PORTRAIT AGREEMENT & MODEL RELEASE: I have read and agree to the following statement: I commission Simply You Photography, the photographer, Stacy McDonald, to photograph myself and/or my underage children. I hereby grant Simply You Photography and her legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of myself, family, and/or child(ren), or in which myself, family, and/or children will be included for editorial, trade, advertising, and any other purpose and in any manner or medium; to alter the same without restriction; and to copyright the same. I hereby release Simply You Photography and her legal representatives and assigns from all claims and liability relating to said photographs.

COPYRIGHT: As a client and/or contracting client of Simply You Photography, I acknowledge and understand that the images taken by Simply You Photography, Photographer; Stacy McDonald, are protected by Federal Copyright Laws. I understand it is ILLEGAL to copy or reproduce these photographs elsewhere without the PHOTOGRAPHER's permission, and violaters of this Federal Law will be subject to its civil and criminal penalties. A limited PRINT RELEASE is supplied with the purchase of my session digital files to print your portraits for your own personal use. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering your images without the PHOTOGRAPHER's permission. Reproduction includes, but is not limited to scanning, downloading, right-clicking, emailing, saving to harddrive, posting on websites or blogs, photocopying, obtaining screen shots, or printing in any manner. Client and contracting party understands the original pictures (RAW Format) are the sole property of the photographer will not be released to the client under any circumstances. Only edited images will the released to the client. Client and contracting party understands that any additional editing images requested by the client (i.e. photoshopping, additional enhancing, etc.) will be subject to an additional charge once they have been uploaded to the contracting party's individual web gallery. Simply You Photography is not responsible for the clothing choices and the way your clothing photographs on the client. I agree to honor the copyright laws as stated in this agreement.

By signing below you certify that you are at least 18 years of age. You have read this portrait agreement/contract and fully understand the contents thereof. You agree that you have the legal authority to grant these permissions and accept all responsibility for such.

A non-refundable retainer is due upon booking in order to reserve your photography session. The retainer fee is deducted from remaining balance or applied to my office time, if the client chooses to cancel. All remaining balances are due at the time of your session. No part of any order, including proofs will be delivered until the balance is paid in full. Your time and date is not reserved until the retainer is received full and clear. Therefore, the deposit is non-refundable upon cancellation with less than 48 hour notice. If you cancel with less than 48 notice, you forfeit your retainer and may not reschedule without a new retainer. Re-scheduling may occur to save your deposit if you give at least 48 hours notice and the date is rescheduled within 2 weeks of the original reserved date or if there is a family emergency or serious illness. I cannot always guarantee an available date two weeks out but will try my best to accommodate. Re-scheduling of the date due to bad weather may occur at my discretion only.
