or gardening services in accordance with the terms outlined herein. The Client may elect to receive either Cleaning Services or Gardening Services, or both. The selected services shall be rendered as specified, but are not limited to the tasks enumerated below. Any requests for services outside the agreed scope shall be subject to separate negotiation and approval. The Service Provider reserves the right to update service offerings based on industry best practices and regulatory requirements. Below are the services offered by 4Cleaning WA, with some included as standard services and others available at an additional cost.
Cleaning Services (Charged per Current NDIS Price Guide)
- Vacuuming, mopping, dusting, and window cleaning
- Laundry and utensil cleaning
- Bathroom and toilet sanitation
- Kitchen, pantry, and furniture cleaning
- Carpet/rug shampooing and stain removal
- Cleaning of house frontage, back areas, and garages
- Electronic equipment cleaning
- High dusting and cobweb removal
- Deep cleaning of kitchen appliances
- Upholstery and mattress sanitation
- Waste and garbage disposal
- Tile and grout deep cleaning
- Pressure washing for exterior surfaces
- Organisation and decluttering assistance
- Sanitisation of high-touch areas
- Disinfection and sterilisation as per health safety guidelines
Gardening Services (Charged per Current NDIS Price Guide)
- Mulching, mowing, and trimming
- Lawn mowing and tree/shrub pruning
- Garden maintenance and irrigation
- Green waste removal and disposal
- Weeding and pest control
- Hedge trimming and structural pruning
- Driveway and pathway cleaning and maintenance
- Overgrown vegetation clearance
- Irrigation system checks and adjustments
- Assistance with minor landscaping projects
- Removal of hazardous plants and debris
1. Duration of Service
4Cleaning WA is committed to providing efficient and timely services. To ensure optimal service delivery, all scheduled services will commence within 30 minutes to one hour of the agreed-upon time. The completion of services may occur on, before, or after the predetermined time, depending on operational factors and service requirements. If there are any adjustments in the duration of a service, either during an ongoing session or for future appointments, the Customer will be promptly notified via email, phone call, or direct communication before or after the service execution.
A minimum service duration of two (2) hours per appointment is mandatory. If a Customer requests a service that lasts less than two hours, they will be billed for the full two-hour period. This ensures that service personnel are adequately compensated for their time and resources.
2. Equipment and Chemicals
4Cleaning WA will provide all necessary cleaning equipment, tools, and chemicals to perform the services effectively. The company ensures that all equipment used is of high quality and industry standard to achieve optimal cleaning and gardening results.
In cases where the Customer requests the use of their own cleaning materials or tools, adjustments to service charges may be considered. However, this is at the discretion of 4Cleaning WA, and additional costs may apply if the provided equipment affects service efficiency.
For services requiring electrical power, all cleaning equipment will be connected to the Customer’s wall-mounted power socket via a surge-protected connector to help prevent electrical anomalies. However, 4Cleaning WA shall not be held responsible for any pre-existing electrical issues or unrelated electronic malfunctions that may occur during or after service execution.
3. Gardening Service Weather Advisory & Policy
3.1 Impact of Weather Conditions on Gardening Services
Gardening services are highly dependent on weather conditions, and extreme weather may negatively affect service quality and personnel safety. The following conditions are considered when scheduling gardening services:
3.1.1 Summer Conditions
During extremely hot and dry periods, soil hardens, plants become stressed, and the overall effectiveness of gardening treatments decreases. Additionally, excessive heat exposure poses health risks to gardening personnel, which may lead to interruptions in service delivery.
3.1.2 Rainy Conditions
Heavy rainfall can result in slippery and muddy soil, making it hazardous for personnel and reducing the efficiency of gardening treatments such as fertilisation and pest control. Wet conditions may also prevent the use of gardening tools and machinery, requiring a delay or rescheduling of the service.
3.2 Measures for Weather-Related Disruptions
To minimise disruptions caused by adverse weather, 4Cleaning WA will:
- Notify the Customer in advance if services need to be rescheduled or modified.
- Prioritise safety, ensuring that gardening personnel are not exposed to dangerous weather conditions.
- Offer rescheduling options to the Customer in the event that services cannot be performed as scheduled.
The Customer is expected to cooperate with any weather-related changes to ensure the continued maintenance of their garden under safe and effective conditions.
4. Additional Gardening Services & Charges
Certain gardening services require specialised skills, resources, and time and may be subject to additional charges. These services include, but are not limited to:
4.1 Green Waste Removal
While standard gardening tasks include minor cleanup, the disposal and transportation of large volumes of green waste fall outside standard services and may incur additional costs. Charges are determined based on the volume and nature of the waste requiring removal.
4.2 Mulching Services
Mulching is an effective method for retaining soil moisture, suppressing weed growth, and improving soil quality. However, the costs of mulching services vary based on:
- The area size requiring mulch application; and
- The type of mulch selected.
Customers are encouraged to discuss mulching needs during the quotation phase to ensure clarity regarding costs.
4.3 Watering & Sprinkler Systems
The design, supply, and installation of irrigation and sprinkler systems require specialised expertise and materials. These services are billed separately, with pricing based on:
- The complexity of the system to be installed; and
- The size and layout of the Customer’s garden.
Customers interested in a customised watering solution should consult 4Cleaning WA during the quotation process to receive a detailed cost breakdown.
5. Liability & Damages Policy
4Cleaning WA is committed to maintaining the highest standards of service and takes responsibility for any damages caused due to employee negligence or misconduct.
