CONDITIONS OF BOOKING
1. DEPOSIT, PAYMENT, BOOKING & CONFIRMING DATES: To reserve your session date, full payment of invoice is required by Paypal. Until this payment is made, your date is not reserved and remains open for booking by other clients. This payment is not refundable under any circumstance, but may be transferable. No photographs, digital or prints, will be released prior to full payment. There are no refunds available after images have been delivered. Once original invoice has been paid, any future price and/or inclusion changes will not affect your session, as long as the client’s session is booked and completed within 60 days of invoice date. After this time, Morgan Ellem Photography has the right to charge the client current pricing. Session inclusions are non-negotiable and non-exchangeable. All session dates will be booked and confirmed upon receipt of payment. One weeks’ notice is required for all sessions to change original booking date, except where circumstances do not allow (eg. sickness, bad weather).

2. IMAGES & COPYRIGHTS: Prints provided by Morgan Ellem Photography may not be reproduced in any manner. Upon receiving high-resolution images (if included as part of selected Package) the client may make prints for personal use and sharing. Web images may be used online for personal blogs, websites and social media. The client is aware that non-professional prints may not show correct colour, brightness or quality compared to professionally printed photographs. No further editing, creative cropping, or colour conversions may be applied to any image supplied by Morgan Ellem Photography. Under no circumstances will RAW or unedited JPGS be released . The client must obtain written permission from, and compensate Morgan Ellem Photography prior to the client, or its friends/relatives, publishing or selling any image for profit. Morgan Ellem Photography hereby obtains all rights to use the photographs under no restrictions whatsoever, including, but not limited to, print and/or web advertising, with any post-processing or manipulation deemed appropriate by the photographer. Morgan Ellem Photography hand-edits all client images to reflect photographer's creative style. Any further editing requested by the client will incur an extra cost ($100/hour). Although all effort is made with pre-session advice, photographer cannot be held responsible for poor clothing choices, unflattering natural expressions, or unwilling/difficult children.

3. MODEL RELEASE: The client hereby grants full ownership, copyright, and any other rights in any and all images produced during the session to Morgan Ellem Photography along with the right to reproduce any of the images by any means or method, and in any medium, now known or created in the future. The client releases any legal claims or disputes, now or in the future, against Morgan Ellem Photography and understands fully that the photographer is under no legal obligation to compensate for me for the use of any image(s).

4. LIMIT OF LIABILITY: In the unlikely event that the photographer is ill or injured, or has an extreme emergency that prevents her from photographing the session, Morgan Ellem Photography will make every effort to reschedule the session. If for whatever reason this is not possible, responsibility and liability is limited to the return of all payments received from the client for the session. In the unlikely event that photographs from the session are lost, stolen or destroyed before the client receives their images, liability of Morgan Ellem Photography is limited to the return of all payments received from the client for the session. Morgan Ellem Photography will keep all client images for a maximum of six months from date of session. After this time, images may be purged and/or deleted with no option of recovery. The client understands that it is their responsibility to personally back-up their own files for protection against permanent loss. If the client requires a replacement disc within six months of session, a $50 fee may be charged.

5. STUDIO: Parents must be in full control of their child/ren's behaviour whilst in my home/studio. Any damage to structure (including but not limited to walls, doors, etc), furnishings (including but not limited to curtains, carpet etc), or Photographer's camera, equipment, or props, caused by the client/children, must be paid for by the client. Morgan Ellem Photography reserves the right to withhold the release of any client images until damage has been repaired/replaced.
