Summerly Photography Service Agreement

This is a contract between Summerly Photography and the following parties:

WEDDING PACKAGE: All packages include the photographer's time for the package selected, a high-resolution flash drive of JPG photos with printing rights, and an online ordering gallery for friends and family. Flash drives will be mailed to the client upon completion of editing. All coverage hours are continuous and shall not be split up.

RETAINER: A retainer in the amount of $800 is due at the time the contract for services is signed. This reserves my services for the above date. Upon signature and receipt of the retainer, photographer will reserve the date and time agreed upon and will not make other reservations for that date and time. For this reason, the retainer payment is non-refundable. If this event is cancelled for any reason, Summerly Photography shall retain all monies paid in order to offset any loss of business.

PACKAGE OPTIONS:

2. $2500 8 hours of coverage, high-resolution photos delivered on a flash drive, online gallery

3. $3300 8 hours of coverage, second shooter, engagement session, high-resolution photos delivered on a flash drive, online gallery

4. $3200 10 hours of coverage, high-resolution photos delivered on a flash drive, online gallery

5. $4000 10 hours of coverage, second shooter, engagement session, high-resolution photos delivered on a flash drive, online gallery

Remaining balance is due on or before the event date listed above. Once a balance is paid, it is non-refundable.

CANCELLATION FEE: If the client cancels within 6 months of their secured date for any reason, 35% of their total package price is due within 2 weeks of cancellation. If the client cancels within 30 days of their secured date for any reason 100% of their total package price is due within 2 weeks of cancellation. Complimentary engagement sessions are contingent on full package payment. In the event of cancellation, completed engagement sessions must be paid for in full within 2 weeks of cancellation, for services rendered. All cancellations must be put in writing.

COPYRIGHT AND USAGE: The client will have the right to make and use copies of the pictures for their own use in e-mail, on personal web pages, on social networking sites and reprints. Client will not use the images for commercial use. Client will not alter the images in any way when using them on their personal web pages or any social networking site. Summerly Photography retains copyright in all images created and will have the right to make reproductions for portfolio samples, self-promotion, and any public database owned or operated by Summerly Photography or its subsidiary. Client must obtain permission from Summerly Photography before submitting any photos for publication.

CREATIVE LICENSE: The photographer’s portfolio is not a guarantee of style. Images are edited at the photographer’s discretion, and flash drives will not include all images shot. The photographer reserves the creative right to edit and release only those deemed creditable as professional in quality and within the photographer’s artistic standards. The Client understands that although Summerly Photography will do their best to recreate requested photos found on Pinterest or other such sites, Summerly Photography is being commissioned for her style of photography and not the styles of others.

EXPENSES: Clients are responsible for all location fees and permits. Expenses such as parking or admittance fees must be paid to Summerly Photography prior to the event date.

RETURNED CHECKS: All returned checks will incur a $60 returned check fee. If your check is returned for any reason you must pay your total remaining balance plus the return check fee by cash or money order only.

EVENT FOOD SERVICE: A hot meal is required for all photographers associated with Summerly Photography. Any event lasting 10 or more hours may require more than one meal. If a meal cannot be provided, it is agreed that the photographer(s) will be allotted a reasonable time frame to obtain one, going off-site if necessary.

GARMENTS: Summerly Photography cannot be held responsible for damage to garments during environmental events.

ARCHIVAL: Upon receipt of a flash drive, the client accepts all responsibility for archiving and protecting the photographs. Summerly Photography cannot guarantee all photos will be permanently archived.

EXCLUSIVITY: Summerly Photography shall provide exclusive coverage for the event. Wedding guests may take photos for non-commercial purposes, but it is the responsibility of the client to prevent family and friends from interfering with the photographer's duties. Guests as well as other vendors are not permitted to take photos during formal sessions.

HARASSMENT POLICY: Summerly Photography will not tolerate any verbally or physically abusive behavior. If the client or their guests are unable to control the conduct of themselves or their guests, resulting in an unacceptable degree of misconduct, the client will be given one opportunity to resolve the problem. If the problem persists, it will be considered a contractual breach and result in the immediate departure of the photographer. Summerly Photography will not be held accountable for any lack of coverage due to the above. Client remains responsible for full payment of any remaining balance due.

LIMITS OF LIABILITY: It is acknowledged that any requests submitted to Summerly Photography will be used for organizational purposes only and in no way represents photography that will be produced. Summerly Photography will make a best effort attempt to fulfill all requests but can make no guarantees that all images will be delivered. Summerly Photography cannot be held responsible for lost photo opportunities, requested or not, due to schedule complications or unsatisfactory conditions caused by, but not limited to, weather, timeliness of event participants or attendees, church or location restrictions, or extraneous cameras or flashes. If Summerly Photography cannot perform this agreement due to extreme conditions caused by, but limited to, road closures, severe traffic, fire, casualty, Acts of God, terrorism, or other causes beyond the control of Summerly Photography, any monies paid by the client shall be returned, less expenses and retention fees, and Summerly Photography shall have no further liability in the matter. In the event of debilitating illness, injury, or incapacitation, Summerly Photography will make a best effort attempt at finding an adequate replacement. If a replacement is provided, this contract and all agreements contained within will be transferable to the replacement. If a suitable replacement cannot be provided, any monies paid by the client shall be returned, less expenses, and Summerly Photography shall have no further liability in the matter. This limitation of liability shall also apply in the event that photographic materials are damaged in processing or lost through equipment or media malfunction.

AGREEMENT: This agreement is not valid until it has been received along with payment of the deposit as specified by the Payment terms listed. By signing this document the undersigned agrees that all parties involved understand and agree to all of the above.