5.1 Liability Coverage
- 4Cleaning WA shall assume full or partial liability for any damage to property, persons, or objects caused during service execution.
- Liability is assessed based on the nature of the damage, the extent of negligence, and other relevant factors.
5.2 Incident Assessment & Investigation
If a damage claim is reported, 4Cleaning WA reserves the right to conduct a thorough investigation, which may include:
- Reviewing photographic evidence submitted by the Customer;
- Interviewing service personnel and other involved parties; and
- Consulting external specialists, if necessary.
5.3 Resolution & Compensation
Following the investigation, 4Cleaning WA will take appropriate corrective action, which may include:
- Arranging repairs to restore the damaged item or property;
- Offering monetary compensation, if repair is not a feasible option; and
- Determining compensation amounts based on the severity of the damage and applicable costs.
5.4 Additional Conditions
- 4Cleaning WA is not liable for pre-existing damages.
- All damage claims must be reported within 24 hours of service completion.
- Customers must provide photographic and written documentation to support any claims.
6. Service Booking & Changes
Customers may schedule cleaning or gardening services during business hours, subject to availability. Bookings may take up to four (4) weeks to process, depending on operational capacity. If a service cannot be fulfilled within the stipulated timeframe, the Customer will be notified in advance.
6.1 Service Modifications & Cancellations
- Customers must notify 4Cleaning WA of any service changes at least 48 hours before the scheduled appointment.
- Late cancellations (after personnel have commenced travel) will result in a cancellation fee equal to a minimum of three (3) service hours.
- Rescheduling requests will be accommodated based on availability, with alternative slots provided where possible.
7. Payment Terms & Charges
- Invoices are issued within seven (7) days of service completion and are payable within seven (7) days of the invoice date.
- A five percent (5%) monthly late fee may be applied to overdue balances.
- Accepted payment methods include bank transfer, credit card, and direct debit. Customers may also opt for prepaid service packages, allowing for multiple scheduled sessions to be paid in advance for uninterrupted service.

- General Cleaning: as per current NDIS Price Guide.
- Gardening Services: as per current NDIS Price Guide.
- Travel Services: as per current NDIS Price Guide (where applicable).
- Quotation Services: Free of charge ($0.00).
Prices are subject to adjustment based on service scope, additional requests, and any changes in the NDIS Price Guide.

ADDITIONAL LEGAL TERMS
The following Additional Legal Terms apply to strengthen enforceability, clarify responsibilities, and ensure compliance with Western Australian law. These terms support and supplement all other parts of this Agreement.
1. Definitions & Interpretation
Terms such as “Business Day”, “NDIS Pricing Arrangements”, “Service Provider”, and “Customer” apply throughout this Agreement. Headings are for convenience only and do not affect interpretation.
2. Duty to Cooperate
Each party must do all reasonable things necessary to give full effect to this Agreement, including providing information, access, and cooperation to allow safe and effective service delivery.
3. Access & Safety Requirements
The Customer must provide a safe environment for staff. The Service Provider may refuse or discontinue services where hazards, aggressive behaviour, illegal activity, or unsafe conditions exist. Such refusal does not constitute a breach of this Agreement and applicable charges may still apply.
4. Limitation of Liability
The Service Provider is not responsible for pre-existing damage, damage caused by third parties, pets, or household members, or issues arising from unclear or incorrect instructions. To the maximum extent permitted by law, liability is limited to the cost of re-supplying the affected portion of the service.
5. Indemnity
The Customer indemnifies the Service Provider for losses arising from the Customer’s breach of this Agreement, failure to disclose hazards, or third-party actions within the premises. This indemnity survives termination of the Agreement.
6. Privacy
All personal information is collected, stored, and handled in accordance with the Privacy Act 1988 (Cth) and relevant NDIS requirements. Information is used only for purposes related to the provision and management of services under this Agreement.
7. Insurance
The Service Provider maintains appropriate insurance, including Public Liability and Workers’ Compensation insurance. Evidence of coverage can be provided upon reasonable request.
8. Force Majeure
The Service Provider is not liable for delays or failure to perform obligations due to events beyond reasonable control such as severe weather, illness, pandemics, power outages, or other emergencies. Services will resume or be rescheduled as soon as reasonably practicable.
9. Dispute Resolution
Parties agree to first attempt to resolve any dispute through good-faith communication. If unresolved, either party may refer the matter to external bodies, including the NDIS Quality & Safeguards Commission or Consumer Protection WA. During a dispute, services should continue where reasonably possible.
10. Notices
Notices must be in writing and may be delivered by email, SMS, or post to the most recent contact details provided by each party. Notices are deemed received on the next Business Day after sending unless proven otherwise.
11. Assignment
The Customer may not assign or transfer this Agreement without the prior written consent of the Service Provider. The Service Provider may subcontract or assign aspects of the service while remaining responsible for overall service quality.
12. No Waiver
Failure by either party to enforce any term of this Agreement does not constitute a waiver of that term or any other term, and does not prevent future enforcement.
13. Entire Agreement
This Agreement, including these Additional Legal Terms, constitutes the full understanding between the parties and supersedes any prior verbal or informal arrangements regarding the same subject matter.
14. Governing Law
This Agreement is governed by the laws of Western Australia. The parties submit to the non-exclusive jurisdiction of the courts and tribunals of Western Australia.
